About this file

This is a Justification and Approval (J&A) document for an Other Than Full and Open Competition procurement under FAR Part 6, specifically for Criminal History Record Information (CHRI) Access services.

The Defense Counterintelligence and Security Agency (DCSA), Procurement Solutions Directorate, is the procuring activity seeking to award a Firm Fixed Price (FFP) contract to National Law Enforcement Telecommunication System, Inc. dba International Justice & Public Safety Network (Nlets) for CHRI access services. The contract period of performance is 51 months from October 1, 2026 through December 31, 2030, consisting of a 3-month base period and four 12-month option periods, with an optional FAR 52.217-8 extension of six months through June 30, 2031. The estimated total contract value, inclusive of option periods but excluding the extension, is redacted. DCSA requires access to international criminal, law enforcement, and public safety records over a secure network to support personnel vetting and background investigations for federal agencies and continuous vetting requirements under Trusted Workforce 2.0. Nlets is designated as the sole source provider because it is the only entity capable of providing direct access to Criminal History Record Information repositories across 50 U.S. States and Territories, Washington D.C., Canada, and international sources (Interpol) while meeting Federal Investigative Standards (FIS) and 5 U.S. Code § 9101 requirements. Services include data connections to CHRI repositories via Nlets facilities in Boyers, Pennsylvania and Columbus, Ohio; technical support and monitoring including network device support, IOS upgrades, security patches, circuit uptime reports, and 24/7/365 monitoring from the Nlets Network Operations Center. DCSA conducted market research via a Sources Sought notice on April 10, 2025 (DCSA_CHRI_SSN_FY25), which yielded two unqualified responses. Procurement history shows four recent CHRI Access contracts awarded to Nlets, with the current FFP award HS002125CE011 having a base period of July 2025 through June 2026. The J&A documents that Nlets is a 501(c)(3) not-for-profit organization owned and operated by the 50 U.S. States, districts, and territories, and is the only provider of this capability in the United States. The fair and reasonable pricing determination is based on Nlets member committee-established pricing and historical government payments, with no certified cost or pricing data required per RFO FAR 15.403-2(b).
