1. Will my experience substitute for the qualifications?
Answer: No, offerors shall comply with all Section L Phase I and Phase II Submission Instructions, as applicable.
2. We have technology that uses AI to detect border threats. Is this a solution that would be considered under this RFP?
Answer: Technology alone will not meet the requirements of this solicitation.
3. There have been some confusion when entries are due. Can you please clarify?
Answer: Responses to Phase 1 – Concept Papers/Qualifications Statements shall be received no later than 4 PM EDT on March 29, 2017 to the BorderWallDesignBuild@cbp.dhs.gov, unless the solicitation is otherwise amended.
4. Before I submit a CAD design of the structure, what are the requirements I must have in order to compete against other designers/architects?
Answer: Offerors shall comply with all Section L Phase I and Phase II Submission Instructions, as applicable.
5. The instructions for the two RFP’s (HSBP1017R0022 and HSBP1017R0023) look identical. Should both forms be filled out and returned…or are they indeed separate instructions?
Answer: HSBP1017R0022 and HSBP1017R0023 are two separate solicitations and must be responded to separately. All submissions shall be clearly labeled in the subject line of the email with the RFP number and Phase.
6. I would like an application for helping build the wall, how do I get?
Answer: See solicitations HSBP1017R0022 and/or HSBP1017R0023 on www.fbo.gov.
7. Please confirm the response dates for these two solicitations, I am seeing dates of 3-22-17 and 3-29-17?
Answer: For solicitations HSBP1017R0022 and HSBP1017R0023, questions were to be submitted no later than 03/22/2017 and, unless otherwise amended, Phase I proposals are to be submitted no later than 4 PM EDT on 03/29/2017. See Section L Phase I Submission
Instructions.
8. Please also confirm if there still is to be a concept drawing submitted today per 2017-JC-RT-0001 as I have been confused in the two
HSBs above.
Answer: “2017-JC-RT-0001” is a Pre-Solicitation notice. No proposal documentation is to be submitted against the Pre-Solicitation
Notice. See solicitations HSBP1017R0022 and/or HSBP1017R0023 on www.fbo.gov for details regarding submission requirements and deadlines.
9. Phase I Response Date is 4PM on 3/28/17. Is this 4PM Pacific? Central? Eastern time?
Answer: Responses to Phase 1 – Concept Papers/Qualifications Statements shall be received no later than 4 PM EDT on March 29, 2017 to BorderWallDesignBuild@cbp.dhs.gov, unless the solicitation is otherwise amended.
10. Will vendors be permitted to upload a video as part of their response to Solicitation #HSBP1017R0022 & HSBP1017R00223?
Answer: No, offerors shall comply with all Section L Phase I and Phase II Submission Instructions, as applicable.

11. The specifications refer to a bonding capacity letter (Page 44) but also a bid bond and include a copy of a bid bond. Is a bid bond needed with the original solicitations? If so, what exactly is the bid bond guarantying?
Answer: A “Bid Bond” (Standard Form 24) is not required for Phase I submissions, although each offeror’ shall discuss its ability to bond at a minimum value of $200,000. Please see Phase I Submission Instructions, Demonstrated Experience. A “Bid Bond” is required to be submitted alongside Phase II proposals in accordance with the requirements of Section L Phase II Volume II TAB B – Bonding Capacity.
12. Once a contract is awarded we assume that a Performance and Payment Bond will be needed with each Task Order issued?
Answer: Performance and Payment bonds are required after the award of a Task Order. See Section H Ordering Procedures for additional information.
13. A question that does not directly relate to bonding is: The Anticipated Contract Award language on page 35 indicates that the Task Order periods of performance under the IDIQ may end up to five years after the expiration of the IDIQ. It also indicates the IDIQ period will be for a five year period. Does this mean that IDIQ contracts could be issued for a five year period and that once issued could be in place for another five years? Or potentially ten years?
Answer: The IDIQ contract has an ordering period of five (5) years. The RFP will be revised as follows, “Task Orders issued under the
IDIQ contracts are established with their own periods of performance and as a result, may extend beyond the expiration date of the IDIQ.”
The Government does not have any indication at this time about the duration of future task orders. The period of performance will be determined at the time of each task order (TO) RFP.
14. Could you please provide the incumbent contract number? If not, is this a new requirement?
Answer: There is no incumbent contract. This is a new requirement.
15. The only way for me to access the "interested vendor" section is to get a username/pass, but those only seem available to vendors. Is there a way for non-vendors (i.e., media) to get access?
Answer: No, access is available to only Vendors and Buyers.
16. Should wage rates apply from Imperial County, CA, and Yuma County, AZ or is the entire contract based on San Diego County?
Answer: Task Order RFPs will identify the applicable Wage Determination for the location of the work. The first Task Order RFP is for work in San Diego County, CA.
17. We are a University, kindly let us know if we are eligible to submit a proposal. Secondly, if we are not eligible for the submission of the proposal, please let us know if we can join with an Indian company and submit the proposal using the technology that we developed.
Answer: All interested parties are invited to submit proposals for this effort provided they are able to comply with the RFP’s Section L
Phase I and II Submission Instructions. Please verify that the solicitation posted on March 17, 2017 at 9:47PM is the correct solicitation to use for submission of offers. Please verify as well that the posting of March 17, 2017 at 6:56PM contains a defective document upload and that the posting of March 17, 2017 at 9:42PM is a duplicate of the 9:47PM posting?
Answer: For HSBP1017R0022, the “RFP Package” link shall not be used and “Solicitation 1” and “Solicitation 2” are duplicates. A contractor can download the RFP from either Solicitation #1 or Solicitation #2. The link found for HSBP1017R0023, Solicitation #1 is to be used (also see any Amendments issued thereafter).
18. Would there be any objection to incorporating patented Israeli technologies?
Answer: Per the RFP, prototype designs shall not include the use of proprietary design or equipment. Offerors shall comply with all
Section L Phase I and Phase II Submission Instructions.
19. We note that as of 10:45 a.m. this morning no deadline has been set for submissions, are we reading that correctly? We assume that will be posted shortly?
Answer: This deadline was established on March 17, 2017. Responses to Phase 1 – Concept Papers/Qualifications Statements shall be received no later than 4 PM EDT on March 29, 2017 to the BorderWallDesignBuild@cbp.dhs.gov, unless the solicitation is otherwise amended.
20. We would like to confirm the format for submission (paper or electronic?) and where to address it when that deadline is set. (We realize that is probably buried in the literature provided, but would be grateful for assistance).
Answer: Offerors shall comply with all Section L Phase I and Phase II Submission Instructions.
21. The question is: Do you want the prototype, the mock-up, or both built?
Answer: If awarded a prototype task order, both would be built.
22. If we provide a contact for the entire team are we at liberty to keep the individual personnel names confidential until after the Phase II submission to protect our employees from potential media backlash?
Answer: The contractor is to identify in their proposal the “Key Personnel” as required. This information is procurement sensitive and will not be released.
23. What actions are expected of the team to commence services after the bid has been awarded?
Answer: The contractor would do the work as identified in its proposal/contracts/task orders.
24. Please confirm that the mentor-protégé letter is only required in Phase 2.
Answer: The mentor-protégé-letter is to be submitted under Phase II.
25. In the first paragraph, the instructions indicate submissions should be in Word and/or Excel format, and the third paragraph makes reference to .pdf pages. Please confirm that the entire submission can be submitted in .pdf, primarily to ensure that fonts are not substituted in Word when opened by a reviewer that alter the original layout and push the submittal beyond the 10-page limit.
Answer: The submission can be submitted as Excel, Word or PDF. The RFP will be revised to reflect this change.
26. The instructions currently are to submit a completed Project Performance Survey with our concept paper. Is it acceptable to submit more than one CBP Contractor Performance Evaluation Survey without it impacting the 10-page limit?
Answer: Offeror is to submit one (1) Project Performance Survey as described in Section L, Phase I, Demonstrated Experience. The completed Project Performance Survey and Summary Matrix are excluded from the 10 pages.
27. CLIN 004 Prototype demolition: Does this refer to taking down the wall after it is built?
Answer: Yes, if the line item is exercised.
28. HSBP1017R0023, pg. 39. 3) Prototype Concept Approach. If one used concrete for the underground portion of the wall, it could still count as 'other border type, if different above ground?
Answer: Yes.

29. Is there potentially going to be either a separate RFI or separate RFP coming out for Remote video surveillance systems, ground sensors, etc.? How will the new electronic sensors integrate with the existing CBP border sensor technology? What code to interface to, and what
PSIM or security management system exists or is to be utilized? : If there is not going to be a separate RFP for Remote video surveillance systems, ground sensors, etc, and there will be potential task orders as stated above that may include these technologies then how will the technologies be specified or selected for the project? How will the new electronic sensors integrate with the existing CBP border sensor technology? What code to interface to, and what PSIM or security management system exists or is to be utilized? What power sources will be specified along the border wall and patrol roads to power electronic detection sensors?
Answer: This question is not applicable for the prototype task order. If required in the future, it will be identified at the task order level.
30. Would the government consider a solution not incorporating a physical barrier but rather a combination of sensors, cameras, and advance surveillance/detection equipment integrated into a common operating picture? Capabilities combining data from multiple sources could support areas not amenable to physical construction and/or compliment physical barriers such as intrusion detection. If not in this procurement, is the government considering other procurements where such solutions could be offered?
Answer: Proposed solutions that do not meet the requirements of the RFP will not be considered. Offerors shall comply with all Section
L Phase I and Phase II Submission Instructions, as applicable.
31. Can respondents submit concept papers in Phase I that address a method to pay for building the wall without specifically proposing a prototype wall design?
Answer: No, offerors shall comply with all Section L Phase I and Phase II Submission Instructions, as applicable, in response to the requirements set forth in this solicitation. If interested parties want to submit concept papers for other ideas, such as those posed in this question, they may do so in response to DHS’s RFI number 2017-DHS-OCPO-RFI-0001.
32. Will barbed wire, or razor ribbon, or spikes, be acceptable for the top of the fence, to prevent climbing? Is there a requirement on installation rate for the fence, after the mock up phase on the project? Would a razor ribbon mesh panel be acceptable? Is a taut wire intrusion detection fence acceptable, to add to the fence panel? Does the bottom 12FT of the fence need to be see through?
Answer: Offerors shall comply with all Section L Phase I and Phase II Submission Instructions, as applicable. It is the offerors responsibility to develop their own solutions.
33. We supplied steel on the Secure Border Fence Act to a sub-contractor. We received a letter of performance support, can I include that letter in reference to the project performance survey?
Answer: A letter of performance may not be substituted for a Project Performance Survey and inclusion of a letter of performance in addition to the Project Performance Survey will be counted against the 10-page limitation for Phase I proposals. For the project performance survey, see Section L Phase I, Demonstrated Experience.
34. Can we include several design concepts that approach the minimum requirements differently?
Answer: No, doing so would constitute alternate proposals, which will not be accepted in response to this solicitation. We will accept only a single design per offeror for each solicitation.
35. The solicitation offer states the commercial and institutional building construction business size standard is $36.5M. Does this mean the contractor has to be small business to submit an offer or does this represent annual volume of small business qualification? Please clarify.
Answer: No, this is a “full and open” competition and is not restricted to small businesses.
36. Will the design of the wall allow for precast concrete segments and will they need to be field grouted? Will the design allow for open windows of steel mesh?
Answer: It is the offerors’ responsibility to develop their own solutions in accordance with the instructions provided in the RFP.
37. Will there be opportunities to equip the concrete wall with custom defense mechanisms?
Answer: Offerors shall comply with all Section L Phase I and Phase II Submission Instructions, as applicable.
38. Will the contractor be able to invoice for milestone payments during the execution of a task order?
Answer: No, milestone payments are not applicable to this requirement. See Section G: Contract Administration Data.
39. Will the USG consider a sub-contractor's letter of commitment from a federally approved surety as fulfilling the bonding requirement?
Answer: A “Bid Bond” (Standard Form 24) is not required for Phase I submissions, although offerors shall discuss their ability to bond at a minimum value of $200,000. Please see Phase I Submission Instructions, Demonstrated Experience. A “Bid Bond” is required to be submitted during Phase II in accordance with the requirements of Section L Phase II Volume II TAB B – Bonding Capacity.
40. Will the restrictions of no proprietary designs be deleted?
Answer: No, this restriction will not be deleted.
41. Does the Project Performance Survey form count toward the ten page total?
Answer: No, the completed Project Performance Survey and Summary Matrix are excluded from the 10-page limit for Phase 1 Concept
Papers.
42. For those companies selected for Phase II, will there be a second period for asking questions?
Answers: The Government may allow for additional questions in relation to Phase II.
43. Background: The submission format instructions on page 38 prohibit the use of font sizes smaller than 12, and the instructions for preparing the Prototype Concept Approach permit the inclusion of "conceptual level presentation drawings." Question/Comment: Request that font sizing for wording or data in tables, figures, drawings or graphics be permitted to be "not smaller than 10."
Answer: The offeror’s entire Phase I submission shall be in 12-point font.
44. Phase I proposal limitation is 10 pages, excluding the Project Performance Survey, Summary Matrix, Table of Contents, and divider pages. Do organizational resumes and key personnel resumes count against the 10 page limit? Can any other attachments be included that do not count against the 10 page limit?
Answer: “Do organizational resumes and key personnel resumes count against the 10 page limit?” – Yes.
“Can any other attachments be included that do not count against the 10 page limit?” – No.
Resumes and any other attachments not identified in Section L, Phase I Submission Instructions will count against the 10-page limit if included. See Section L, Phase I Submission Instructions for the full requirement on what is excluded from the 10-page limit.
45. Please confirm that the Offeror's cover letter and cover sheets are excluded from the page count.
Answer: No, they are not excluded from the 10-page limitation. See Section L, Phase I Submission Instructions. If cover letters and cover sheets are included, they will count against the 10-page limit.
