52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Factor 1 - Technical Capability of the Service

Factor 2 – Price

Factor 3 - Past Performance

The technical capability evaluation factor will be rated on an acceptable and unacceptable basis. A quote will be rated as acceptable if the equipment meets general operating specifications and additional requirements. A quote will be rated as unacceptable if the equipment does not meet general operating specifications and additional requirements. Operating specifications and additional requirements are listed in the Performance Work Statement (PWS) (attachment 1).

The quoter’s price, the total price for all items, will be evaluated to determine whether it represents a fair market price in accordance with FAR 13.106-3(a).

Each quoter is required to submit their past performance references. Technical and past performance, when combined are the relative importance of all other evaluation factors, when compared to price. The evaluation of past performance will be an assessment based on a consideration of all relevant facts and circumstances. The Government is seeking to determine whether the quoter has consistently demonstrated a genuine concern for customer satisfaction, and timely delivery of goods. This determination is a matter of judgement.
