SECTION M - EVALUATION FACTORS FOR AWARD

The following have been modified:

EVALUATION CRITERIA/PROCESS

M-1. Basis for Award: The Government intends to award a single Purchase Order to the Vendor providing the

Lowest Priced Technically Acceptable (LPTA) quote. The following factors will be evaluated:

Factor 1: Technical

Factor 2: Past Performance

Factor 3: Price

M-2. Evaluation Process Upon identification of the quote with the lowest price as illustrated below (Table Figure

#1), the quote will be fully evaluated for acceptability in Technical and Past Performance. In order to be considered for award, there must be an "Acceptable" rating in every non-price factor. If the initial lowest priced quote is found

"Acceptable", the Government will evaluate the next lowest priced quote to determine adequate competition. If the initial lowest quote is determined to not be “Acceptable”, then the Government will move on to the next quote for evaluation and so on until an “Acceptable” lowest priced quote and next lowest priced quote is evaluated. No other quotes will be evaluated for acceptability once the lowest and next lowest priced quotes have been evaluated as

“Acceptable”. Finally, the price of the LPTA quote must be determined fair and reasonable, most likely based on adequate competition established through the second LPTA quote. Should the Government not have a second

“Acceptable” quote, the Government reserves the right to utilize methods other than adequate competition to determine fair and reasonable. Tradeoffs are not permitted. The Government intends to award without discussions;

however, the Government reserves the right to enter in discussions if it sees fit.

The Government will take the extended total prices provided by the Vendors as fill-ins to Section L Table Figure #3 and add those extended total prices up for an overall total and rank the Vendors by lowest to highest based on that overall total.

Table Figure #1

Pricing Schedule [Step-Ladder Pricing]

Attendee Range Unit Price Per Person Extended Total Price

Min 200 attendees $3.00 $600.00 (Qty 200)

201-349 attendees $2.00 $698.00 (Qty 349)

350-450 attendees $1.00 $450.00 (Qty 450)

M-2.1 Technical - Factor 1. The Technical factor will be evaluated based on the Vendor’s demonstrated understanding and adequate proposed solution to the requirements described in Section C. The Quote will be evaluated to assess:

a) Does the quote provide a detailed breakdown of all proposed refresh necessary to meet the requirements of Section

C?

b) Does the quote provide a detailed and sufficient explanation of the catering services necessary to complete the tasks in Section C and demonstrate an understanding of the requirement, looking specifically at:

i) Does the quote include a sufficient explanation of the conference schedule – to include (but not limited to) arrival time, set-up time, replenish time, clean-up time and departure time?

ii) Does the quote include a sufficient description of the set-up required?

iii) Does the quote include a sufficient technical approach for maintaining the refreshments throughout the day as defined in Section C.

Technical will be rated on an “Acceptable” or “Unacceptable” basis using the ratings in Table #2 below. The Vendor’s

Quote must be “Acceptable” in all elements of the Technical Factor to be considered overall “Acceptable”.

Table #2 – Technical Ratings

Adjectival Rating Description

Acceptable Quote meets the requirements of the solicitation

Unacceptable Quote does not meet the requirements of the solicitation.

M-2.2 Past Performance Evaluation - Factor 2. The Government will review the Past Performance provided by the

Vendor in order to determine Past Performance acceptability. The Government will evaluate Past Performance using the information submitted on the narratives provided by the Vendors in accordance with Section L-2.2. The

Government will assess customer satisfaction, quality of food prepared, timeliness and compliance with delivery / performance schedule for jobs that are similar in size, scope and complexity, current or within the last three (3) years, to this requirement. This information may be verified with that customer referenced. Past performance will be rated on an “Acceptable” or “Unacceptable” basis using the ratings in Table #2.

Table #3 – Past Performance Evaluation Ratings

Adjectival Rating Description

Acceptable Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown. (See note below.)

Unacceptable Based on the Offeror’s performance record, the Government does not have a reasonable expectation that the Offeror will be able to successfully perform the required effort.

Note: In the case of a Vendor without a record of relevant Past Performance or for whom information on Past

Performance is not available or so sparse that no meaningful Past Performance rating can be reasonably assigned, the

Vendor may not be evaluated favorably or unfavorably on Past Performance. Therefore, the Vendor shall be determined to have unknown Past Performance. In the context of acceptability/unacceptability, “Unknown” shall be considered “Acceptable.”

Total Price

(The extended total prices for each range will be totalled and utilized for evaluation purposes.) $1,748.00

M-2.3 Price Evaluation - Factor 3. Price will be evaluated for fair and reasonable. The Government will evaluate each individual quantity range’s (Minimum 200, 201-349, and 350-450) unit price for fair and reasonable. Price will not be assigned an adjectival rating nor be scored.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(i) Technical Acceptability of the items offered to meet the Government requirement;

(ii) Past Performance;

(iii) Price;

Technical and Past Performance, when combined, are significantly less important than Cost or Price (10 U.S.C.

2305(a)(3)(A)(iii) and 41 U.S.C. 3306(c)(1)(C)).

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
