NOTICE FOR FILING AGENCY PROTESTS

United States Coast Guard Ombudsman Program

It is the policy of the United States Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation.

OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the Government Accountability Office (GAO).

Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative

Dispute Resolution (ADR) forum rather than filing a protest with the GAO or some external forum.

Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the Contracting Officer or Ombudsman.

Informal Forum with the Ombudsman. Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the applicable Contracting Officer. If the

Contracting Officer is unable to satisfy their concerns, interested parties are encouraged to contact the

U.S. Coast Guard Ombudsman for Agency Protests. Under this informal process the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, Contracting Officer, and solicitation closing date (if applicable).

Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the Contracting Officer through open and frank discussions. If the protester‘s concerns are unresolved, an Independent Review is available by the

Ombudsman. The protester may file a formal agency protest to either the Contracting Officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government.

The agency‘s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103(d) (2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. To be timely protests must be filed within the period specified in FAR 33.103(e). Formal protests filed under the OPAP program should be submitted to:

Each offer submitted will be evaluated separately.

(f) Late submissions, modifications, revisions, and withdrawals of offers.

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)

(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and—

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt mailto:D05-SMB-C4ITSC-CPD-C3CEN-TeamD@uscg.mil of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the

Government reserves the right to conduct discussions if later determined by the Contracting

Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

(End of Provision)

D.2 52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the

Government, price and other factors considered using the trade-off process. The following factors shall be used to evaluate offers:

1) Past Performance (more important than Technical Capability/Approach)

The Government will evaluate an offeror’s past performance based on any of the following:

(1) past performance questionnaires/surveys, (2) the Past Performance Information Retrieval

System (PPIRS), and/or any other source, including the Contracting Officer’s knowledge of and/or previous experience with the offeror. The offeror’s past performance will be evaluated based on the degree to which current and previous contract efforts indicate the probability of the offeror successfully accomplishing the requirements of the statement of work. The currency and relevancy of the information, source of the information, context of the data, and general trends in contractor’s performance will be considered. Past performance information received from the offeror shall be within the past 3 years or ongoing and be relevant to this requirement (i.e., for same or similar requirement.) Current performance will have a greater impact in the evaluation than less recent performance. Although the Government will consider information obtained from other sources, the burden of providing thorough and complete past performance information rests with the offeror. Only relevant past performance will be evaluated. An offeror’s lack of relevant past performance will not be evaluated favorably or unfavorably and will be rated as “neutral”.

2) Technical Capability/Approach (less important than Past Performance and more important than price).

The Government will evaluate the Contractor’s Proposal for Knowledge and understanding of the SOW and Feasibility and Soundness of Contractors written proposal. The Government will evaluate the Contractor’s capability and approach to describe testing and repair procedures; to include specific tools/equipment that will be utilized for testing and repair procedures.

3) Price (significantly less important than Past Performance and Technical

Capability/Approach when combined)

The Government will evaluate price for reasonableness. Offerors are required to provide prices for all items/CLINs. A price proposal that is inconsistent with the technical proposal will be a basis for finding the technical proposal to be unacceptable. Unit prices left blank or annotated with something other than a dollar figure will be considered unacceptable and the proposal may be rejected without any further consideration. The other evaluation factors are significantly more important than price. Although price is not the controlling factor in award of this contract, it is an important factor and should not be ignored. The degree of its importance will increase with the degree of the equality of the proposals in terms of the other evaluation factors. If competing proposals are substantially equal in Technical

Capability/Understanding and Past Performance, price may be the controlling factor in award.

b) Basis for Award. The Government will conduct a tradeoff process to determine the vendor whose quote represents the best value to the Government. In doing so, the Government may award to other than the lowest priced proposal or other than the highest technically rated proposal. However, the technical evaluation factors, when combined, are significantly more important than price. The evaluation factors are listed above in descending order of importance. When combined, non-price factors (Past Performance and Technical

Capability/Approach) are significantly more important than price. As non-price factors converge, price gains importance in making the award selection.
