U. S. Department of Homeland Security

Immigration and Customs Enforcement

Statement of Objectives

Family Case Management Services

Department of Homeland Security (DHS)

U.S. Immigration and Customs Enforcement (ICE)

Enforcement and Removal Operations (ERO)

SECTION C - STATEMENT OF OBJECTIVES (SOO) - COMPREHENSIVE FAMILY

CASE MANAGEMENT PROGRAM

C.1 PURPOSE

The purpose of this effort is to obtain contractor services to establish a cost-effective Comprehensive Family Case Management Program for up to five (5) years and six (6) months, subject to the ordering limitations provided for in this solicitation. U.S.

Immigration and Customs Enforcement (ICE) Enforcement and Removal Operations (ERO) requires contractor assistance to provide appropriate monitoring services and situate participating non-dangerous, low-flight-risk family units within a framework that promotes compliance with immigration obligations until removal or other resolution of their cases. Contractor-provided and/or -facilitated community-based services tailored to individual participant needs will serve as a central means to monitor participants and to promote compliance with their immigration obligations.

C.2 SCOPE OR MISSION

The scope of this effort aims to promote compliance with participants’ release conditions, including any required reporting to ICE ERO, immigration court hearings, and final orders of removal, while allowing them to remain in the community and maintain access to community services for the duration of the removal process. The contractor shall develop and implement an individualized Family Service Plan (FSP) and perform services in accordance with the requirements of this SOO at contractor locations based upon a family unit’s case and circumstances. The FSP shall provide the participant with recommendations on how to participate in the program successfully. The scale of this effort is dependent on the number of enrollments, but should accommodate a minimum of 40 Heads of Household up to a maximum of 300 Heads of Household, depending on enrollment and funding demands.

C.3 PERIOD OF PERFORMANCE

The total potential period of performance for this effort is five (5) years and six (6) months, comprised of a one-year base period of performance beginning on the date of contract award, and four one-year option periods exercisable at the Government’s sole discretion. Prior to the conclusion of the final option period, the Government reserves the right to extend the contract for up to an additional six (6) months in accordance with

FAR 52.217-8.

C.4 PLACE OF PERFORMANCE

The place of performance will be the Miami, Florida metropolitan region.

C.5 BACKGROUND

ICE ERO identifies and apprehends removable aliens, detains such aliens when necessary and appropriate, and removes them from the United States. ERO manages all aspects of the removal process, including domestic transportation, detention, bond management, and supervised release, including alternatives to detention (ATD) programs.

ATD is a flight-mitigation tool that uses technology and case management to increase compliance with release conditions and facilitate alien appearance at immigration court hearings and compliance with final orders of removal, while allowing aliens to remain in their community as they move through the immigration process. In the past, ICE has worked with providers that are experienced in addressing the needs of aliens in the removal process, including facilitating access to accurate and timely information about immigration removal proceedings and services available to them. These providers help ensure that aliens subject to removal processes appear at their immigration court hearings, comply with ICE ERO reporting requirements, and appear for removal. ICE is now soliciting assistance to provide a variation on ATD services that may be better suited for families released from immigration detention pending the outcome of their cases.

C.6 PERFORMANCE OBJECTIVES

1. Implement a standard enrollment and compliance process that includes:

Conducting an initial interview with the proposed family participants prior to their release from ICE custody to confirm their intended destination upon release and to gather other relevant information about the proposed participants.

Communicating (verbally and in writing) with the family participants in a language they understand (in most cases, Spanish) about immigration proceedings, generally, as well as the particular program obligations tied to enrollment.

Issuing family participant identification cards to be used solely for Contractor identification, e.g. for check-in appointments, and other general tracking purposes.

Conducting a follow-up in-person interview with the family participants.

Conduct regular and on-going monitoring of family participants through in-person (e.g. home or office visits) and telephonic reporting. At a minimum, check-ins should be done prior to any appointment, hearing, or other immigration required obligation.

Generating a tailored Family Service Plan (FSP) that rigorously identifies participants’ distinct vulnerabilities and needs and the combination of services, resources, and oversight measures that will serve as an effective framework to ensure successful participation in the program. The FSP provides participants with recommendations on available services and resources based on their vulnerabilities, needs, family composition, etc.

Conducting additional check-ins as needed to promote compliance with immigration requirements.

Identifying available housing options in advance of their arrival in the destination region for family units1 without prearranged housing.

Assisting individuals with transportation logistics, including with regard to identifying and securing appropriate and cost-effective transportation to their destination.

2. Inform program participants of their legal rights, responsibilities, and obligations.

Explain and communicate the importance of compliance with ICE ERO reporting requirements, immigration court appearance dates, and removal orders.

Proactively assist program participants in securing access to local immigration attorneys, including those who are low cost and pro bono attorneys.2

Proactively seek partnerships with local legal organizations to arrange “Know Your Rights” presentations and other basic forms of legal information exchanges.

No contract funds may be used to pay for legal representation.

3. Provide information and facilitate access3 to local community-based medical and mental health care resources for participants. Public health resources should be utilized where available.

Construct a medical emergency plan to engage emergency medical services, when necessary.

No contract funds may be used to pay for medical and mental health services.

4. Facilitate access to available volunteer community service opportunities for participants. Provide families with information about local community groups and resources, including relevant church services, ethnic community groups, or other organizations.

5. Access to educational opportunities.

Inform parents of K-12 school options for their children and assist with the registration process, acquisition of basic school supplies, and other preparatory measures, as needed. No contract funds shall be used to pay for school supplies or registration fees.

Facilitate access to language programming for participants with limited English proficiency, with specific emphasis on programs tailored to instructing adults.

A family unit, for the purposes of this effort, is defined as one or more adult alien parent(s) and/or legal guardian(s) accompanied by their own minor child(ren).

The contractor may not form an attorney-client relationship with any participant.

This document uses “facilitate access” to indicate that the contractor has obligations to act in an advisory or information-sharing capacity but may not directly provide or fund the attendant activity, resource, or service.

6. Facilitate access to available housing options that comply with all local, state, and federal housing regulations and will ensure facilities offer secure, separate spaces for family units. No contract funds shall be used to pay for housing.

7. Facilitate all participant transportation required to meet appearance and reporting obligations related to their immigration cases.

Inform participants of the full range of public transportation options in the metropolitan area where they reside.

Arrange for transportation in emergency situations where public transportation options are inadequate.

8. Develop, maintain, and safeguard individual participant case records via a comprehensive case management system, prioritizing both the accuracy and confidentiality of all case records.4

The case records for all participants shall include at a minimum: full name, date of birth, alien registration number (i.e., A-number), country of origin, date of program enrollment, dates of past and pending ERO in-person reporting dates and immigration hearings, participant compliance with these proceedings, participant compliance with check-in appointments, use of services per participant, and outcome of the participant’s immigration proceedings.

9. Provide regular accurate reports to the Contracting Officer’s Representative (COR) and appropriate ERO staff.

Regular bi-weekly reports on compliance with regard to all ERO reporting dates, immigration court hearings, and removals, which will include detailed explanations of, and actions taken in response to, any unmet immigration obligations by participants. The bi-weekly report will include recommendations for participant terminations based on noncompliance.

Quarterly reports documenting the services received by each participant, to include dates, participant names, organization names, and a brief narrative of each service that addresses the identified need for the service and whether it is recurring or a single appointment.

The contractor shall also be prepared to provide ad hoc reports associated with the data above, as requested by the COR.

The contractor will also report on any significant developments in the participants’ lives that may impact their immigration case or ability to comply with case-related appearance and reporting obligations (to include, but not limited to, major medical or mental health concerns, marriage, pregnancy, etc.).

10. Provide immediate notification to the COR and appropriate ERO staff upon becoming aware of any serious or emergent incidents, including but not limited to

This data will necessarily include sensitive personally identifiable information (PII). Current data security measures shall be contractually in place to prevent an unauthorized or negligent breach in data.

loss of accountability of a participant’s whereabouts, participant arrest on criminal charges, or participant hospitalization.

11. Track and monitor program and immigration proceedings compliance.

Program performance metrics will include the success rate, failure rate, absconder rate, and removal rate. Success and failure rates are broadly defined by the extent to which participants appear for immigration court hearings, comply with ICE ERO reporting requirements, and appear for removal, as applicable, throughout the course of their participation in the program.
