SIMPLIFIED ACQUISITION PROCEDURES (SAP)

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (J&A)

SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER DETERMINES THAT ONLY ONE SOURCE IS REASONABLY AVAILABLE. THIS DETERMINATION MUST BE SUPPORTED WITH FULL JUSTIFICATION FOR SOLE SOURCE FROM THE CUSTOMER. WHEN THE CUSTOMER DESCRIBES AN ITEM WITH A PURCHASE DESCRIPTION WHICH LIMITS THE AVAILABILITY TO ONE SOURCE, THE JUSTIFICATION MUST EXPLAIN WHY THE ITEM IS THE ONLY ONE THAT WILL MEET THE GOVERNMENT’S REQUIREMENT. STATEMENTS SUCH AS "ONLY KNOWN SOURCE" OR "ONLY SOURCE WHICH CAN MEET THE REQUIRED DELIVERY DATE" ARE INADEQUATE TO SUPPORT A SOLE SOURCE PURCHASE. BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRE, AND THE INTENDED USE

The United States Coast Guard (USCG), Aviation Logistics Center (ALC) has a requirement on a sole source basis, to procure the renewal of the HVR Software subscription and support for one year from 01 October 2016 through 30 September 2017.

UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE,

HVR Software B.V. is the sole supplier of this software. HVR Software B.V. has verified that no distributors exist for their proprietary products. HVR Software B.V. allows replication of database files and data between ALC and the disaster recovery site located at Operations Systems Center (OSC). It is used for bidirectional replication with Ingres and Oracle in support of ALMIS.

REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES:

Historical data shows that HVR Software B.V. is the sole proprietor of this software and they are the original software developer. HVR Software B.V. has maintained their status as the only source qualified to fulfill this requirement in that they own the proprietary data required (See attached letter from HVR Software B.V.).

EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND OPEN COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE.

HVR Software B.V. is the sole proprietor of the HVR Software and they own the exclusive data rights. This requirement is a renewal of the HVR subscription and support of an existing system already in place. It would not be economically feasible at this time to solicit other vendors for a whole new software program.

PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED As stated above, HVR Software B.V. will not sell the proprietary data rights for t his software, which has limited the USCG’s ability to provide adequate technical description to potential new sources. Therefore, it is difficult to take steps to foster competition for the subscription/support on a proprietary software.
