HS0021-13-Q-0009

Justification for Other Than Full and Open Competition for

Sectera vIPer Universal Secure Phones

I. Contracting Activity

Defense Security Services (DSS) Office of Acquisitions 27130 Telegraph Road Quantico, VA 22134

II. Description of the Action being approved

Award of a Sole Source Purchase Order for Sectera vIPer Universal Secure Phones.

III. Description of (Supplies/Services)

Ten Sectera vIPer Universal Secure Phones and three software update cables estimated value of . A certified funding document with FY2013 O&M funding will be used for the procurement of this requirement.

IV. Statutory Authority Permitting other than full and open competition

10 U.S.C. 2304(c)(1), One source or limited sources.

V. Rationale Justifying Use of Cited Statutory Authority

In accordance with the Committee on National Security Systems, National Instruction for Approved Telephone Equipment, dated September 2011, General Dynamics is the only source to purchase the Sectera vIPer Universal Secure Telephone. The vIPer is manufactured by General Dynamics C4 Systems (GDC4S) which is the only National Security Agency (NSA) approved source for this Cryptographic Controlled Item (CCI) and the only Voice over IP Phone certified by the NSA to protect voice communications classified Top Secret and below over commercial, wired VoIP networks.

VI. Efforts to Obtain Competition

Market research was conducted in order to obtain competition. One alternative option for procuring the Sectera vIPer Secure Telephone apart from entering into a direct award with General Dynamics C4 Systems was found.

General Dynamics has a requirements contract that may be used as the contract vehicle to make purchases. The contract is administered out of the Maryland Procurement office (MPO) at Fort Meade for the National Security Agency (NSA). This vehicle is available to US Government customers by sending funding via a Military Interdepartmental Purchase Request (MIPR) to MPO. MPO then can place an order directly with General Dynamics.

HS0021-13-Q-0009

A direct award with General Dynamics C4 Systems for the purchase of Sectera vIPer Telephones is the most efficient and cost effective approach to meet the customer’s needs in a timely manner.

VII. Price Reasonableness

The contracting officer has determined the anticipated cost to the Government of the Sectera vIPer Universal Secure Telephones covered by this J&A will be fair and reasonable.

VIII. Actions to Remove Barriers to Future Competition

For the reasons set forth in Paragraph 5, the Defense Security Service (DSS) has no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, (DSS) will assess whether competition for future requirements is feasible.

IX. Point of Contact
