Statement of Work
Project Name:
NA DTM DTS Remove Bulkhead ST Claire River
BP SPINET Gull Island, Michigan Wet lands St Claire River Clair County, MI 48028
1. BACKGROUND:
The Customs and Border Protection (CBP), Office of Facilities Management and Engineering Directorate (FM&E) is responsible for the coordination of all real property management functions within CBP, in addition to all aspects of financial management and budgeting, logistical support, building management services, investment planning, and life cycle management of real property.
A 20 linear feet of steel sheet pile (Bulkhead) placed by the Custom Border Patrol (CPB) in 2009 for access to the wetlands adjacent to and in the St. Clair River at Gull Island has since been submerged from the high water levels. The higher water levels have left the Bulkhead structure entirely in the water way, creating a hazard to navigation in the St. Clair River.
2. SCOPE:
This project is to satisfy the request from the Department of the Army to remove the Bulkhead hazard from the water way. The contractor shall review the in place structure to verify it is built per the attached plains. The contractor will remove the Bulkhead in its entirety. The contractor will apply and obtain a permit for this work from the Army Corp. of Engineers (USACE). The contractor shall properly dispose of all the removed structure.
3. DESCRIPTION OF WORK:
The Contractor shall provide all materials, labor, tools, equipment, permits and supervision to accomplish tasks as outlined in this Statement of Work.
A. Apply for a General Permit from the USACE for the removal of structures within this proposed work. The General Permit allows for a shortened review process for projects that have minor impacts and are typically completed within 60 days once a complete application has been received.
Complete and return the application following the procedures set forth in the application. Plan view and cross-sectional view drawings, in 8½” x 11” format, should accompany the application. Drawings and a narrative on the form should specifically identify and describe all of the structures, work, and discharges, including temporary or removal measures.
B. Remove Bulk head in its entirety.
C. Properly dispose of all excavated material.
4. APPLICABLE DOCUMENTS:

5. DESIGN SUBMITTALS
4.1 Pre-design report: This report shall include the requirements of the USACE as indicated above, as well as the documentation. This report shall include a copy of 8-1/2”x11” with 11”x17” fold-outs as required.

5. WORK SCHEDULE:
Contractor shall be required to perform work between the hours of 0730-1630 Monday through Friday, except federal holidays.
Contractor shall notify Contracting Officers Representative (COR), in writing at least 48 hours in advance to request a deviation to established work schedule.
Contractor shall safely provide any Barge, crane or other lifting mechanisms required, in coordination with Contracting Officer, and Border Patrol safety officer on site.
The Government offices will not be open on these days and the Contractor is not expected to perform work during these Holidays. New Year’s Day, Labor Day, Martin Luther King Jr.’s Birthday, Columbus Day, President’s Day, Veteran’s Day, Memorial Day, Thanksgiving Day, Independence Day and Christmas Day.

General – All submittals shall be provided through a Material Approval Submittal (MAS) process and submitted to the COR in a PDF file format. Unless noted otherwise, all deliverables shall be in electronic format and submitted via email.
Submittals for Approval - If the contract provides for the submission of shop drawings, samples, lists, and descriptive data for approval, it is IMPORTANT that these be transmitted as early as possible in order to allow time for review and approval. In order to expedite the review for approval, the Contractor shall ensure that the submittals are clearly marked to properly identify the specific items proposed.
The Government will have five (5) calendar days to review contract deliverables/submittals. The Government reserves the right to reject any deliverable based on defects with respect to completeness correctness, clarity, and inconsistencies.
In the event of a rejection of any deliverable, the CS will notify the Contractor in writing within five (5) calendar days of the receipt of the deliverable of any deficiencies to be corrected. The Contractor shall have five (5) calendar days to correct the deficiencies and resubmit for review and approval.
6.1 Accuracy All deliverables shall be accurate in presentation, content, and shall adhere to the guidelines set forth in this document. All documentation presented to CBP shall be complete, correct, clear and consistent.
6.2 Clarity Deliverables shall be clear and concise.
6.3 Timeliness Deliverables shall be submitted on or before the due date specified in SOW. A deliverable is considered timely if submitted on or before the date specified in the SOW and if the Government provides any written notifications of deficiencies, the Contractor corrects the deficiencies within five (5) calendar days.
Submittals
6.4 Submittals shall be provided for the following requirements.
6.4.1 Deliver a Project Schedule within five (5) calendar days of issuance of the NTP. The schedule shall provide sufficient detail to include but not limited to design time, method of approach and milestone and completion dates relating to the various phases or sequences of the project. The Project Schedule shall be in electronic format, using established software such as Microsoft Project or other recognized industry standard software. The Contractor shall submit an updated Project Schedule with each progress payment request or at any time that on-site work falls seven (7) calendar (or more) days behind the scheduled time frame.
6.4.3 Deliver a Two Week Look Ahead Schedule within five (5) calendar days of issuance of the NTP. This schedule shall clearly show the detail of task(s) time lines shown on the Project Schedule. This schedule shall be updated weekly and emailed to the COR by close of business each Friday during the entire performance of this order.
6.4.5 Contractor shall prepare and submit a Task Specific Accident Prevention Plan (APP) and Task Specific Safety
Plan within five (5) calendar days of notice of Notice to Proceed. This plan shall be submitted for informational purposes.
Pre-Removal Submittals
6.5 Project Schedule. See Paragraph 6.4.1.
6.6 SOV. See Paragraph 6.4.2, above.
6.7 Task Specific Accident Prevention Plan (APP) and Task Specific Safety Plan (submitted for information only).See Paragraph 6.4.5, above.
6.8 The Contractor shall prepare and submit to the COR a “Traffic Control Plan” outlining the areas for material and equipment staging and movement around the site during the project. This traffic control plan shall be submitted along with line 6.4.5 above. There can be no delivery of any materials and/or equipment until the Traffic Control Plan has been approved by the COR.
In Progress Report Requirements
6.9 Daily Reports - The Contractor shall provide daily status reports to the COR and/or the on-site point of contact (POC) throughout the duration of the project until all work is completed. These updates shall be transmitted via email by 4:00 PM (Local Time) each Friday. The frequency of updates may be adjusted by the COR, as appropriate.
6.10 Two Week Look Ahead Schedule: the Contractor shall provide an updated Two Week Look Ahead Schedule to the COR and CS via email throughout the project duration.
6.11 Weekly Progress Color Photos: The Contractor shall provide weekly progress color photos. Photos shall be in digital format and be of size and quality that when printed on 8 ½” x 11” stock can show the detail of the work. Photos shall be of a quantity and quality to adequately show progress of the work being executed and related activities. Provide a minimum of six (6) progress photos per week. Photos shall be transmitted via email along with weekly reports by 4:00 PM (Local Time) each Friday.
Post-Removal Submittals
6.12 The Contractor shall furnish the following Post-Removal Submittals.
6.12.3 All post-removal photo submittals shall be reviewed and approved by the COR before final acceptance of project completion.
6.12.4 Contractor shall provide a 1 year warranty on labor, materials, including equipment and travel expenses from the date of acceptance of the project by the COR and the conclusion of the project and before final acceptance of the work.
7. GOVERNMENT-FURNISHED EQUIPMENT AND INFORMATION:

10. SECURITY:
1.1. SECURITY: The work conducted on this task order will be For Official Use Only (FOUO) with appropriate markings on all documents produced in support of this SOW. The Contractor shall comply with Customs and Border Protection (CBP) administrative, physical and technical security controls to ensure that the Government's security requirements are met.
1.2. PHYSICAL SECURITY: The Contractor shall safeguard all Government equipment, information and property provided for Contractor use. At the close of each work period, Government facilities, equipment, and materials shall be secured.
1.3. CBP BACKGROUND INVESTIGATION (BI) CLEARANCE:
(a) The Contractor shall comply with the CBP administrative, physical, and technical security controls to ensure the federal government's security requirements are met.
(b) Contractor s hired for work within the United States or its territories and possessions, and who require access to the Department of Homeland Security (DHS) owned or controlled facilities, information systems, security items, or products and/or sensitive but unclassified information shall be U.S. Citizens and shall live within the United States or its territories.
(c) The Contractor shall run a preliminary criminal background check on candidates prior to being referred for interviewing. Only candidates who pass the preliminary criminal background check performed by the Contractor shall perform work under this SOW.
(d) All Contractor’s hired for work must pass a criminal background check, which will be performed by CBP, Security Programs Division prior to being allowed full access to government systems. Failure to pass a criminal background check or a thorough CBP background investigation completed by the CBP, Security Programs Division is grounds for removal from working under this SOW.
(e) The Contractor shall submit within ten (10) working days after award of this Task Order, a list containing the full name, and date of birth of these candidates who have successfully passed the preliminary background investigation (BI) by CBP, or submit such information and documentation as may be required by the Government to have a BI performed for all personnel.
The information must be correct and be reviewed by a Customs Official for completeness. Normally, this shall consist of SF-85P, "Questionnaire for Public Trust Positions;" FD-258, "Fingerprint Chart;" and a Financial Statement. Failure of any Contractor personnel to pass a BI means that the Contractor has failed to satisfy the requirement to provide cleared personnel.
(f) The continuing failure to meet the requirement to provide cleared personnel is grounds for termination of the task order, unless cleared personnel are timely provided as replacements. The Contractor shall provide a qualified replacement capable of passing a BI for any person who fails to successfully pass a BI. This policy applies to any personnel hired as replacements.
(g) Completion of the investigation may be as brief as 90 days or as long as 1 year
All Contractor personnel will be escorted by a government appointed person while inside the Border Patrol Station.
