J&A No: 20-0024-01

Contract Number: HQ0860-23-C-6000 facilities or research teams capable of meeting the cost and schedule requirements to support this effort.

Pulsed laser testing and analysis from LLE for MDA will provide valuable data that no other MDA assets can currently support. LLE is the only vendor with the capability to meet all of the Government’s requirements.

8. Determination of Fair and Reasonable Cost (FAR Part 6.303-2(b) (7)).

The Contracting Officer will ensure the negotiated costs for the MDA/DVS contract are determined fair and reasonable before award. LLE’s catalog prices or basis of estimate (BOE) with supporting labor hours, skill mix, rates and factors. In accordance with FAR 15.403-4, Requiring Certified Cost or Pricing Data, certified cost or pricing data will be required for this effort. The Contracting Officer will make a fair and reasonable determination based on rates validated through the supporting Government agency and a government cost estimate (IGCE), program office technical evaluation, historical costs, and any other pertinent data available.

9. Any Other Facts Supporting the Use of Other Than Full and Open Competition (FAR Part 6.303-2(b)(9).

As part of the Stockpile Stewardship Program LLE has a five-fold mission: conduct implosion experiments and basic physics experiments in support of the National Inertial Confinement Fusion (ICF) program, develop new laser and materials technologies, provide graduate and undergraduate education in electro-optics, high-power lasers, high-energy density physics, plasma physics, and nuclear fusion technology, operate the National Laser Users' Facility, and conduct research and development in advanced technology related to high-energy-density phenomena. LLE is the only source able to satisfy these requirements, and in order for other sources to satisfy MDA’s requirements, new facilities and test set-up activities would be required, which would incur substantial duplication of costs and unacceptable delays

LLE is part of DOE’s Stockpile Stewardship Program and support the industrial base. LLE is an integral part of the MDA’s Advance Technology testing efforts. LLE laser facilities are key to continuing support of pulsed laser phenomenology research and development across a broad spectrum of Missile Defense research categories. Pulsed laser testing and analysis from LLE for the MDA will provide valuable data that no other MDA assets can currently support.

10. Actions Taken to Remove Barriers to Competition (FAR Part 6.303-2(b) (11)).

This J&A will enable direct support of the LLE facilities and phenomenology testing. All test planning, results, and analysis or modeling products delivered under this contract will have Government Purpose Rights (GPR) or Unlimited Rights unless prior written authorization is obtained from the Contracting Officer. MDA’s GPR data set, resulting from this acquisition, may support follow on work capable of being performed outside this facility. This would open up the competitive space for R&D of applied pulsed laser research for MDA requirements.

11. Technical/Requirements Official Certification (FAR Part 6.303-2(c)). “I certify that this justification for other than full and open competition is made in good faith and that the supporting data and information are accurate and complete to the best of my knowledge and belief. I further certify that this request is not the result of a lack of advance planning.”

12. Contracting Officer (FAR Part 6.303(b)(12)). “I have determined that the anticipated cost to the Government will be fair and reasonable and certify that the justification is accurate and complete to the best of my knowledge and ability.”

13. Legal Counsel. “I have reviewed the justification and determined it to be legally sufficient.”

14. Contracting Director (Program Level). “I have reviewed the justification and recommend it be approved.”

15. Approval (FAR Part 6.304). “In accordance with FAR Part 6.304, the above justification for other than full and open competition is hereby approved.”
