6. Pursuant to FAR Subpart 13.106-1 (b), the Contracting Officer may solicit from one source if they determine that the circumstances of contract action deem only one source reasonably available:

Check the appropriate reason below:

XX Only one responsible source and no other supplies or services will satisfy agency requirements, i.e. Unique capabilities, Limited number of sources, Proprietary data.

XX Brand Name Mandatory ___Unusual & Compelling Urgency ___Exclusive Licensing Agreements ___Industrial Mobilization/Standardization

7. Impact Statement (describe the impact on the mission or property)

These Various Parts are proprietary commercial items of the proposed contractor.

The U.S. Coast Guard did not negotiate the purchase or unrestricted use of any technical data associated with these items when they were originally acquired for fleet applications. Accordingly, the reproduction manufacturing drawings, specifications, repair tolerances/parameters and other relevant information needed to purchase these items remain the sole property of the OEM.

8. Explain why an adequate purchase description or other information suitable to solicit by Full and Open Competition has not been developed or are not suitable.

Since the technical information required in making a fair and reasonable assessment of these Various Parts is unavailable; the OEM is the only contractor that can guarantee interchangeability of these items. Therefore, we are restricted to and must rely solely upon the OEM or an authorized OEM distributor to satisfy the current acquisition need. Any attempt to purchase these items using other than the OEM or an OEM certified distributor could cause equipment failure and subsequent failure to meet unit mission requirements.

9. Provide a Statement of Actions, if any, the government may take to remove or overcome any barriers to competition before future acquisitions are required.

COTR will continue to conduct market research with a focus on the locating vendors with the required specialized capabilities needed for this type of work.
