JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Office – Defense Commissary Agency, IT Contracting Branch, Ft. Lee, VA
2. Type of Contract Action – This is a new firm fixed price contract utilizing surcharge funds.
3. Description of Supplies/Services – GLink software maintenance renewal; estimated total value of $ :
Base 9/1/2018 – 8/31/2019 $16,500.00
OY1 9/1/2019 – 8/31/2020
OY2 9/1/2020 – 8/31/2021
OY3 9/1/2021 – 8/31/2022
OY4 9/1/2022 – 8/31/2023
4. Authority Cited - 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1(b)(1)(ii) Only one responsible source and no other supplies or services will satisfy agency requirements
5. Reason for Authority Cited - This renewal directly supports DIBS, which is one of the agency’s primary business systems. Upgraded technologies are required to enhance the agency’s performance and promote interoperability throughout the DoD, the military retail system and our industry partners. More specifically, DIBS provides commissaries and central distribution centers (CDCs) around the world the ability to order product in support of the DoD’s military members, their spouses, retirees, and guard and reserve personnel. As a result, DeCA has a requirement to keep DIBS operational to ensure stores and CDCs retain their ability to order product (groceries).
GLink is an inherent software application that allows this functionality and is being used by DeCA personnel at headquarters, regions, stores, and CDCs as the means to connect to the DIBS ordering system. In order to remain up-to-date, the licenses require maintenance to receive software updates, push patches, and helpdesk support.
GLink software is the proprietary product embedded in the Defense Commissary Agency’s Interactive Business Systems (DIBS) design and is required to ensure that the DIBS system remains operational in support of DeCA's mission. Without the current version of GLink, DeCA's core business sustainment operations (commissaries around the world 24x7) would be in jeopardy.
Only GLink, the software publisher, can provide the software maintenance to ensure that DeCA operates the current version of GLink software and receives the necessary updates, security patches, and helpdesk support.
6. Efforts to Obtain Competition - The Contracting Officer reached out the G&R to determine if they had any US resellers and they did identify one company, however, the partner can only sell new licenses and associated maintenance and because this requirement is only for a renewal, it is not open for the partner company to bid on. LEA IT Contracting also posted a notice of intent/sources sought notice to FBO on April 18, 2018 with a response date of May 9, 2018. No vendors responded to the notice.
7. Fair and Reasonable Cost Determination – The price will be determined fair and reasonable prior to award.
8. Market Research and Interested Sources – Research indicates that Gallagher & Robertson AS (G&R) are the owner and sole publisher of the GLink application. While G&R does have a distributor in North America, as stated above, the partner is only authorized to sell new license and maintenance. Since, this is a renewal, DeCA must procure maintenance from the original license provider, G&R.
9. Actions to Increase/Foster Competition - DeCA procured a new Enterprise Business Solution (EBS) in 2014. EBS is replacing aging supply chain processes and systems DeCA currently uses both at the Headquarters and commissaries worldwide to include club store formats. DeCA requires a fully integrated grocery specific retail business suite that performs all supply chain functions necessary to operate and manage a large retail grocery business. The solution consists of a tightly interconnected suite of application programs, subsystems, or modules that share common data elements, and common graphical user interfaces. The suite contains modules that can be implemented and deployed incrementally, yet still retain the integrated characteristics of the entire suite. Data must be easily shared with other modules without the use of complex proprietary interfaces. Implementation of the module that would ultimately replace DIBS will occur, but until that time, the DIBS application must remain operational.
10. Other Factors - Acquisition history: HQC007-11-P-0003 and HQC007-14-P-0002. Other benefits to DeCA include, but may not be limited to: no changes required to the legacy DIBS application; no downtime expected which ensures continuity of operations; ensures stores remain well stocked in direct support of commissary mission to support military members, their spouses, guard and reserves personnel, and retirees. Only GLink software can interface and provide maintenance with the current DeCA owned GLink software. Only G&R can provide help desk support on their proprietary software and equipment.
