ENCLOSURE 1

QUESTION 1:

The solicitation states that SaaS vendors will need to be FedRAMP certified. Does the FedRAMP certification requirement apply to vendors with a Platform as a Service (PaaS) model?

ANSWER 1:

Vendors do not need to be FedRAMP certified. No.

QUESTION 2:

Will DeCA consider vendors that take exception to specific security requirements, such as FedRAMP certification and varying encryption standards? With respect to the estimated volume of deliveries, we may not be able to custom-fit requirements.

ANSWER 2:

Vendors do not need to be FedRAMP certified. The Contractor shall demonstrate compliance with DFARS clauses 252.204-7012 and 252.204-7020 and annually validate with the DeCA ITT Office for compliance at a minimum. The Contractor shall provide to the DeCA ITT Office the CSO/CSP tenant data flows/logs to support log reviews by the agency's Cybersecurity Service Provider (CSSP).

The Contractor shall implement required Cybersecurity Supply Chain Risk Management (C- SCRM) security controls. The Contractor shall safeguard all data in accordance with security controls that meet or exceed current International Organization for Standardization (ISO) 27001 or Service Organization Control (SOC) 2 requirements.

QUESTION 3:

Will DeCA consider vendors that take exception to cold-chain requirements?

ANSWER 3:

No. Contractor shall maintain “cold chain” (chill and freeze) temperatures for all delivered foods requiring cold chain temperature control.

QUESTION 4:

In relation to Service Contract Labor Standards (FAR 52.222-41), can DeCA confirm that vendors can elect to state these do not apply?

ANSWER 4:

Vendors are required to comply with all relevant labor standards as expressed in federal statutes such as the Service Contract Act and associated federal regulations promulgated and enforced by the United States Department of Labor.

QUESTION 5:

For clarification, according to the referenced sections there are three distinct types of pricing that combined make up the Total Proposal Pricing: 1) Delivery Fee pricing which is inputted into the spreadsheets for Mandatory and Optional Locations. This is required pricing and must be completed. 2) A Government Supplemental Payment. This is an optional amount proposed by the Offeror including the triggering method to earn it. The Offeror can make this a requirement of their proposal up to the Maximum Supplemental Payment amount. 3) Amounts due for any Additional and or Alternative Capabilities proposed by the Offeror. These Additional and or Alternative Capabilities along with their corresponding amounts may be included or excluded in the award by DeCA. Is this understanding, correct?

ANSWER 5:

(1) Yes. (2) Offerors may propose an annual Government Supplemental Payment along with associated triggering method, in order to achieve the government requirements for delivery fees to be paid by authorized patrons. (3) Offerors may identify Additional or Alternative Capabilities, along with associated pricing. However, amounts associated with Additional or Alternative Capabilities will not be assessed as part of the government’s evaluation of the pricing factor.

QUESTION 6:

The first paragraph states "Based on the government’s market research, any proposed delivery fee in excess of $10 for a delivery radius not to exceed 10 miles may be deemed unreasonable."

Is the "Delivery Fee" mentioned here the same as the Delivery Fee the customer will see at checkout when ordering Commissary Delivery from their specific location for up to 10 miles?

ANSWER 6:

Yes.

QUESTION 7:

The first paragraph states "Based on the government’s market research, any proposed delivery fee in excess of $10 for a delivery radius not to exceed 10 miles may be deemed unreasonable."

Is the "Delivery Fee" mentioned here the same as the Delivery Fee the customer will see at checkout when ordering Commissary Delivery from their specific location for up to 10 miles?

Regarding this $10 "Government Objective", is it inclusive or exclusive of any Government Supplemental Amounts or Additional and or Alternative Capabilities amounts?

ANSWER 7:

Authorized commissary patrons will see the delivery fee at checkout, but will not see or be responsible for paying the Government Supplemental Payment. A proposal submission may include a request for a “Government Supplemental Payment” necessary to achieve the government’s requirement that authorized commissary patrons will pay no more than a $10 fee for deliveries within 10 miles.

QUESTION 8:

The first paragraph states "Based on the government’s market research, any proposed delivery fee in excess of $10 for a delivery radius not to exceed 10 miles may be deemed unreasonable."

Is the "Delivery Fee" mentioned here the same as the Delivery Fee the customer will see at checkout when ordering Commissary Delivery from their specific location for up to 10 miles? In essence, does this $10 per delivery objective only apply to the Delivery Fee customers see at checkout?

ANSWER 8:

See answer to QUESTION 7.

QUESTION 9:

Government Supplemental Payments (GSP). For these Supplemental Payments it states "The Offeror’s proposed amounts may be incorporated into the contract and will bind the awardee pursuant to the terms of the clause." If the Offeror proposes a GSP and is awarded the contract, does the government have the option to exclude the GSP from the contract or is the Offeror able to ensure the GSP is an integral part of the total pricing proposed?

ANSWER 9:

If the contract award includes pricing that includes a “Government Supplemental Payment,” in accordance with a proposal from successful offeror, then the government and the contractor are obligated to those terms under the contract.

QUESTION 10:

Government Supplemental Payments (GSP). For these Supplemental Payments it states "The Offeror’s proposed amounts may be incorporated into the contract and will bind the awardee pursuant to the terms of the clause." When the Offeror wants to integrate a specific capability / earning mechanism, what is the government's guidance when deciding whether that item should be placed under the Government Supplemental Payment category or under the Additional and or Alternative Capability category?

ANSWER 10:

The successful Offeror’s Government Supplemental Payment and triggering method will be incorporated into the contract, which will bind the government and the contractor under the terms of the contract. Similarly, if the government elects to use proposed Additional or Alternative Capabilities as proposed by a successful offeror, contract language will include any additional capability and associated price. Additional and Alternative Capabilities will be evaluated as part of the Technical Capability factor.

QUESTION 11:

How will the government calculate the Total Proposal Pricing? For example, the Delivery Fee pricing is explained in the solicitation and can be calculated on a per delivery basis or a total cost based on estimated deliveries per day shown in the spreadsheet. Are GSPs and Additional and or Alternative Capability amounts calculated by adding up the potential amount using the same delivery volume estimates and simply added together with the Delivery Fee amounts?

ANSWER 11:

Pricing will be evaluated based on total delivery fees provided, plus the addition of the “Governmental Supplemental Payment”. The GSP will not be allocated among individual delivery fees for purposes of proposal evaluation.

QUESTION 12:

Is there currently a "Maximum Supplemental Payment" amount and if so what is it?

ANSWER 12:

The request for proposals does not identify a maximum Government Supplemental Payment;

however, fairness of pricing will be considered in the context of retail grocery delivery.

QUESTION 13:

It states "Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). The text states "...the Government may provide a supplemental payment to the Contractor up to the negotiated Government’s Maximum Supplemental Payment amounts by contract year." and "If the Government’s Maximum Supplemental Payment is reached for a given contract year, the Contractor will no longer receive the Supplemental Payment for subsequent deliveries in that contract year and agrees to receive only the delivery fees listed in Enclosure A...". If this amount is to be negotiated when do these negotiations occur?

ANSWER 13:

Offerors should submit proposals based on fair market pricing for grocery delivery in relevant regions based on information that was provided in the solicitation packet, which includes:

anticipated average orders per day, store hours, and store locations. A submission may include a request for a “Government Supplement Payment” necessary to achieve the government’s requirement that authorized commissary patrons will pay no more than a $10 fee for deliveries within 10 miles.

QUESTION 14:

It states "Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). The text states "...the Government may provide a supplemental payment to the Contractor up to the negotiated

Government’s Maximum Supplemental Payment amounts by contract year." and "If the Government’s Maximum Supplemental Payment is reached for a given contract year, the Contractor will no longer receive the Supplemental Payment for subsequent deliveries in that contract year and agrees to receive only the delivery fees listed in Enclosure A...". If this amount is not specified by the government before proposal submission how can an Offeror estimate the total amount of payment they will be eligible to receive and when those payments may "run out" during a specific year?

ANSWER 14:

Pricing in contract award will include, if applicable, an annual Government Supplemental Payment for the contract period, expressed as a bi-weekly payment to the contractor, once a contractor has invoiced for the annual Government Supplemental Payment as identified in the contract, then the contractor will not be entitled to further Government Supplemental Payment (GSP) until the following contract year.

QUESTION 15:

Can the Offeror propose multiple Government Supplemental Payments and or multiple Additional and or Alternative Capabilities amounts? Or is the government's intention to have just one Government Supplemental Payment and or just one Alternative Capabilities amount?

ANSWER 15:

Offerors shall submit no more than one Government Supplemental Payment. If a successful offeror identifies “Additional or Alternative Capabilities (one or more than one) that the government elects to purchase, the government and the offeror will negotiate a fair and reasonable amount to reflect such additional or alternative capabilities that will be incorporated into the contract award. The government will not consider amounts or potential amounts associated with “Additional or Alternative Capabilities” as part of the evaluation of the price factor.

QUESTION 16:

The solicitation does not incorporate an incentive fee (supplemental) FAR or DFAR Clause. Will the government please provide the FAR clause that will applied for the supplemental payments?

ANSWER 16:

The successful Offeror’s Government Supplemental Payment and triggering method will be incorporated into the contract, and the government and the contractor will be bound by that clause under the terms of the contract. There is not a standard FAR clause for this provision.

QUESTION 17:

Upon reviewing the statement of work, I understand you need deliveries for the West locations.

Just so I'm clear, I need to provide drivers for each West location? Will we need to make deliveries multiply times a day?

ANSWER 17:

Deliveries vary based on location. Information on anticipated deliveries at each location is provided in the request for proposals.

QUESTION 18:

When completing the online shopping portal, I assume the order is pre-paid for correct? Or am I coming out of pocket?

ANSWER 18:

Authorized commissary patrons pay the government a lump sum total at the time of order submission that includes the prices of the ordered items, surcharge (required by DeCA’s statutes), delivery fee, and delivery tip (if the patron chooses to pay a tip) at the time the order is submitted. The amount paid by the patron is processed through the government’s payment system, and the delivery contractor is paid accumulated delivery fees and tips on a biweekly basis, upon required invoicing.

SUMMARY OF CHANGES

SECTION SF 1449 - CONTINUATION SHEET

The following have been added by full text:

52.212-2 AMEND 4

52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES

(NOV 2021) AMENDMENT 0004

(a) The Government will award one contract resulting from this solicitation that represents the Best Value to the Government using a Trade-Off evaluation using the following evaluation factors and weighting:

Factor 1 – Technical Capability Subfactor 1 – Delivery Radius

Subfactor 2 – CLICK2GO Integration/ Data Security Subfactor 3 – Management Subfactor 4 – Staffing Subfactor 5 – Additional and or Alternative Capabilities Factor 2 – Past Performance Factor 3 – Price

The Technical Capability Factor and the Past Performance Factor are of equal importance. Each Subfactor within the Technical Capability factor is of equal importance. The government will provide adjectival ratings only at the factor level. The non-price factors, when combined, are more important than the Price Factor.

Factor 1 – Technical Capability - VOLUME 1:

The Technical Capability factor includes five Subfactors: delivery radius, CLICK2GO integration, management, staffing, and additional and or alternative capabilities. The Government will evaluate the Offeror’s technical proposal and issue one combined technical and risk rating at the factor level in accordance with the definitions herein. The Government reserves the right to incorporate any portion of an Offeror’s proposal in to the resultant contract.

Subfactor 1 – Delivery Radius: The government will evaluate the offeror’s proposed delivery radius(es). An offeror’s proposed delivery radius(es) of less than 10 miles from the originating commissary locations will not be evaluated as a deficiency; however, offerors are advised that the government may consider delivery radius(es) of at least 10 miles to be more advantageous to the government.

Subfactor 2 – CLICK2GO Integration/ Data Security: The government will evaluate the offeror’s plan to integrate with the agency’s eCommerce platform (Freshop) in the time required by the Performance Work Statement Amendment 0004. The government will evaluate the offeror’s plan pertaining to the timeline for the integration, including significant dates and actions occurring within that timeframe, as well as any risks to meeting the integration schedule. The government will evaluate documentation submitted demonstrating the likelihood of the offeror integrating within 45 days of contract award.

The government will evaluate the offerors plan for compliance with DFARS clauses 252.204-7012 and 252.204-7020 and validate compliance annually and determine if it is sufficient. The government will evaluate the offeror’s plan on how they will provide CSO/CSP tenant data flows/logs to support log reviews by the agency's Cybersecurity Service Provider (CSSP) to determine if is sufficient.

The government will evaluate the offeror’s Cybersecurity Supply Chain Risk Management (C-SCRM) security controls as well as evaluate the offeror’s plan to safeguard Personal Identifiable Information (PII) and data in accordance with security controls that meet or exceed current International Organization for Standardization (ISO) 27001 or Service Organization Control (SOC) 2 requirements and determine if it is sufficient.

Subfactor 3 – Management: The government will evaluate the offeror’s approach to managing the contract, to include: the offeror’s management techniques to manage the program schedule, performance, risks, subcontracts, and data throughout contract performance; the offeror’s approach to delivering orders from the time it receives an order until it delivers the order; the offeror’s process for providing consistent, timely delivery in accordance with industry standards; the offeror’s process for communicating to the store that an order has been delivered; and the offeror’s plan to maintain customer satisfaction.

Subfactor 4 – Staffing: The government will evaluate the offeror’s plan for staffing the contract, including the offeror’s plan to ensure delivery drivers receive and maintain installation access and any recruitment and retention plan.

Subfactor 5 – Additional and or Alternative Capabilities: The government will evaluate the Offeror’s proposal for any capabilities or solutions that are additional to, or take an alternate approach to meeting, the contract requirements and objectives. Failure to propose additional or alternative capabilities will not be evaluated as a Risk or Deficiency; however, an offeror may enhance its proposal by proposing Additional or Alternative capability. If an Offeror proposes such capabilities, the government will evaluate the proposed additional capability for Strengths, Significant Strengths, and Risk to the extent the proposed additional capability meets any of those definitions. Nothing in these evaluation instructions shall require the Government to assign a Strength, Significant Strength, or Risk to a proposed Additional or Alternative capability if the proposed capability does not meet the definitions herein for those findings.

The government will use a Combined Technical/Risk Rating methodology to evaluate the offeror’s Technical Capability proposal. The combined technical/risk rating includes consideration of risk in conjunction with the significant strengths, weaknesses, significant weaknesses, uncertainties, and deficiencies in determining technical ratings. Combined technical/risk evaluations shall utilize the combined technical/risk ratings listed in Table 1 Combined Technical/Risk Rating Method and the risk descriptions set forth in Table 2 Technical Risk Rating Method.

Table 1. Combined Technical/Risk Rating Method

Color Rating

Adjectival Rating

Description

Blue Outstanding

Proposal demonstrates an exceptional approach and understanding of the requirements and contains multiple strengths and/or at least one significant strength, and risk of unsuccessful performance is low.

Purple Good

Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength or significant strength, and risk of unsuccessful performance is low to moderate.

Green Acceptable Proposal meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.

Yellow Marginal Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.

Red Unacceptable Proposal does not meet requirements of the solicitation and, thus, contains one or more deficiencies and is unawardable, and/or risk of performance is unacceptably high.

Table 2. Technical Risk Rating Method

Adjectival

Description

Low

Proposal may contain weakness/weaknesses which have low potential to cause disruption of schedule or degradation of performance. Normal contractor emphasis and normal Government monitoring will likely be able to overcome any difficulties.

Moderate

Proposal contains a significant weakness or combination of weaknesses which may have a moderate potential to cause disruption of schedule or degradation of performance. Special contractor emphasis and close Government monitoring will likely be able to overcome any difficulties.

High

Proposal contains a significant weakness or combination of weaknesses which is likely to have high potential to cause significant disruption of schedule or degradation of performance. Special contractor emphasis and close Government monitoring will unlikely be able to overcome any difficulties.

Unacceptable Proposal contains a deficiency or a combination of significant weaknesses that causes an unacceptable level of risk of unsuccessful performance.

Definitions:

Significant Strength is an aspect of an Offeror’s proposal with appreciable merit or will exceed specified performance or capability requirements to the considerable advantage of the Government during contract performance.

Strength is an aspect of an offeror's proposal that has merit or exceeds specified performance or capability requirements in a way that will be advantageous to the Government during contract performance.

Weakness means a flaw in the proposal that increases the risk of unsuccessful contract performance.

Significant Weakness in the proposal is a flaw that appreciably increases the risk of unsuccessful contract performance.

Deficiency is a material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level.

Risk, as it pertains to evaluation of offers, is the potential for unsuccessful contract performance.

The consideration of risk assesses the degree to which an offeror’s proposed approach to achieving the technical factor may involve risk of disruption of schedule, degradation of performance, the need for increased Government oversight, and the likelihood of unsuccessful contract performance.

Factor 2 – Past Performance – VOLUME II:

The Government will evaluate the offeror’s proposed record of recent and relevant past performance to determine the Government’s confidence assessment in accordance with the definitions stated herein. A past performance record is recent if it the effort was performed within three years of the proposal due date. Any performance that falls outside of the three-year recency window will be deemed not recent and will not be evaluated. The Government reserves the right to evaluate past performance information known to the Government in addition to the information proposed by the Offeror. Table 3 Past Performance Relevancy Rating Method definitions shall be utilized to determine relevancy of each past performance record.

Table 3. Past Performance Relevancy Rating Method

Adjectival

Description

Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.

Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

Somewhat Relevant

Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.

Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

Performance Confidence Assessment. Evaluation shall be in accordance with the criteria established in the solicitation. Table 4 Performance Confidence Assessments Rating Method will be used to rate the offeror’s overall record of past performance. In the case of offerors for which there is no information on past contract performance or where past contract performance information is not available, the offeror may not be evaluated favorably or unfavorably on the factor of past contract performance (see FAR 15.305[a][2][iv]). In this case, the offeror’s past performance is unknown and assigned a performance confidence rating of “Neutral.”

Table 4. Performance Confidence Assessments Rating Method

Adjectival Rating Description

Substantial Confidence Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.

Satisfactory Confidence Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.

Neutral Confidence

No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.

The offeror may not be evaluated favorably or unfavorably on the factor of past performance.

Limited Confidence Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.

No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.

Factor 3 - Price – VOLUME III:

The Government will evaluate the offeror’s Price proposal to determine that the proposed amounts are reasonable. Pursuant to FAR 15.404-1(b), the Government anticipates determining price reasonableness based on adequate price competition; however, the Government reserves the right to consider other information and techniques to determine price reasonableness. Based on the government’s market research, any proposed delivery fee in excess of $10 for a delivery radius not to exceed 10 miles will be deemed unreasonable. The Government will evaluate separately priced line items within an Offeror’s price proposal for unbalanced pricing.

Unbalanced pricing exists where the prices of one or more-line items are significantly overstated or understated, despite an acceptable total price. Price includes the total delivery pricing plus the Government Supplemental Payment (GSP).

(a) Required Commissary Locations Price - Offerors may propose the same delivery fee price for each commissary location in the West Area or different delivery fee prices for different commissary locations within the West Area. If the offeror proposes the same delivery fee for each required commissary location within the West Area, the proposed delivery fee will also be the offeror’s evaluated price. If the offeror proposes different delivery fee prices for different locations within a proposed area, the government will calculate the average delivery fee price for all locations within the area and the average will be used as the offeror’s evaluated price. If the Offeror proposes additional amounts due to the Offeror’s Technical Capability, Subfactor 5 Additional and or Alternative Capabilities, the government will calculate an additional price inclusive of the additional capabilities using the same methodology. The government may make award to an Offeror at the applicable evaluated price either inclusive or exclusive of the additional capabilities consistent with the terms herein.

(b) Optional Commissary Locations Price - In addition to the aforementioned information, the government will evaluate the amounts the Offeror proposes for the optional commissary locations listed in Attachments A pursuant to the contract clause titled “Government Option to Expand Delivery Locations” If the offeror proposes the same delivery fee for each optional commissary location within the West Area, the proposed delivery fee will also be the offeror’s evaluated price for optional locations. If the offeror proposes different delivery fee prices for different optional locations within the West Area, the government will calculate the average delivery fee price for all optional locations within the West Area and the average will be used as the offeror’s evaluated price for optional locations.

(c) Government Supplemental Payment. In addition to the fees per delivery, the government will evaluate the Offeror’s proposed Government Supplemental Payment (GSP) and how the Offeror proposes to earn that amount. The Offeror’s proposed GSP will be incorporated into the contract.

(d) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(e) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the solicitation, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(f) This solicitation is for the procurement of commercial services pursuant to Federal Acquisition Regulation (FAR) Part 12, Acquisition of Commercial Products and Commercial Services. As such, the Government will evaluate proposals pursuant to FAR Subpart 12.6, Streamlined Procedures for Evaluation and Solicitation for Commercial Products and Commercial Services, in conjunction with FAR Part 15.

(16) PROPOSAL INSTRUCTIONS: Government Objective: DeCA is a component of the Department of Defense (DoD) reporting to the Under Secretary of Defense for Personnel and Readiness. DeCA operates a worldwide commissary system that provides quality grocery products at substantial savings to eligible patrons, including active-duty military personnel and retirees. DeCA’s mission is to deliver a vital benefit of the military pay system that sells grocery items at significant savings while enhancing quality of life and readiness. DeCA uses an EBS to support all of DeCA’s business operations (retail, back office, and support). This EBS system incorporates an application for DeCA’s online shopping portal (operated as “CLICK2GO®”). The DeCA ecommerce application has the capability to support ecommerce delivery services to provide additional access to the benefit to eligible patrons.

The intent is for DeCA to offer grocery delivery at 64 state-side locations to include Alaska and Hawaii as each Commissary’s CC2G business grows and provides sufficient metrics for the Doorstop Delivery program within the lifecycle of this contract. Based on Market Research, the government’s objective is for delivery within a 10-mile radius from the delivery pickup commissary location at a price per delivery not to exceed $10. Note that while the aforementioned metrics are government objectives, an Offeror is not required to propose this specific delivery radius or price and the government will evaluate any proposed delivery radius and price consistent with the evaluation criteria.
