LIMITED SOURCES JUSTIFICATION

40 U.S.C 501 and 41 U.S.C. 3102, et seq.

This acquisition is conducted under the authority of the Multiple Award Schedule Program per Title III of the Federal Property and Administrative Services Act of 1949 (Title 41 U.S.C. 3102, et seq.) and Title 40 U.S.C 501, Services for Executive Agencies; and is justified by the following facts and rationale required under Federal Acquisition Regulation (FAR) 8.405-6(a)(1)(i)(C), as follows:

1. Identification of Agency and Contracting Activity:

The U.S. Department of Homeland Security (DHS), Immigration and Customs Enforcement (ICE), Office of Acquisition Management (OAQ) proposes to enter into a supplemental agreement to an existing Call Order on the basis of other than full and open competition.

2. Description of the Action Being Approved:

DHS / ICE / Office of the Chief Information Officer (OCIO) is requesting a modification to Call Order # HSCETC-12-F-00022 for Enforcement Integrated Database (EID) Arrest Graphical User Interface (GUI) for Law Enforcement [EAGLE] Mobile Identification and Booking [MIB], EAGLE Directed Identification Environment (EDDIE) Software Operations & Maintenance (O&M) Support Services [hereafter referred to as EAGLE/EDDIE MIB] with Wexler Technical Solutions, Inc. (WTS) for the dual purposes of twelve months of continued performance of services with four option periods as displayed in the below matrix in accordance with (IAW) FAR part 8.405-6(a)(1)(i)(C), logical follow-on.

The Call Order is currently set to expire on 03/23/15. The previous modification (P00005) utilized the Option to Extend Services Clause (52.217-8) in order to extend the period of performance expiration date from 09/24/14 to 03/23/15. The current vendor, Wexler Technical Solutions Incorporated, Blanket Purchase Agreement (BPA) Number HSCETC-11-A-00013 and BPA call order number HSCETC-12-F- 00022, is a small business under General Service Administration (GSA) Schedule number GS-35-F-0120W which is valid until 11/30/2019.

The ICE Program Office is currently in the process of creating an acquisition package for the recompete effort which is being referred to internally as the “Enforcement & Removal Operations (ERO) Consolidation” procurement. The ERO Consolidation procurement would combine several current ICE BPA call orders into one larger Task Order that will be recompeted during Fiscal Year 2016. The recompete for these services was originally scheduled for award in June of 2015 however, after further review of the program office’s requirements; the estimated award date was pushed back to June of 2016. The program office anticipates having the procurement package documentation completed by January of 2016 which would make the estimated award date of June 2016 achievable. This delay in the acquisition package preparation is not due to a lack of acquisition planning but rather a concentrated effort to hone and refine the government work statement, requirement and associated documentation.

By extending the period of performance for the current call order as a logical follow-on, the ICE day-to-day operations will not be interrupted for the EAGLE/EDDIE MIB Operations and Maintenance services while the new effort is recompeted under the “ERO Consolidation” procurement.

This supplemental agreement will adjust the period of performance and estimated pricing information as follows:

Performance Period Value

Extension Period 2 - (3/24/15 – 03/23/16) $3,389,094.26 Extension Period 3 - (03/24/16 – 06/23/16) $586,268.19 Extension Period 4 - (06/24/16 – 07/23/16) $195,422.73 Extension Period 5 - (07/24/16 – 08/23/16) $195,422.73 Extension Period 6 - (08/24/16 – 09/23/16) $195,422.73 Total Base + All OPs $4,561,630.64

3. Description of Supplies/Services Required to Meet the Agency’s Needs:

EAGLE MIB is an application within the Identification and booking program and overall Homeland Security Investigations (HSI) portfolio that provides ICE law enforcement officers (LEOs) with processing tools that are specifically tailored to meet the required business needs of ICE concerning arrested subjects.

WTS performs adaptive maintenance, corrective maintenance, perfective maintenance, preventative maintenance, and enhancements to the EAGLE MIB system as well as any required updates to the system documentation as requested by the Government. These support services also include modifications to the system due to configuration changes, security changes, infrastructure changes, and minor regulatory or agency changes. This type of support also includes activities that ensure compliance with Government and security requirements, adherence to the ICE System Lifecycle Management (SLM) process, required system availability and acceptable functionality of applications, application training, and tiered helpdesk support to maintain consuming applications and end user efficiency.

EAGLE Directed Identification Environment (EDDIE) is a recently developed mobile capability/application. The previous processing via EAGLE MIB of individuals encountered in connection with ICE law enforcement activities by ICE LEOs while in the field essentially required mirroring an office setup using the associated cumbersome and expensive equipment (cameras, laptops with air cards, fingerprint scanning devices, etc.) and experiencing the associated related challenges (connectivity issues, adequate equipment protection, operational risks, etc.).

Conversely, EDDIE will be both agile and affordable as an iOS-based application that shall control a separate mobile fingerprint scanning device (whose procurement is being coordinated under a separate contract) that captures this aspect of a subject’s biometric information and wirelessly transfers it (via Bluetooth) to their iOS-based devices (smartphones).

4. Authority and Supporting Rationale; Identification of the Justification

Rationale and Demonstration of Proposed Contractor’s Unique Qualifications

The original BPA (HSCETC-11-A-00013) and Call Order (HSCETC-12-F-00022) were both competitively awarded under the authority of the Federal Supply Schedules Program – FAR 8.4. Therefore, the statutory authority permitting the limitation of sources for the continued performance of EAGLE/EDDIE MIB O&M support services is FAR 8.405-6(a)(1)(i)(C); In the interest of economy and efficiency, the work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original BPA and call order were not awarded based on limited sources justification or sole source.

Production O&M support for a single service represents crucial but limited cyclical activities that ICE believes are best managed under the existing EAGLE/EDDIE MIB O&M Call Order where resources are currently in place and functioning. The scope and associated tasks of O&M support services remain the same across each of the aforementioned services (EID, SEVIS, EDDIE) within the EAGLE/EDDIE MIB Call Order. WTS has been providing EAGLE MIB O&M support services at the level of quality required since 09/24/12. As a result, WTS possesses a unique familiarity with EAGLE MIB as well as the specific transfer protocols, schema translations, and security requirements of EID and IDENT that is required to successfully implement the EDDIE application/capability.

Awarding this call order to WTS noncompetitively as a logical follow-on will prevent disruption, duplication of costs, transition delay and increased costs which is in the interest of economy and efficiency to the Government. WTS has the experience needed to continue the services without delay or substantial cost increases which would occur if this work was transitioned to a new vendor. Awarding this order to WTS will prevent unacceptable delays or disruptions in service that would occur if a new vendor began performance of the services. Therefore, it is in the best interest of ICE to extend performance of the EAGLE/EDDIE MIB O&M support services call order via execution of the above described modification as a logical follow-on.

5. Determination that the Order Represents the Best Value:

The Contracting Officer anticipates the price for the continued performance services for EAGLE MIB Software O&M Support Services including EDDIE O&M support services via a modification to Call Order # HSCETC-12-F-00022 will be considered fair and reasonable as ICE currently procures EAGLE MIB O&M support services and has an acquisition history, including historical pricing data and previously established BPA labor category rates, for performance of the required services.

The Contracting Officer will confirm that all rates and prices are in accordance with the BPA rates established from WTS’ GSA schedule and will thereby determine the fairness and reasonableness of the price quote for the continued performance of services required for EDDIE before issuing the modification to increase the funded value of the Call Order. ICE will also consider the level of effort and the mix of labor proposed to perform these services to further ensure the modification represents the best value to meet the ICE’s needs. The price quote will also be compared to the Independent Government Cost Estimate (IGCE) and current period pricing, and exceptions and variances will be analyzed to determine whether they are acceptable.

6. Description of the Market Research Conducted:

Official market research was not conducted for this intended modification as it was previously done as part of the original Call Order award. Market Research will be conducted for the ERO Consolidation procurement which has an estimated award date of June 2016.

7. Other Facts Supporting the Justification:

This effort will be recompeted in Fiscal Year 2016 via the “ERO Consolidation” procurement effort. The “ERO Consolidation” procurement will combine several different BPA calls into one task order and will replace the services performed under this current call order. The period of performance for the extension is in line with the “ERO Consolidation” timeline. The three one month options shall serve as periods of transition and may also be exercised if there are delays with the “ERO Consolidation” procurement.

8. Statement of Actions to Overcome Barriers for Competition:

The continued performance of EAGLE/EDDIE MIB Software O&M support services for the period of performance previously stated in this document is currently in the best interest of ICE in order to avoid a break in service and continue to support the overall ICE mission. Thereafter, it is the intention of ICE to recompete the entire EAGLE/EDDIE MIB Software O&M support services requirement via the “ERO Consolidation” procurement which has an estimated award date of June 2016. The extension of the current call order into Fiscal Year 2016 will allow for coverage of services until the “ERO Consolidation” procurement is awarded.
