5.0 PRICING EXCLUSIONS
5.1 Exclusions – Unusual Damage. Prices do not include components that have been cannibalized or severely damaged due to mishandling, water immersion, or crash damage.
Because USCG aircraft are used primarily around salt water at low altitude for search and rescue missions, some corrosion is to be anticipated and is considered "normal" for the aircraft.
Corrosion itself does not constitute unusual damage.
5.1.1 Components received which indicate obvious misuse, cannibalization or severe damage due to mishandling, water immersion or crash damage may dictate an exclusion from the prices specified in the contract schedule. Such components shall be inspected, repair costs determined, and authorization to proceed obtained from the KO prior to commencement of work. If the
Contractor considers a component to be a candidate for exclusion, the KO shall be notified within fifteen (15) calendar days of receipt of the component. Verbal notification to the KO shall be confirmed in writing. The Contractor's delivery obligation for the component shall be suspended as the date of notice to the KO.
5.1.2 The KO will make a written determination as to the exclusion validity. With KO’s approval, any usable components or assemblies may be used in the repair of other USCG assets.
If the KO agrees with the exclusion recommendation and desires repair of the component, either a task order modification or a new task order will be issued reflecting authorization and funding.
If the KO determines not to repair an excluded item, it will be considered BER and no exclusion charges will apply. Any asset determined by the KO to be BER will be handled in accordance with section 5.2. The Contractor's delivery obligation shall resume upon receipt of the KO's determination.
5.1.3 The Government shall not be liable for any amount expended by the Contractor in excess of the applicable firm fixed price reflected in the schedule unless prior written authorization has been given by the KO.
5.2 BER. The USCG typically considers an item BER when the cost to repair exceeds 60 percent of the price of a new unit; however, the USCG is not bound by this measure number and will make all final BER determinations. If an item is determined BER, the KO shall make a unilateral decision as to component disposition. The USCG will provide disposition instructions
(either to scrap the item at the Contractor’s facility or to return the item to ALC) for all items.
The Contractor shall not dispose of an item until they have been notified by a written modification to the order. When returning the item to ALC, the items shall be clearly marked as
“BER” with the supporting evidence. The Contractor will be authorized the firm-fixed Test and
Evaluation fees established in CLIN 0004 and all respective option year CLINs for items returned “As-Is”.
6.0 TECHNICAL PERFORMANCE ACCESS AND DISCLOSURE
6.1 Technical Performance General. Contractor access to proprietary information is required under this SOW. Contractor employees shall safeguard this information against unauthorized disclosure or dissemination in accordance with the law and Government policy and regulation. The Contractor may be required to enter into an agreement with other companies to protect their information from unauthorized use or disclosure for as long as it remains proprietary and shall refrain from using the information for any purpose other than that for which it was furnished.
