PART 1

GENERAL INFORMATION

1. GENERAL INFORMATION:

1. General: This is a non-personal services contract to provide ED 503, ED 504, ED506, ED 507, ED 508, ED 511, ED 512, ED 513 and ED 514. The Government will not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.

1.1. Description of Services/Introduction: The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, other items, and non-personnel services necessary to execute graduate level training as defined in this Statement of Work

(SOW).

1.2. Background: Defense Security Service (DSS) has a requirement for training services in support of the Center for Development of Security Excellence (CDSE).

1.3. Objectives: Contractor support is required to assist the CDSE Training Division in the analysis, design, development, and maintenance of training for the Writing and Communication Skills for Security Professionals and Security as an Integral Part of DoD Programs.

1.4. Scope: The contractor shall provide all personnel, equipment, tools, materials, supervision, and other items and services necessary to implement (deliver) graduate level courses as defined in this Statement of Work (SOW).

1.5. Period of Performance: The period of performance shall be for 10 months

1.6. General Information

1.6.1. Quality Assurance: The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).

1.6.2. Recognized Federal Holidays:

*The Government holiday is Friday if the date falls on a Saturday, and the Government holiday is Monday if the date falls on a Sunday.

1.6.2.1. Other designated days: The Government observes the following days as holidays:

Day(s) designated by Federal Statute or by Presidential Executive Order, Presidential Inauguration Day, and any other day so designated by the President’s Proclamation. Such days are agreed to by the contractor that observance of such days by Government personnel shall not otherwise be a reason for an additional period of performance, or entitlement of compensation except as set forth within the contract. In the event that the contractor’s personnel work during the holiday, the contractor will reimburse employees according to applicable labor laws;

however, no form of holiday or other premium compensation will be reimbursed under the contract either as a direct or indirect cost, other than their normal compensation for the time worked.

1.6.4. Hours of Operation: The contractor is responsible for conducting business between the hours of 8:00 a.m. to 4:30 p.m., Monday through Friday, except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government-directed facility closings. For other than firm fixed price contracts, the contractor will not be reimbursed when the government facility is closed for the above reasons.

The Contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.

1.6.5. Place of Performance: Work will be performed at the contractor’s facility, with periodic face to face meetings at CDSE facility, Linthicum, MD, 21090. Other face-to-face meetings may be required in the National Capitol Region.

1.6.6. Type of Contract: This RFP is conducted under FAR Part 12.6 and 13.5. The government will award a firm fixed price contract.

1.6.7. Security Requirements: None. This is an unclassified contract. Contractors will not require access to DSS information systems or networks.

1.6.7.1. Physical Security: The contractor shall be responsible for safeguarding all government information provided for contractor use.

1.6.8. Special Qualifications: The contractor is responsible for ensuring all employees involved in the review and submission of DoD SPēD certifications for accreditation are qualified and recognized by the NCCA. Contractor personnel will possess and maintain the knowledge, skills, and expertise in national certification, licensure, and accreditation recognized by the NCCA throughout the execution of this contract.

1.6.9. Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post-award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officer’s Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.

1.6.10. Contracting Officer Representative (COR): The COR will be identified by separate letter of designation issued by the Contracting Officer. A copy of the COR designation letter will be sent to the Contractor, stating the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates, or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.

The COR monitors all technical aspects of the contract and assists in contract administration.

The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communications with the Contractor concerning technical aspects of the contract; issue written interpretations of technical requirements, including Government drawings, designs, and specifications: monitor Contractor’s performance and notify both the Contracting Officer and Contractor of any deficiencies; coordinate availability of government-furnished property, and provide site entry of Contractor personnel.

1.6.11. Identification of Contractor Employees: All contract personnel attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties, are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed. When visiting CDSE, contractors will be required to obtain and wear visitor badges.

1.6.12. Key Personnel: The following personnel are considered key personnel by the government: Program Manager (PM), Instructional Systems Designer, and Instructor / Subject Matter Experts (SME) for each course. See the position descriptions listed below for further detail. The contractor shall notify the COR at least two (2) weeks prior to replacing any key personnel, and the new individual must be at least as qualified as the individual being replaced.

The Program Manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The Program Manager or alternate shall be available between 8:00 a.m. to 4:30 p.m., Monday thru Friday except Federal holidays or when the government facility is closed for administrative reasons. Qualifications for all key personnel are listed below:

1.6.12.1. Program Manager. The contractor shall appoint an individual that has experience and qualifications commensurate with the program management responsibilities of this contract.

1.6.12.2. Instructional Systems Designer. Instructional Systems Designer. This individual shall have demonstrated experience developing and updating instructor-led or instructor-facilitated online distance-delivered courses. A minimum of a graduate degree in instructional systems design or five years of experience in instructional systems design is required.

1.6.12.3. Instructors / SMEs. The SME / Instructor for ED 503 must have a Master's Degree; a Juris Doctorate degree is preferred. Experience directly related to teaching students to apply Constitutional Law to DoD security is preferred. The individual must have at least one year experience dealing with legal issues within a U.S. Government agency or within the U.S. military services. An Instructor / SME will be designated to each course. Each Instructor/SME must have documented successful completion of an instructor training course or prior educational experience that aligns with an instructor training course and documented 100-hours of instruction within the online collaborative learning environment, classroom or blended learning environment, presenting subject-matter relevant to the course that he or she is assigned to. Each SME Instructor must have a Master's Degree, at least one year experience teaching at the collegiate level. Experience directly related to the subject matter presented in each course is preferred.

1.6.13. Contractor Travel: Contractor may be required to travel within the National Capital Region during the performance of this contract to attend CDSE-sponsored meetings and conferences.

1.6.14. Data Rights: The data Government rights are set forth in the clause 252.227-7015 included in this contract.

1.6.15. Organizational Conflict of Interest: Contractor and subcontractor personnel performing work under this contract may receive, have access to or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements) or perform evaluation services which may create a current or subsequent Organizational Conflict of Interests (OCI) as defined in FAR Subpart 9.5.

The Contractor shall notify the Contracting Officer immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the Contracting Officer to avoid or mitigate any such OCI. The Contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the Contracting Officer and in the event the Contracting Officer unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the Contracting Officer may affect other remedies as he or she deems necessary, including prohibiting the Contractor from participation in subsequent contracted requirements which may be affected by the OCI.

PART 2

DEFINITIONS & ACRONYMS

2. DEFINITIONS AND ACRONYMS:

2.1. DEFINITIONS:

2.1.1. CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.

2.1.2. CONTRACTING OFFICER. A person authorized to enter into, administer, and/or terminate contracts, and make related determinations and findings on behalf of the government.

Note: The only individual who can legally bind the government.

2.1.3. CONTRACTING OFFICER’S REPRESENTATIVE (COR). An employee of the U.S.

Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.

2.1.4. DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement.

2.1.5. DELIVERABLE. Anything that can be physically delivered, but may include non-manufactured things such as meeting minutes or reports.

2.1.6. KEY PERSONNEL. Contractor personnel who are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the SOW. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.

2.1.7. PHYSICAL SECURITY. Actions that prevent the loss or damage of Government property.

2.1.8. QUALITY ASSURANCE. The government procedures to verify that services being performed by the contractor are performed according to acceptable standards.

2.1.9. QUALITY ASSURANCE SURVEILLANCE PLAN (QASP). An organized, written document specifying the surveillance methodology to be used for surveillance of contractor performance.

2.1.10. QUALITY CONTROL. All necessary measures taken by the contractor to assure that the quality of an end product or service shall meet contract requirements.

2.1.11. SUBCONTRACTOR. One who enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor.

2.1.12. WORK DAY. The number of hours per day the Contractor provides services in accordance with the contract.

2.1.13. WORK WEEK. Monday through Friday, unless specified otherwise.

3.1. Materials/Services: The Government will provide:

4. CONTRACTOR-FURNISHED ITEMS AND RESPONSIBILITIES:

4.1. General. The Contractor shall furnish all supplies, equipment, facilities, and services required to perform work under this contract that are not listed under Section five (5) of this SOW. 5.0 Task

PART 5

5.0 Task

5.1 Scope of Work: Unless otherwise stated in writing by the Contracting Officer (CO), the contractor shall provide all personnel, equipment, tools, materials, supervision, and other items and services necessary to implement (deliver) a graduate level courses as defined in this Statement of Work (SOW).

The courses ED 502, ED 503, ED 504, ED 506, ED 507, ED 508, ED 511, ED 512, ED 513 and ED 514 are graduate-level courses. The courses are each equivalent to three (3) graduate credit hours and are presented over a period of approximately sixteen weeks, including online instructor-facilitated distance-learning instruction. The contractor shall present each course to a class with an average size of 10 to 20 students per course iteration.

These courses provide an educational opportunity for mid-career security specialists to gain in-depth knowledge and understanding of complex subject matter that is essential for security professionals to move into senior leadership and executive positions in the Federal government.

The courses will develop each student’s ability to use this knowledge to become more effective as security leaders in the Department of Defense (DoD). The courses include instruction and activities in an interactive online collaborative learning environment (CLE), and assignments that each student will prepare independently. Case studies, research papers, scholarly reading assignments, and other methods of instruction that facilitate in-depth analysis of complex issues are included in these courses.

Each course shall be presented in accordance with the Detailed Course Design Document that is attached. Each detailed course design document describes the course, includes a detailed course syllabus and all documentation required to present the course.

5.2 Course Delivery Requirements

5.2.1. The contractor shall update course material for each course to reflect appropriate dates and current events and to make improvements based on feedback from prior presentations of each course (not to exceed 10% of course material). Coordinate with CDSE staff to make any needed changes to Detailed Design Document consistent with changes to course material. It is desired for this to be done two (2) months prior to the beginning of each class but no later than three weeks before the class begins.

5.2.2. Post updated course material on CDSE’s Sakai collaborative learning environment (CLE) by one month prior to presentation of each class.

5.2.3. Present each course in accordance with the solicitation document for the Spring and/or

Summer sessions IAW Detailed Design Document, facilitated by SME instructor.

(January 5 – April 24, 2015 and April 27 - August 21, 2015) o Evaluate student performance during the course / Grade assignments o Provide feedback to each student on assignments o Administer level one (1) evaluation including a questionnaire / survey o Post all student grades including final cumulative grades in CDSE’s record system

5.2.4. Provide a post-course report for each class including a summary of student grades, data gathered by level one (1) evaluation, problems encountered, list of current events or policy changes that require modification to course content, and recommendations for updates and improvements to be made to each course before it is presented again. The reports should also document any unique or unusual circumstances or events that had an impact the course or on delivery of the course. This report is due 30 days after the course is presented for each class.

5.2.5. Participate in CDSE meetings to discuss course content, delivery, and other matters related to the courses.

5.2.6. Provide monthly activity reports including a summary of activities performed by the contractor in support of this contract.

6.0 Deliverables

6.1 Update Course Material: Update course material for each course to reflect the appropriate dates and current events and to make improvements based on feedback from prior presentations of the course (not to exceed 10% of course material). Coordinate with CDSE staff to make any needed changes to Detailed Design Document consistent with changes to course material. (This should be done approximately two months prior to each class.)

6.2 Post updated course material for each course on Sakai CLE by December 5, 2014 and March 28, 2015.

6.3 Implementation. The contractor shall be responsible for implementing (teaching) each course using the approved final detailed course design document and course material. The contractor shall present each course to approximately 10–20 students over a period of 16 or 17 weeks. The contractor is responsible for grading students’ coursework, entering grades in the Sakai CLE, and reporting students’ final grades to the Chief of the CDSE Education Division, timely responding to students’ questions, and providing feedback on student assignments.

During the last week of the class, the contractor shall administer a level one evaluation including a questionnaire / survey soliciting from each student feedback about the course.

Implementation includes administering level one evaluation and level two evaluation as indicated below.

6.4 Level One evaluation (Reaction). The contractor shall administer an evaluation for each class in which students complete a course evaluation form during the last week of the course. This may be done electronically in Sakai. The contractor will tabulate the results of the evaluation. The results shall be included in the Post-Course Report for each course each time the course is presented.

6.5 Level Two evaluation (Learning). For each course, the contractor shall use the previously created graded assignments and examinations to allow the instructor to evaluate each student’s comprehension of the main concepts and information presented in the course.

The graded assignments will be administered and graded as described in the detailed course design document. The assignments and examinations must be appropriate for graduate-level education and must be graded based upon documented criteria. The instructor shall assign a grade to each student based upon this evaluation and record those grades in the CDSE system of records. Grades for student assignments and examinations must be posted in the Sakai CLE and the cumulative final grades for each student who completes the course must be reported to the Chief, CDSE Education Division within ten days of the completion of the class. A cumulative summary of student grades shall be included in the Post-Course Report for each class.

6.6 Post-Course Reports. At the end of each semester the Contractor shall provide a post-course report for each class including a summary of student grades, data gathered by level 1 evaluation, problems encountered, list of current events or policy changes that require modification to course content, and recommendations for updates and improvements to be made to the course before it is presented again. Each report should also document any unique or unusual circumstances or events that had an impact the course or on delivery of the course.

[Report is due 30 days after presentation of each class.]

6.7 Participate in Meetings. Each SME instructor will participate in up to fifteen hours of meetings related to updating and delivering courses as scheduled by CDSE. This will include faculty meetings, meetings to discuss updates to courses and meetings to discuss other topics incidental to delivery of CDSE courses. 6.8 Monthly Activity Report. This report shall be provided electronically to the COR not later than noon, the first Monday of each month. This report shall outline tasks accomplished, meetings attended, problems encountered, mitigation strategies, risks and any other relevant performance information.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph

(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
