Amendment 01
The following is incorporated into the solicitation:
1. While the Scope of Work, under "Background", identifies the number of full time employees and trainees at this facility, it does not provide any minimum guarantee with respect to the number of people who will eat at the dining hall or the amount of money that will be spent each month. Is the Government able to provide historic information regarding dining use and spending for this population?
Answer: The dining hall has never been used, thus, there is no past service information to provide. Note: The personnel assigned and in-training at the CBP facility are not obligated to eat in the dining facility.
2. Would the government consider amending the RFP to include a minimum spending guarantee?
Answer: No.
3. Is a bidder able to offer a percentage of total revenue for the monthly payment/cost rather than a fixed monthly dollar fee?
Answer: No.
4. Do we have to charge the per diem rate for lunch for Jefferson County or can we charge more? What is the per diem rate for Jefferson County?
Answer: No and Not applicable, respectively. The contractor menu pricing is the contractor’s decision. Note: The menu pricing should be competitive with the local market as the potential customers are not obligated to eat in the dining hall.
5. Do we pay our employees minimum wage as a starting wage or is there a different wage based on the fact this is a government facility.
Answer: For contracts equal to or less than $2,500, contractors are required to pay the federal minimum wage as provided in Section 6(a)(1) of the Fair Labor Standards Act.
The federal minimum wage provisions are contained in the Fair Labor Standards Act (FLSA). Note: Some States also have minimum wage laws and laws providing greater employee protections; the contractor must comply with both (Federal and WV State requirements, whichever is most stringent).
6. Are the services you are seeking for lunch only? Or is the expectation for breakfast & lunch.
Answer: Providing a Lunch service is the only meal service that is mandatory. The contractor may seek approval from CO to offer a Breakfast and Dinner meal. The Breakfast would not start serving before 6:00 am and Dinner meal would have to end by 7:00 pm.
7. Replace Attachment 02 – Government Furnished Property in its entirety. This change deletes the items listed under “Expendable & Durable Items” as these items are not provided. Any references to these items in the solicitation are hereby deleted.
8. The Due Date for Quotes remains unchanged.
