NOTICE FOR FILING AGENCY PROTESTS
It is the policy of the United States Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the General Accountability Office (GAO).
Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative Dispute Resolution (ADR) forum, rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the contracting officer or Ombudsman.
Informal forum with the Ombudsman. Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the cognizant contracting officer. If the contracting officer is unable to satisfy the concerns, the interested party is encouraged to contact the USCG Ombudsman for Agency Protests. Under this informal process, the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, contracting officer, and solicitation closing date (if applicable).
Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the contracting officer through open and frank discussions. If the protester’s concerns are unresolved, an independent review is available by the Ombudsman. The protester may file a formal agency protest to either the contracting officer or as an alternative to that, the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103. If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. This will not preclude re-filing of the protest to meet the requirement. To be timely, protests must be filed within the period specified in FAR 33.103(e). Formal protests filed under the OPAP program should be submitted to:
Department of Homeland Security United States Coast Guard (CG-9131) Ombudsman Program for Agency Protests 2100 2nd Street, SW, Stop 7112 Washington, D. C. 20593-7112
FAX: 202.475.3904
The Ombudsman Hotline telephone number is 202.372.3695.
The Government is soliciting fixed price Proposals for award of an Indefinite Delivery Requirements contract for the repair and overhaul of equipment listed in the following Schedule of Supplies/Services. The Government anticipates award of a single contract but may break out CLINs and award more than one (1) contract if determined to be in the best interest of the Government. An offeror’s proposal, to be considered for award, must price a minimum of one (1) CLIN for all contract periods and must be responsive to the terms and requirements of the solicitation.
Equipment is to be repaired and overhauled in accordance with the Air Force Technical Orders (AFTO’s) listed in Schedule of Supplies/Services.
The term of the contract(s) will be for a 12-month Base Period and four (4) 12-month Option Periods for a total duration not exceeding five (5) years. Repair and overhaul services will be purchased by issuance of individually funded fixed price Task Orders as needs arise and funding permits.
This solicitation is a Total Small Business Set-aside. The NAICS Code is 336413 and the Small Business Size Standard is 1000 employees. Proposals from large businesses will not be considered under this Total Small Business Set-aside acquisition. All responsible small business sources may submit a proposal which will be considered by the agency. The Original Equipment Manufacturers (OEM) are Honeywell, Cage Code: 94580 and Parker-Hannifin Corporation, Cage Code 26055.
This solicitation uses the policies and procedures of FAR Part 12 – Acquisition of Commercial Items in conjunction with FAR Part 15 – Contracting By Negotiation with the Contract Format set forth in FAR 12.303. Incorporated provisions and clauses are those in effect through Federal Acquisition Circular 05-63.
This Solicitation contains Proposal Instructions under FAR 52.212-1 Instructions to Offeror-Commercial Items that offerors are required to follow. Proposals that do not comply with the Instructions will not be considered for contract award.
Quantities listed in the Schedule of Supplies/Services are estimates for the specific periods of performance. Failure of the Government to order any of the line items more quantities described as estimated or maximum will not entitle the contractor to an equitable adjustment in price.
Schedule of Supplies/Services BASE PERIOD 12- months from time of Award (Contract Year 1) Repair and overhaul Equipment shown in accordance with (IAW) the Air Force Technical Orders Stated and the terms of the Statement of Work (SOW)

STATEMENT OF WORK
1.0 SCOPE
The United States Coast Guard, Aviation Logistics Center, requires depot level maintenance through the award of a fixed price Indefinite Delivery Requirements type contract for the repair and overhaul of the various indicators as identified in the Schedule of Supplies/Services in accordance with this Statement of Work (SOW). The components will be shipped to the contractor for repair and overhaul in order to restore them to a Ready for Issue (RFI) condition.
The quantities in the Schedule of Supplies/Services represent the Government’s estimated quantities of components anticipated for repair and overhaul against this solicitation and resulting contract. The Schedule of Supplies/Services requires a firm-fixed repair and overhaul price for each component listed in the Schedule of Supplies/Services. Please note the Schedule of Supplies/Services includes contract line item numbers (CLINs) that utilize a “header” number and “family” members under that same CLIN. The header NSN and part numbers are designated by the letter “H’. Unmarked components are considered family members of the header and are fully interchangeable. The firm-fixed repair and overhaul price specified for the “header” applies to all the “family” members within that CLIN. At a minimum the contractor shall submit pricing for at least one line item identified in Schedule of Supplies/Services.
Offerors are to propose one (1) firm-fixed repair and overhaul price that will be used to repair and overhaul the “header” NSN and part number AND the “family member” NSNs and part numbers within that CLIN. If a single repair and overhaul price cannot be proposed that covers the header NSN and family member NSNs, the offeror shall provide a brief explanation as to why. At a minimum the contractor shall submit pricing for at least one (1) CLIN listed in the Schedule of Supplies/Services for each contract performance period. The Indicators are Flight Critical.
The technical requirements in this statement of work are identified as the minimum acceptable standards of performance to define an operationally effective system. The contractor must have access to either the Original Equipment Manufacturers (OEM) or United States Air Force Technical Order (AFTO), maintenance, repair and overhaul manuals, performance/test/acceptance criteria, and data to ensure the items specified in Schedule of Supplies/Services are repaired and overhauled, and operating in accordance with the applicable OEM manual or AFTO. The contractor is solely responsible for obtaining the AFTO(s) and OEM manual listed in Schedule of Supplies/Services of this document. The USCG does not maintain or release the technical documents.
The information contained in this section is not intended to be all-inclusive nor does it detract from the procedures outlined in the OEM or AFTO specifications except where specifically noted herein. The technical manuals listed in Schedule of Supplies/Services are the basic directives to be used in the part replacement requirement. Replacement parts shall conform to the configurations stipulated by other applicable directives and instructions contained herein. Parts replacement shall be confined to those parts determined to be beyond economical repair unless otherwise specified.

All other components shall be repair and overhauled in accordance with the firm-fixed repair and overhaul prices accepted at contract award.
4.5.2 Unusual Damage Reporting Requirements
When a component is processed for unusual damage evaluation, the contractor shall, within fifteen (15) calendar days of receipt of the item, submit an inspection condition report, repair and overhaul price proposal, covering all parts and repair needed to return the unit to satisfactory condition that meets all applicable OEM or AFTO specifications. The proposal shall contain the task order number, line item number, national stock number (NSN), part number (P/N), nomenclature, and serial number of the component, a listing of the replacement parts and/or material required, the time needed to effect the repair and overhaul, and a cost breakdown including the cost of each required part and the number of labor hours. The hourly labor rate will be charged at the firm-fixed hourly labor rate contained in Schedule of Supplies/Services, schedule of requirements. The contractor’s delivery obligation shall stop from the date of notification that an item has been determined to be a candidate for “unusual damage evaluation.” The delivery obligation will be specified in the task order modification and will apply only to those items specifically addressed by the modification. The contractor is obligated to deliver all other components not individually addressed by the modification under the original delivery date specified on the task order. The proposal shall not include the work involved in the teardown and inspection, which will have already occurred, as this is covered by the firm-fixed price specified in the Schedule of Supplies/Services requirements.
Within thirty (30) calendar days, the Contracting Officer shall either initiate negotiations for a firm-fixed price with the contractor or deny authorization for the repair and overhaul based on information in the report and any other information which may be available. Upon mutual agreement as to price and delivery, a task order modification will be issued to require repair and overhaul at the agreed upon terms. If repair and overhaul is not desired, the Contracting Officer will provide the contractor with disposition instructions. In the event an item is returned to the activity in a disassembled condition, the contractor shall be entitled only to appropriate compensation for scrap fee as specified in the Schedule of Supplies/Services.
4.5.3 Cannibalized Units
Firm-fixed prices proposed in Schedule of Supplies/Services for repair and overhaul shall not include assemblies and components which have been cannibalized for repairable parts. These items shall be evaluated at the firm-fixed-price specified in Schedule of Supplies/Services for Inspection/No Fault Found. In the event any of the components listed in Schedule of Supplies/Services are received in a condition that represents cannibalization, immediate notification to the Contracting Officer is required. This notification shall include a detailed description of the noted deficiencies and shall reference the task order number, national stock number, part number, and serial number and is subject to the discretion of the Contracting Officer.
4.6 Service Bulletins, Modifications And/Or Engineering Change Proposals
The Contracting Officer will notify the contractor in writing of items requiring incorporation of a service bulletin or modification. Upon receiving notice of a service bulletin or modification, the contractor shall submit within thirty (30) calendar days a firm-fixed priced proposal for an incremental charge to be assessed each time the service bulletin or change is incorporated in a component. The proposal shall contain a breakdown of material and labor costs based upon the firm-fixed labor rates and material factors. The incremental charge agreed to for incorporation of a service bulletin shall apply only to those components into which the contractor incorporates a required service bulletin; not those into which the service bulletin has been previously incorporated. Upon agreement of the incremental charge and issuance of a contract modification to reflect this change, the service bulletin shall be incorporated into each subsequent component received at the contractor’s facility if said service bulletin has not already been incorporated. When service bulletin incorporation changes the component’s part number, the new part number will be added to the contract. The contractor shall update the components data plate if applicable denoting the new part number and/or modification number.
4.7 Obsolete Parts Or Processes
The contractor shall use new parts meeting the requirements of specified AFTO’s, OEM specifications, or USCG specifications and/or drawings. In the event certain parts or processes become obsolete, the contractor shall, within fifteen (15) calendar days after receipt of the assembly or component, notify the Contracting Officer in writing and submit (1) rationale and verification of any obsolete part or process, and (2) a written estimate of the effort required to make the repair and overhaul. Such estimates shall include nomenclature, part number, cost and quantity of replacement parts, and total labor hours. The contractor shall verify cost of part(s) with invoices or catalogs. The contractor’s delivery obligation for the component(s) identified shall be suspended as of the date of the notice to the Contracting Officer. The Contracting Officer will, within thirty (30) calendar days of receipt of the contractor’s written estimate make a written determination as to the disposition of the component. After receipt of the Contracting Officer’s disposition instruction, the contractor shall have sixty (60) calendar days for delivery.
4.8 Environmental Requirements.
All parts must be thoroughly cleaned IAW applicable Component Maintenance Manuals or FAA Advisory Circular 43-205, Guidance for Selecting Chemical Agents and Processes for Depainting and General Cleaning of Aircraft and Aviation Products, to ensure they are as free as practicable of all hazardous dust to include hexavalent chromium, cadmium, lead, etc., prior to being returned to ALC. ALC may take random samples of parts to ensure they are free as practicable of all hazards. Information on these hazards can be found in Occupational Safety and Health Standards 1910.1025 (lead), 1910.1026 (Hexavalent Chromium) and 1910.1027 (Cadmium).
5.0 REPAIR TURN AROUND TIME
5.1 Turn Around Time / Delivery Schedule
The REQUIRED turn-around-time is sixty (60) days after receipt of material. Earlier delivery is desired if there are no extra costs incurred by the Government. Turn-around-time is defined as beginning at the time of receipt of repairable at the CONUS contractor’s facility or Point of Departure for Non-CONUS offerors and ending at the time of delivery to ALC, Elizabeth City, North Carolina. The offeror may ship earlier than the desired delivery if there are no extra monies incurred by the Government (see section 5.2). The offeror may also, without prejudicing its offer, propose a staggered delivery schedule for large quantity orders based on plant capability which will also be considered during proposal evaluation.
5.2 Accelerated Turn-Around-Time and Delivery
Only the Contracting Officer may request and authorize an accelerated turn-around-time and delivery if needed by the Government. In the event an accelerated turn-around-time and delivery is needed, the contractor shall be entitled to compensation for additional labor hours and expedited freight costs necessary to complete performance earlier than the turn-around-time and delivery schedule established in the contract. After receiving a written request from the Contracting Officer for an accelerated turn-around-time and delivery the contractor shall provide a written response within two (2) business days advising if an accelerated turn-around-time and delivery can be accomplished and include any additional costs necessary for the accelerated performance. Accelerated performance will be authorized in writing via a task order modification. If the contractor accelerates turn-around-time and delivery on its own initiative in order to meet the delivery schedule established in the contract task order the additional costs are not recoverable from the Government.
5.3 Urgent Requirements
An Aircraft on the Ground (AOG) situation necessitates a special schedule and requires accelerated repair and overhaul completion and expedited delivery to the applicable U.S. Coast Guard Air Station. In the event an AOG status occurs as a result of a lack of any of the components specified in the schedule, the contractor will be notified by the Government in writing of the AOG situation. The contractor’s response shall provide 1) status of the component(s) needed to satisfy the AOG condition that includes what USCG items in-house for repair and overhaul are closest to completion under normal working conditions and 2) an estimate of the labor hours needed to accelerate repair and overhaul completion. The accelerated repair and overhaul work will be authorized via a task order modification in conjunction with mutually agreed upon prices, delivery, and shipping cost reimbursement for next day delivery to the applicable USCG Air Station.
In the event of an AOG situation, the Task Order and applicable task order line item number will be modified to reflect the USCG Air Stations delivery address and the applicable USCG requisition number. The contractor shall be required to ensure the Requisition Number is included on shipping documents/delivery tickets so that the material receipt can be processed by the applicable USCG Air Station receiving personnel.
