(4) Identification of the exception to fair opportunity.

In this situation, the new work consists of a period of performance extension to be issued on a sole-source basis in accordance with FAR 16.505(b)(2)(i)(E). Per the terms of the GWAC, orders do not require offer and acceptance from SBA per FAR 19.804-6(a). The new work could be accomplished through issuance of a new task order supported by FAR 16.505(b)(2)(i)(E), however due to administrative convenience and efficiency it is in the Government’s best interest to issue a modification to the existing task order to extend the period of performance in accordance with FAR 52.217-8 Option to Extend Services. The clause was included in the original task order award; however the Government failed to include the potential value of the Option in the task order award amount. By not including the potential value in the award the Government did not properly evaluate the option. As a result of these failures, the exercising the option requires the approval of a Fair Opportunity Exception.

The extension is needed to allow sufficient time to transition the required services to the USCG C3CEN Installation Logistics Maintenance Services (ILMS) multiple award IDIQ contract vehicle without a break in services. The duration of the extension and the pricing of the extension are in accordance with FAR 52.217-8.

(5) Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer determines that the anticipated price will be fair and reasonable based on upon comparison to GWAC awarded rates and comparison to the rates established upon award of task order HSCG44-12-F-PC2335. In accordance with FAR 52.217-8, the services will continue at the current rates which were determined fair and reasonable at time of task order award. The Contracting Officer has determined that extending the period of performance of the subject task order represents the best value and will result in the lowest overall cost alternative, considering price and administrative costs, to meet the Government’s needs.

(6) Any other facts supporting the justification.

There are no additional facts to support this justification.

(7) A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the exception to fair opportunity.

No additional actions will be taken to remove barriers to competition. The follow-on procurement will be transitioned to the USCG C3CEN ILMS multiple award IDIQ contract vehicle. Future requirements for the same services can be solicited using fair opportunity procedures in accordance with FAR 16.505(b)(1) and in accordance with ILMS contract ordering procedures
