Sole Source Justification for Simplified Procedures for Certain Commercial Items
FAR 13.501(a)(1)(ii)
(1) Agency and Contracting Activity.
The Department of Homeland Security (DHS), United States Coast Guard Command, Control, & Communications Engineering Center (C3CEN), Portsmouth, VA proposes to enter into a contract on a basis under the simplified procedures for certain commercial items.
(2) Nature and/or description of the action being approved.
The USCG has a requirement to procure, on a sole source basis, an unlimited license agreement to install a G849 Digital Voice Privacy Processor (DVP-200) interface option that enables Type III protected communications over High Frequency (HF) radios into existing US Coast Guard owned MICOM 3T HF radios onboard all OTH, 33’, 45’, 47’, 52’ boats, 87’& 160’ cutters and MICOM 3Ts HF radios currently in stock or upon acquisition platforms.
The contract for the equipment and licenses will be awarded to:
Royal Communications International, Inc.
3135 Coachman Ct Oceanside, CA 92056
(3) Description of Supplies/Services.
The following equipment required is:
QTY P/N EQUIPMENT DESCRIPTION

Does not include interface cable.

(4) Identification of the justification and the rationale.
This sole source acquisition is being conducted under the simplified procedures for certain commercial items under the authority of 41 U.S.C. 1901 as implemented by the Federal Acquisition Regulation (FAR) 13.501(a)(1)(ii).
(5) Demonstration that the nature of the acquisition requires use of the authority cited.
DHS has mandated (Sensitive Systems Handbook 4300A) that all tactical communications equipment are required to have a minimum of 256-bit AES encryption. C3CEN discovered that an unknown number of MICOM 3T HF radios do not have the required Voice Privacy option that enables Type III protected communications over High Frequency (HF) radios.
The 256-bit AES encryption requirement mandated by DHS is fulfilled by the DVP-200.
However, for the MICOM 3T’s to be fully compatible with the DVP-200, the G849 VP Option must be enabled within the radio. The only entity that can enable this internal feature is Royal Communications International, Inc, as named the only authorized sales and service reseller by the OEM.
This procurement action will provide the MICOM 3T HF radio the capability identified in the requirements from CG-761. That is, to enable Type III protected communications over HF through the Rockwell Collins Digital Voice Privacy Processor (DVP-200) device. C3CEN intends to have the subject radios inspected and if the feature is not installed, use one of these licenses to bring the radio up to the approved baseline. This will save the US Coast Guard significant schedule impacts by allowing for a field upgrade vs. shipping back to the factory.
Without the G849 option installed, tactical communications via the MICOM 3T HF radio will be out of compliance with DHS Sensitive Systems Policy Directive 4300A and not interoperable with partner DHS agencies via the COTHEN protected circuit.
(6) A description of the efforts made to ensure that offers are solicited from as many potential sources as is practicable.
No additional sources have been identified for the procurement of the VP Option. MOBAT-USA (OEM) provides only one authorized sales and service reseller in North America: Royal Communications International, Inc. The VP Option is an internal feature within the radio itself that can only be enabled by authorized service resellers.
(7) Determination by the Contracting Officer that the anticipated cost to the government will be fair and reasonable.
The Contracting Officer determines the anticipated prices will be fair and reasonable based upon comparison to published commercial price lists for the required components. If necessary, other than cost and pricing data will be requested to ensure that all prices are deemed fair and reasonable.
(8) Description of market research.
After discussions and verification from the OEM and due to the proprietary nature of the software and hardware being procured; no other sources could be identified.
(9) Any other facts supporting the use of other than full and open competition.
None
(10) A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.
Royal Communications International, Inc is the only source that has expressed interest in the proposed acquisition.
(11) A statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for required supplies or services.
Future replacement of the entire radio system will use full and open competition.
(12) Contracting Officer’s Certification.
I certify that the data supporting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief.
Jessica L. Coltz Date Contracting Officer
(13) Technical/Requirements Personnel Certification.
I certify that this requirement meets the Government’s minimum need and that the supporting data, which forms a basis for the justification, is accurate and complete.
LT Christopher A. Rogers Date Technical Representative/COR
(14) Legal Review and Concurrence:
I have reviewed this justification and deemed it legally sufficient.
