NOTICE FOR FILING AGENCY PROTESTS

It is the policy of the United States Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the

Government Accountability Office (GAO). Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative Dispute Resolution (ADR) forum, rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the contracting officer or Ombudsman.

Informal forum with the Ombudsman. Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the cognizant contracting officer. If the contracting officer is unable to satisfy the concerns, the interested party is encouraged to contact the USCG Ombudsman for Agency

Protests. Under this informal process, the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman:

solicitation/contract number, contracting office, contracting officer, and solicitation closing date (if applicable).

Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the contracting officer through open and frank discussions. If the protester's concerns are unresolved, an independent review is available by the Ombudsman. The protester may file a formal agency protest to either the contracting officer or as an alternative to that, the Ombudsman under the

OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency's goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103. If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. This will not preclude re-filing of the protest to meet the requirement. To be timely, protests must be filed within the period mailto:D05-SMB-LRS-Procurement@uscg.mil mailto:D05-SMB-LRS-Procurement@uscg.mil mailto:D05-SMB-LRS-Procurement@uscg.mil specified in FAR 33.103(e). Formal protests filed under the OPAP program should be submitted to:

STATEMENT OF WORK

1.0 Background

The United States Coast Guard (USCG), Aviation Logistics Center (ALC), Long Range Surveillance (LRS)

Product Line requires Overhaul of Honeywell International, Inc., Engine, Gas Turbine (hereafter known as

Engine). The USCG, ALC, LRS Product Line supports the Coast Guard’s fleet of 22 HC-130H aircraft. The engines are defined as a flight critical safety item (CSI). A CSI is a part, assembly, installation or production system with one or more critical characteristics that, if not conforming to the design data or quality requirements, would result in an unsafe condition. Unsafe conditions relate to mishap severity categories I (Catastrophic) and II

(Critical), and include conditions which could cause loss or serious damage to the end item or major component, lost of control, serious injury to personnel, or death of personnel. In order to successfully maintain airworthiness of the aircraft and maintain mission readiness, it is imperative that the USCG maintain and provide a revolving pool of engines for distribution to USCG Air Stations and Depot Level facilities.

2.0 Scope

LRS requires the Overhaul of the Engine listed in the Schedule of Supplies/Services. This Overhaul will include all necessary repairs in order to make the Engine Ready-for-Issue on the USCG’s HC-130H aircraft. The contractor shall be either a Federal Aviation Administration (FAA) approved overhaul facility, Original Equipment

Manufacturer (OEM) Certified facility, or Air Force Certified facility.

All work shall be performed in accordance with the Air Force Technical Orders (TO), latest revision, for the following components:

Engine, Gas Turbine

P/N: 381116-1-7, NSN: 2835-01-056-6467

The USCG will ship the components to the contractor’s facility to be overhauled and to include repairs, as needed, to make the Engine Ready-for-Issue (RFI) at the firm-fixed price established in the Schedule of Supplies/Services.

3.0 Requirement

During the Overhaul process the Contractor shall be responsible for: complete teardown, evaluation, removal of paint, cleaning, inspection (both visual and technical inspection), non-destructive inspection, repainting, testing, and replacement of missing consumable parts.

The contractor shall provide all parts, labor, tooling, test equipment, and facilities necessary to complete the overhaul and repair process, as defined by the applicable TO.

The contractor should factor in the overhaul and repair efforts necessary to return the components listed in this Statement of Work (SOW) to an RFI condition at the firm-fixed prices established at time of award.

The contractor shall also perform any required repairs and replace conditional parts that fail inspection in accordance with the applicable TO, thereby insuring the items listed in this SOW are returned to an

RFI condition.

3.1 Contractor Verification of Components

Upon receipt of components the contractor shall verify that the part numbers and serial numbers on the components match exactly those on the Contract. The Contractor shall notify the Contracting Officer of any discrepancies, in writing, within 10 working days after receipt of the material. The Government reserves the right to have discrepant components returned “as is”; therefore, the Contractor shall not start work on discrepant components until disposition instructions are received from the USCG. Correction of discrepan-cies and/or disposition instructions will be provided via modification to the Contract.

3.2 Corrosion Inspection

USCG aircraft operate primarily around salt water, at low altitude, and are subject to corrosion. Corrosion should be expected on USCG components and does not constitute unusual damage. Should corrosion be found during initial inspection and functional testing, disassembly shall be made to the extent necessary to remove all corrosion or replace the part or parts affected. Corroded parts shall be replaced, except in those cases where removal of corrosion from parts will not impair efficiency or safe operation of the part. Corrosion removal and treatment of affected areas shall be accomplished in accordance with the TO or best commercial practices if not addressed by the TO.

4.0 Serviceable Parts and Replacement Parts

Overhaul pricing shall include all replacement parts. These parts shall be provided by the Contractor. Parts that are considered “high cost” by the Contractor may need to be replaced; therefore, firm-fixed prices for overhaul should take into consideration this possibility. High cost replacement parts will not be considered as “Over &

Above” and will not necessitate re-negotiation of the overhaul price. Parts of a component found to be in a serviceable condition, as a result of inspection and functional testing, shall be reused. Missing parts or parts found to be defective shall be replaced with new parts that meet the TO’s current specifications and drawings. Only new replacement parts, traceable to the OEM, are acceptable for use for this requirement.

5.0 Cannibalization

The firm-fixed Overhaul price established in the Schedule of Supplies/Services does not include components that have been cannibalized. The USCG will not authorize over and above price requests for additional parts or labor for any parts not considered cannibalized. When a component is processed for cannibalization the contractor shall, within fifteen (15) working days of receipt of the component, submit to the Contracting Officer a written inspection condition report and a fixed price overhaul quote covering all parts and repairs needed to return the component to a serviceable condition that meets all applicable TO specifications. The quote shall include a listing of the replacement parts and/or material required, the cost of each required replacement part, the number of labor hours and hourly labor rates established in the Schedule of Supplies/Services, and the time needed to perform the repair and overhaul and return the component to a serviceable RFI condition.

The Contractor’s delivery obligation shall stop from the date of notification that a component has been determined to be a candidate for cannibalization. Upon mutual agreement as to price and delivery, a modification to the

Contract will be issued to authorize overhaul work at the agreed upon terms. If overhaul work is not desired by the

Government, disposition instructions for the un-overhauled components will be provided.

6.0 Flight Critical Equipment and Airworthiness Certification The components listed in the Schedule of Supplies/Services are classified as Flight Critical. The contractor shall certify all overhauled components to be Airworthy and suitable for installation on USCG aircraft. The contractor may use the FAA Form 8130 Airworthiness Certificate; however, use of this form is not required. The contractor may use an equivalent Airworthiness Certificate to certify the airworthiness of an overhauled component. An equivalent Airworthiness Certificate used for other Government agencies, such as an Air Force Airworthiness

Certificate or a contractor developed USCG approved or OEM Airworthiness Certificate that is equal to the FAA

8130 form, is acceptable. Airworthiness Certificates shall only be issued by qualified individuals for commercial aviation industry under FAA Regulations.

7.0 Serial Number Tracked Components

The Engines are Serial Number Tracked in the USCG Asset Computerized Maintenance System (ACMS) which is the information system used by the USCG to schedule and record Aircraft Maintenance. All components will have a Significant Component History Report (SCHR) and a Component Repair Record (CRR).

7.1 Significant Component History Report (SCHR)

No SCHR action is required by the contractor except to ensure the SCHR remains with the component.

7.2 Component Repair Record (CRR)

The contractor must complete this record (Attachment 1) to document the maintenance performed on the component including any Test and Inspection with No Fault Found results. Maintenance documentation

(CRR) must be provided. The Contractor shall comply with the following completed CRR disposition instructions:

1) The Original CRR shall be packed with the component at the completion of overhaul and/or modification for return to the USCG.

2) Mail one (1) completed copy of the CRR within five (5) working days of acceptance by the

Government to the following address:

Commanding Officer

USCG Aviation Logistics Center

1664 Weeksville Road

Bldg. 78 / ACMS

Elizabeth City, NC 27909-5001

3) The Contractor shall maintain a copy of each completed CRR for a period of ninety (90) days.

8.0 Product Quality Deficiencies Report (PQDR)

Repaired and overhauled components found to have deficiencies will be reported on the Joint Deficiency

Reporting System as a Product Quality Deficiency Report (PQDR). The Government may issue a No-Cost purchase order and return the components to the Contractor for investigation.

9.0 Requests for Government Furnished Material (GFM)

Requests for GFM will be reviewed by the Government and a determination will be made to either furnish the requested material and adjust the monetary value of the Contract, as applicable, or deny the request (per the conditions of paragraph 5.0). Requests for GFM shall be submitted in writing to the Contracting Officer with a brief narrative that supports the request.

10.0 Turn Around Time and Delivery Time

The required turn-around-time is sixty (60) days after receipt of material (ARM). Earlier delivery is desired if there are no extra charges to the Government.

11.0 Aircraft on Ground (AOG) and Work Stop (WS) Requirements

An AOG or WS situation necessitates a special schedule and requires accelerated overhaul completion and expedited delivery to the applicable USCG facility. In the event an AOG/WS status occurs, as a result of a lack of any of the components specified in the Schedule of Supplies/Services, the Contractor will be notified by the Government in writing of the AOG/WS situation. The Contractor’s response shall provide: 1) status of the component(s) needed to satisfy the AOG/WS condition. This will include identification of USCG components in-house for repair/overhaul that are closest to completion under normal working conditions, and

2) an estimate of the labor hours needed to accelerate work completion. The accelerated work will be authorized via a Contract modification in conjunction with mutually agreed upon prices, delivery, and shipping cost reimbursement for the fastest traceable means to the applicable USCG facility.

In the event of an AOG/WS situation, the Contract and applicable line item number will be modified as needed to reflect the USCG delivery address and the applicable USCG Requisition Number. The Contractor shall be required to ensure the Requisition Number is included on the shipping documents/delivery tickets so that the material receipt can be processed by the applicable USCG receiving personnel.

12.0 Environmental Requirements

All parts must be thoroughly cleaned in accordance with applicable Component Maintenance Manuals or FAA

Advisory Circular 43-205, Guidance for Selecting Chemical Agents and Processes for Depainting and General

Cleaning of Aircraft and Aviation Products, to ensure they are as free as practicable of all hazardous dust to include hexavalent chromium, cadmium, lead, etc., prior to being returned to ALC. ALC may take random samples of parts to ensure they are as free as practicable of all hazards. Information on these hazards can be found in Occupational Safety and Health Standards 1910.1025 (lead), 1910.1026 (Hexavalent Chromium) and

1910.1027 (Cadmium).
