Dear Ms. Bretz:

This letter is to serve as acceptance of the offer submitted by your agency on February 10, 2016. In accordance with Section 8(a) of the Small Business Act (15 USC 637(a)(1)) and the Federal Acquisition Regulation (FAR) Part 19.8, and the executed Partnership Agreement between the U.S. Small Business Administration (SBA) and the Department of Homeland Security, SBA hereby accepts your offer letter for competition in the 8(a) Business Development (BD) Program for:

IDIQ for Design/Build Construction Multiple Award Contracts for Coast Guard District/Region 7 with Competition being limited to 8(a) Firms in the states of Florida, Georgia, and South Carolina.

Our analysis indicates that acceptance of this requirement meets the criteria for competition in the 8(a) BD Program. You have designated a North American Industry Classification System (NAICS) Code of 236220 for this requirement. This NAICS Code should not be changed without prior coordination with this office. The assigned SBA Requirement Number is 0455-16-601505-01. Please reference this number should you need to contact this office relative to this procurement. The SBA Requirement Number should also be referenced on any resultant contract award documents.

You are authorized to announce the acquisition in the Federal Business Opportunities (FedBizopps) online publication and issue a solicitation. However, you must state in the publication the geographical restriction of the requirement in the announcement. The following statement should be included in the announcement: It has been determined that competition will be limited to 8(a) firms located in the states of Florida, Georgia, and South Carolina and other 8(a) construction firms with a bona fide place of business within the geographical competitive area, and the assigned NAICS code. All other 8(a) BD Participants are deemed ineligible to submit offers.

At the conclusion of your evaluations, please advise the SBA District Offices of the apparent successful offeror. Your notice must include the firm’s name, the anticipated award value for the first year, and the total dollar amount of the award.

Additionally, the notice should include the date of the firm’s representations and certifications and the date of the firm’s initial date for receipt of offers so that a determination of the 8(a) firm’s eligibility can be made by SBA. Within five (5) business days of this notification, SBA will confirm the eligibility of the apparent successful offeror to receive the contract award and notify your office, in writing, of its determination. If the 8(a) firm is found ineligible, the SBA District office that Services that Firm will

Francisco A. Marrero District Director

Jonel Hein Deputy District Director

Ms. Jean Bretz inform you, in writing, of the firm’s ineligibility and request that you send SBA the name of the next highest evaluated 8(a) firm for an eligibility determination.

Under the terms and conditions of the Partnership Agreement, you are to execute and distribute one copy of the contract, including basic contract, orders, modifications, and purchase orders, if applicable, to our office within 15 business days of the award. The SBA must be consulted prior to any changes that affect the scope of the contract.

In addition, the Department of Homeland Security will retain the responsibility for compliance with the limitations on subcontracting requirements and all applicable provisions of FAR Section 52.219-14. Upon detecting any violations of the Ostensible Subcontracting rule, procuring agencies should immediately notify the SBA’s Headquarters office via an email to: 8abd2@sba.gov.

In the event that this requirement does not result in a contract award, please notify the SBA District Office.
