JUSTIFICATION AND APPROVAL
LIMITED SOURCES JUSTIFICATION
1. Contracting Office – Defense Commissary Agency, IT Contracting Branch, Fort Lee, VA
2. Type of Contract Action – This is a new FY16 Brand Name firm, fixed-price delivery order using Defense Working Capital Funds (DWCF) and Surcharge Funds.
3. Description of Supplies/Services –Oracle Database Enterprise Edition – Processor and Active Data Guard – Processor licenses and related maintenance. The maintenance will include a base year plus four one-year option periods. The base year cost of licenses and maintenance is estimated at ; the total cost of the acquisition (including options) is expected to be
4. Authority Cited - FAR 8.405-6(a)(1)(i)(C), Logical Follow-On
5. Reason for Authority Cited – DeCA manages commissary operations worldwide for the Defense Department. This includes the Headquarters, region offices, and approximately 250 commissaries worldwide. The agency currently uses Oracle brand name products which meet security configuration requirements in accordance with Defense Information Systems Agency (DISA) security technical implementation guidelines (STIGs) for enterprise-wide business systems to support DeCA’s mission.
As a result of previous requirements, Oracle software and tools have been extensively implemented throughout the agency. Oracle server and client applications have proven to be a reliable and integral part of the DeCA’s Information Technology infrastructure. Oracle software and tools support data base transactions within DeCA’s business systems, communicate critical information to the many existing databases, and provide the ability to communicate with many other DeCA applications.
The intent of this contract action is to provide supplemental support for a system in which DeCA is highly invested. DeCA currently has an active FY’13 contract (HQC007-13-F-0003, DLT Solutions) valued at $3.9M for which more licenses and maintenance support is required. In lieu of increasing the scope of the current contract, it was determined that a logical follow-on contract be put into place to satisfy this requirement and allow additional contractual opportunities to resellers of brand-name Oracle products. This acquisition is a logical follow-on to previous order HQC007-12-F-0009. The previous order included both new licenses and renewal maintenance and cited a brand-name justification.
Re-competing DeCA’s agency-wide database software requirement to replace current Oracle brand software was found to not be in the Government’s best interest. These additional cost burdens would include: acquiring additional expertise to manage other database software products, re-writing interfaces of existing business systems to exchange information with existing Oracle databases, major learning curves for both Government personnel and contractors to learn the development, operation, management, and use of other database software. This burden would also result in major delays to key DeCA business system enhancements due to additional contract actions to acquire expertise. Oracle software is proprietary; only Oracle Corporation and certified resellers are valid solutions. Oracle products have no negative impact on DeCA, its mission, any existing application or business system in the agency.
It is for the reasons stated above, and in accordance with FAR 8.405-6, that DeCA intends to limit competition for this requirement.
6. Efforts to Obtain Competition – The solicitation shall be posted to GSA eBuy; however, IAW DFARS 208.7402, only DoD ESI BPA holders will be considered for award.
7. Fair and Reasonable Cost Determination – Cost will be determined fair and reasonable prior to award.
8. Market Research and Interested Sources – Market research was conducted utilizing Department of Defense (DoD) multiple award contract vehicles and other Government-wide Acquisition Contracts (GWACS). Market research also included gathering data from several vendors’ websites and previous acquisitions. The market research revealed that DLT Solutions, LLC is capable of supplying this requirement and is a DoD ESI BPA holder. Additional vendors capable of supplying this requirement through a DoD ESI BPA are Affigent LLC, Mythics Inc., and Immix Group.
9. Actions to Increase/Foster Competition – DeCA continues to perform market research for products that are available through resellers and Oracle Certified Partners, that are able to maintain and support the implementation of security controls to protect sensitive information and address regulatory requirements for government data. DeCA continually communicates and works with other DoD agencies, its business partners, and attends trade and industry shows, in an effort to stay abreast of this evolving technology. As legislation and regulatory changes mandated by DoD change and influence the DoD department’s information technology requirements, the commercial market place’s ability to stay abreast of those changes and provide viable solutions will also change.
10. Other Factors –DeCA currently maintains the same or similar Oracle products on order HQC007-13-F-0003 with DLT Solutions.
