3. Description of Supplies/Services:

U.S Customs and Border Protection (CBP), currently employs fully integrated scenario based training as part of the Use of Force Training curriculum nationwide. In instituting this program, CBP has deployed the simulated projectile training system known as FX Simunitions. This system allows participants to simulate the actions required in a deadly force encounter during training, in as realistic a way as possible, while still maintaining a safe environment. Produced by General Dynamics, this system includes both specialized kits for the conversion of firearms, as well as the magazines and projectiles used with these converted firearms. This contract vehicle is for the purchase of additional conversion kits and projectiles to augment and support the training curriculum. Items will include:

The requirement is to provide simulation marking cartridges, blank cartridges, weapons conversion kits, and magazines for use in scenario based use of force training to CBP at a total cost not to exceed $9,500,000.

4. Identification of Authority and Supporting Rationale Permitting a Limited Sources Award:

The authority permitting CBP to restrict consideration to a Sole Source Acquisition is found at FAR 6.302-1 – Only one responsible source and no other supplies or services will satisfy agency requirements.

CBP/UFCE has unique requirements related to fully integrated scenario based training, including the conversion of current CBP-owned firearms for use in this training. CBP has invested significant manpower developing the training curriculum, as well as a tremendous amount of funds on the Simunitions system. Any future procurements should include interoperability with the currently deployed systems as a mainstay of the technical requirements. Based on market research, the FX system design is proprietary and therefore will only work with FX components.

Product reviews from CBP indicate General Dynamics is the only provider that can provide the interoperability with the FX Simunition system. Therefore, it is the only responsible source that will satisfy the agency requirements.

5. Demonstration That the Nature of the Acquisition Requires Use of the Authority Cited:

CBP currently has significant numbers of FX converted weapons, along with perishable stocks of FX marking cartridges. To invest in any new system that does not allow for compatibility and interoperability with the current systems in place would duplicate efforts, create competing interests, and overall be a poor use of fiscal resources. Also, if a different conversion kit were to be introduced, CBP would have to purchase and maintain two separate inventories of projectiles, creating possibly unsafe training situations (if the wrong projectile was use in the wrong converted weapon.) Logistical planning also becomes problematic, if one system runs out of projectiles prior to the other. To maintain consistency, investment of funds for a supply contract with General Dynamics represents the best value overall to the government.

6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable:

A FedBizOpps notice will be publicized, as required by FAR Subpart 5.102(a)(6) and 5.2.

7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable:

The contracting officer has determined that the anticipated price(s) will be fair and reasonable based on previous orders, other agency contract pricing, GSA schedule pricing and commercial price list.

8. Description of Market Research:

Market research for simulated training projectiles and conversion systems has been an ongoing endeavor. This research was conducted via the internet, with vendors, and with specific civilian contacts that have intimate training and handling experience in the aforementioned products.

There are currently three manufacturers of simulated training projectiles. UFCE has identified General Dynamics (GD), Force on Force, and UTM. Program personnel looked at the technical compatibility of each vendor’s products with CBP’s current system.

Ultimately, GD’s FX Simunition System was determined to be the only system that met all of the government’s technical needs and requirements, including compatibility.

GD does have one GSA authorized distributor but several items have been modified to meet CBP requirements and are not available through the distributor.

9. Any Other Facts Supporting the Use of Other Than Full and Open Competition.

The overall marketplace includes manufacturers of firearms based simulated training rounds, including weapons platforms and accessories. CBP’s specific marketplace is limited to manufacturers of devices that meet all CBP’s technical requirements, including firearms conversion kits as well as projectiles. Currently, however, there is only one known manufacturer capable of meeting CBP’s requirements. This is due to the interoperability needed between the current system and new items being procured.

Alternate manufactures identified as producing simulated training systems are not capable of this functionality. Due to the proprietary nature of the manufacturing systems, the requirement could not be tailored to allow for modification of other systems to meet the Governments needs.

10. A Listing of the Sources, if Any That Expressed, in Writing, an Interest in the Acquisition:

None

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition for Supplies or Services Required:

At this time, no additional future procurements for supplies, beyond this IDIQ contract, are foreseen. If, however, a future need does arise, CBP will continue to monitor advancements in technology and innovation to ensure that competition is fostered and utilized.
