The Government may retain such excess quantities up to $250 in value without compensating the Contractor therefore, and the Contractor waives all right, title, or interests therein. Quantities in excess of $250 will, at the option of the Government, either be returned at the Contractor’s expense or retained and paid for by the Government at the contract unit price.
(End of Clause)

(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 10 days after issuance, with written notice stating the Contractor’s intent not to ship the item (or items) called for and the reasons.
Upon receiving this notice, the Government may acquire the supplies or services from another source.

The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the “maximum.” The Government shall order at least the quantity of supplies or services designated in the Schedule as the “minimum.”
(c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.
(d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order.
The contract shall govern the Contractor’s and Government’s rights and obligations with respect to that order to the same extent as if the order were completed during the contract’s effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after June 30, 2020.

52.217-9 -- Option to Extend the Term of the Contract (Mar 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 15 calendar days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 60 months.

52.212-2 -- Evaluation -- Commercial Items (Oct 2014)
(a) This acquisition will utilize the Lowest Priced Technically Acceptable (LPTA) procedure. A decision on the technical acceptability of each offeror’s quotations will be made. For those offerors which are determined to be technically acceptable, award will be made to that vendor with the lowest overall price. The Government intends to make an award based on the initial quotations. If further questions are required, the contracting officer may contact the offeror or offerors. In order to be considered suitable for award, the proposal must receive an acceptable rating for every non-price factor. Award will be made to the responsible offeror whose quotation conforms to all solicitation requirements, such as terms and conditions, representations and certifications, and technical requirements, based on the results of the evaluation described in paragraph (b) below.
(b) The LPTA evaluation process will be accomplished as follows:
(1) Subfactor1 Technical Acceptability. Each offeror’s technical quotations will be evaluated to determine if the offeror provides a sound, compliant approach that meets the requirements of the SOW and demonstrates a thorough knowledge and understanding of those requirements.
Product samples received under this solicitation will be evaluated for quality, workmanship and compliance to the item specifications.
Sub-Factor 1 - Evaluation rating method.
Sub-Factor 2 – Relevant Past Performance
The offerors’ proposal will be evaluated to determine the extent to which their performance demonstrates the likelihood of successful performance in providing requirements similar in size, scope and complexity of this solicitation. The Government may choose to evaluate publicly available reports, and/or data from the Contractor Performance System (CPS). The Government may use present and/or past performance data obtained from a variety of sources, not just those contracts identified by offeror. The information gathered for past performance may also be used in the responsibility determination.
The Government will review all past performance data submitted and verify past performance information.
Rating System for Sub-Factor 1 – Management Approach Rating Definition Acceptable Proposal meets the requirements of the solicitation or exceeds.
Unacceptable Proposal does not meet all requirements of the solicitation.
HSCG23-15-R-QAD033 Page 22 of 38
Past Performance will be evaluated on the basis of performance risk. While good past performance does not always assure good prospective performance and vice versa, past performance is nonetheless an indicator of future performance.
A risk assessment will be made of an Offeror’s potential performance based on the Offeror’s past performance. The risk assessment will utilize a High/Low risk determination. Past performance evaluation will consider whether the Offeror’s past performance is relevant to this acquisition, whether the reports show a pattern of consistency in past performance, timeliness of deliveries or performance, quality of performance and contractor responsibility. The evaluation may include data provided through the Past Performance Information Retrieval System (PPIRS).
An Offeror without a record of relevant past performance of for whom information on past performance is not available will be rated Neutral. A Neutral rating does not advantage or disadvantage an Offeror. Recent past performance is defined as within the past three years. The evaluation factor will be rated using the following descriptors:
Sub-Factor 2 – Relevant Past Performance evaluation rating method.
Rating System for Sub-Factor 2 –Relevant Past Performance Rating Definition Acceptable
Based on the offeror’s relevant past performance record, the USCG has a reasonable expectation that the offeror will successfully perform the required effort or the offeror’s relevant past performance record is unknown (see note below).
Neutral If an offeror having no record of relevant past performance through the federal database or relevant past performance information is not available, the offeror will receive a neutral rating.
Unacceptable
Based on the offeror’s relevant past performance record, the USCG has no reasonable expectation that the offeror will successfully perform the required effort.
Price
Price will not be assigned an adjectival rating. Price will be evaluated for reasonableness in accordance with one or more price analysis techniques identified in FAR 15.404 and the factors cited in FAR 12.209. Any proposal that is unreasonable or materially unbalanced as to price for basic and option items including follow-on years may be rejected. An unbalanced proposal is one that incorporates prices that are significantly understated or overstated as indicated by price analysis techniques.
The price will be evaluated on the basis of total estimated price to the Government.
(c) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may
HSCG23-15-R-QAD033 Page 23 of 38 determine that an offer is unacceptable if the option prices are significantly unbalanced.
Evaluation of options shall not obligate the Government to exercise the option(s).
(d) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

NOTICE FOR FILING AGENCY PROTESTS
It is the policy of the United States Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time-consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the Government Accountability Office (GAO). Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative Dispute Resolution (ADR) forum, rather than filing a protest with the GAO or some external forum.
Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the contracting officer or Ombudsman.
Informal forum with the Ombudsman. Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the cognizant contracting officer. If the contracting officer is unable to satisfy the concerns, the interested party is encouraged to contact the USCG Ombudsman for Agency Protests.
Under this informal process, the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman: solicitation/contract number, contracting office, contracting officer, and solicitation closing date (if applicable).
Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the contracting officer through open and frank discussions. If the protester's concerns are unresolved, an independent review is available by the Ombudsman. The protester may file a formal agency protest to either the contracting officer or as an alternative to that, https://www.fincen.uscg.mil/secure/payment.htm
HSCG23-15-R-QAD033 Page 26 of 38 the Ombudsman under the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the Government. The agency's goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103. If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. This will not preclude re-filing of the protest to meet the requirement. To be timely, protests must be filed within the period specified in FAR 33.103(e). Formal protests filed under the OPAP program should be submitted to:
