2. Contract for AFN360 AoIP App Development, Hosting, and Support

3. Background. Defense Media Activity (DMA) is responsible for the design, development and management of all public access digital communications platforms for the Department of Defense (DOD).

DMA provides comprehensive internal and external information to the entire

Department of Defense through all available media. DMA communicates messages and themes from the Secretary of Defense, Service Secretaries, and other DOD and US government services through the medium of print, the worldwide web, radio, and television in order to support and improve quality of life and morale, situational awareness, force protection, and to sustain readiness. The American Forces Network (AFN) provides U.S. radio and television news, information and entertainment programming to military service members, DOD civilians and their families overseas, and aboard U.S.

Navy ships. The effective implementation of the AFN360 multi-platform digital audio streaming mobile and web app will support the DMA and AFN mission by contributing to the fulfillment of several objectives and initiatives found in the DMA Performance Plan Strategic Goal 3: Enhance our support to

Joint Forces and DoD Components. The DMA Contracting Office has purchased services of a similar nature in the past.

4. Objectives: Defense Media Activity, American Forces Network requires the development, and subsequent hosting and technical support, of a modern, multiplatform, Audio over IP (AoIP) APP to efficiently and effectively engage its core demographics, which include US military and government service members, family members and military retirees living and working outside the continental United States (OCONUS). The app’s primary focus is to provide an engaging, user friendly audio experience comparable with commercial digital audio apps available in the U.S.

5. Scope. The scope of this contract is to provide the Government all necessary services and resources for the development and maintenance of a multiplatform AoIP application. The contract include this areas of multiplatform app development, hosting, push notifications, technical support and services, programming updates and maintenance, and access to user metrics, reports and analytics.

5.1. This work shall be performed in accordance and consistent with the objectives of this contract and Performance Work Statement (PWS).

5.2. The period of performance is one year, with four additional option years for hosting and technical support, for a total possible period of performance of five years.

5.3. The Contractor shall work in conjunction with the Government’s schedule to minimize disruptions and delays.

5.4. The Contractor is not responsible for providing content. The government will provide all content for the app either through the form of

RSS feeds the app consumes and displays, web views within the app or via text files given to the Contractor for use in native code of the application.

6. Performance Requirements.

6.1 Contractor shall provide a multiplatform AoIP app that meets the following capabilities:

6.1.1 Correlative multiplatform app available on iOS, Android, Microsoft, and Amazon devices, smart speakers, modern web browsers, smart TVs, and PlayStation and XBOX game consoles.

6.1.1.1 Proposal should provide for a tiered/ phased development and deployment schedule, and include itemized pricing options for each platform.

6.1.2 Shall support on-demand streaming, radio streaming, admin curated playlist streaming.

6.1.3 Shall provide capability for content search, and

recommendations based on user profile and preferences.

6.1.4 Shall support user registration.

6.1.5 Shall provide customized user profiles for sponsor & dependents, and provide for parental controls.

6.1.6 User interface shall provide for “favorites” and “recently played”.

6.1.7 Media player should contain no less than the standard media player controls.

6.1.8 Shall provide mechanism for push notifications.

6.1.9 Shall provide mechanism for targeted image/banner advertising.

6.1.10 Shall provide capability to display rich metadata, and “now playing” information.

6.1.11 Mobile app shall be accessible via hands-free/ voice assist.

6.1.12 Mobile app shall pause for phone call, navigation, or

notification.

6.1.13 Shall provide media CMS for simple display and layout

editing.

6.1.14 Shall provide mechanism to gather, organize and report user metrics and analytics.

6.1.15 Shall provide and/or support geo-blocking, and capabilities to whitelist specific IP addresses and/or ranges.

6.1.16 Shall provide capability for audience interaction services – polls, surveys, etc.

6.1.17 The app shall be section 508 compliant.

6.1.18 Shall meet DISA and DOD Cyber Security requirements for download and use on government devices.

6.1.18.1 Contractor shall ensure services provided are compliant with the

6.1.19 The Contractor shall participate in no less than three design reviews, preliminary, intermediate and final, with AFN and associated parties to ensure clear understanding of project requirements, expectations, risks, and timelines.

6.1.19.1 It is expected that status meetings and progress reviews will be conducted regularly and as needed.

6.2 APP Hosting

6.2.1 The Contractor shall provide for the mobile application to run, without compromise, on the two latest versions of the iOS and

Android operating systems.

6.2.2 The Contractor shall maintain the mobile application availability on popular marketplaces, to include Apple (iOS) and Google

(Android).

6.2.3 The app shall be a hybrid of content packaged into the app’s native code as well as content that is piped in from the web using both RSS feeds and web views of externally hosted html pages.

DMA will manage these push notifications via the Contractor provided/ developed CMS, or similar mechanism.

6.2.5 The app shall allow users to easily share the content they consume to various social media platforms including Facebook, Twitter, and Instagram.

6.2.6 The app shall be a responsive high performance mobile

application that delivers screen load times of sub 1 second.

6.2.7 The app will have a contemporary mobile application design that is professional in nature.

6.3 Support

6.3.1 The contractor will have personnel on-call to support the app.

Personnel will be utilized to diagnose and correct any application failures encountered during normal use. Personnel should be available to provide support with-in 2 hours of notification by

AFN support personnel of a failure. Contractor’s support personnel are required to remain engaged, and to assist the government until the failure is resolved.

Security Requirements.

Work performed in accordance with this performance work statement is UNCLASSIFIED with the possibility that the Contractor may have indirect or unintentional exposure to Controlled

Unclassified Information (CUI) while completing tasks associated with performance on this contract.

The following security requirements shall apply to this effort.

Should the successful offeror and DMA decide contractor personnel must visit DMA facilities for any purpose, DMA retains the right to request removal of contractor personnel regardless of prior clearance or adjudication status, whose actions, (while assigned to this contract) clearly conflict with the interest of the Government.

12.3 Information Security.

The Contractor shall immediately notify the COR upon discovery of any inadvertent or unauthorized disclosures of classified or sensitive information, data, documentary materials, records or equipment.

12.3.1 Sensitive Information Protection and Storage. Controlled Unclassified Information

(CUI) in its many forms, personally identifiable information (PII) of any type, as well as any otherwise sensitive data, and/or equipment will only be disclosed to authorized personnel on a need-to-know basis. The Contractor shall ensure that appropriate administrative, technical, and physical safeguards are established to ensure the security and confidentiality of this information, data, and/or equipment is properly protected. When no longer required, this information, data, and/or equipment will be returned to Government control, destroyed, or held until otherwise directed. The disposition of all data will be at the written direction of the COR. This may include documents returned to Government control; destroyed; or held as specified until otherwise directed. Items returned to the Government shall be hand-carried or sent by certified mail to the COR. It is anticipated that this information will be gathered, created, and stored within the primary work location. If contractor personnel must remove any information from the primary work area they should protect it to the same extent they would their proprietary data and/or company trade secrets. The use of any information that is subject to the Privacy Act will be utilized in full accordance with all rules of conduct as applicable to Privacy Act Information.

The government will retain unrestricted rights to government data. The ordering activity retains ownership of any user created/loaded data and applications hosted on vendor’s infrastructure, as well as maintains the right to request full copies of these at any time. The data that is processed and stored by the various applications within the network infrastructure may contain personally identifiable information (PII). This data and PII shall be protected against unauthorized access, disclosure or modification, theft, or destruction. The Contractor shall ensure that the facilities that house the network infrastructure are physically secure. No data shall be released by the

Contractor without the consent of the Government in writing. All requests for release must be submitted in writing to the COR/CO. All Contractor deliverables shall be marked, at a mailto:dma.meade.hqdma.list.security-office@mail.mil mailto:dma.meade.hqdma.list.security-office@mail.mil minimum, Controlled Unclassified Information or CUI unless otherwise directed by the

Government (see Reference N). The Contractor (and any sub-contractor) is required to abide by government and DMA guidance for protecting sensitive and proprietary information.

12.3.2 Protection of Information. The contractor shall be responsible for properly protecting all information used, gathered, or developed as a result of work under this contract. The Contractor shall also protect all Government data, equipment, etc. by treating the information as sensitive.

All information about the systems gathered or created under this contract should be considered as sensitive information. It is anticipated that this information will be gathered, created, and stored within the primary work location. If contractor personnel must remove any information from the primary work area they should protect it to the same extent they would their proprietary data and/or company trade secrets. The use of any information that is subject to the Privacy Act will be utilized in full accordance with all rules of conduct as applicable to Privacy Act Information.

12.3.4 The contractor shall not retain, use, sell, or disseminate copies of any deliverable that contains information covered by the Privacy Act of 1974, or that which is generally protected by the Freedom of Information Act.

12.3.5 In the event that it may become applicable, Contractor employees will be required to comply with all Government security regulations and requirements. Failure to comply with security requirements will be cause for removal and the contractor will not be able to provide service on this contract.

12.3.6 As may be applicable, the contractor shall not divulge any information about DoD or DoD files, data processing activities or functions, user identifications, passwords, or any other knowledge that may be gained, to anyone who is not authorized to have access to such information.

12.3.7 The Contractor shall afford the Government access to the Contractor’s facilities, installations, operations, documentation, databases and personnel used in performance of the contract. Access shall be provided to the extent required to carry out a program of IT inspection

(to include vulnerability testing), investigation and audit to safeguard against threats and hazards to the integrity, availability and confidentiality of data or to the function of information technology systems operated on behalf of DMA or DoD, and to preserve evidence of computer crime.

12.4 Miscellaneous Security Requirements.

12.4.1 Physical Security. Contractor personnel must comply with local security requirements for entry and exit control for personnel and property at the installation and DMA facilities, as may be applicable. The contractor shall observe and comply with the security provisions in effect at all DoD facilities. Identification shall be worn and prominently displayed as required.

12.4.2 Potential Operational Constraints. Force Protection Conditions (FPCONs) and Health

Protection Conditions (HPCONs) may affect access to the host installation. FPCONs and

HPCONs are established by the host installation or higher national command authorities. The

Installation Executive Director is responsible for implementing the proper response to progressive levels of terrorist and health threats. FPCONs and HPCONs are normally displayed at entrance gates, building entrances, and office entrances. The contractor shall adhere to and operate in accordance with any restrictions imposed as a result of a FPCON or HPCON.

Measures implemented under the various levels of threat may impact the contractor’s normal operational approach to services. The contractor shall ensure that services are sustained during heightened security measures.

12.4.3 Reporting Requirements. As may be applicable, the Contractor shall report to the

Security Directorate and/or COR any information or circumstances of which they are aware that may pose a threat to the security and/or safety of DoD personnel, contractor personnel, resources, and classified or unclassified defense information. Additionally, the contractor shall report any incident of sexual assault or sexual harassment involving any Contractor personnel.

12.4.4 Authorized Visitor Control. Contractor representatives on official business related to the contract shall have the visit coordinated by the COR to gain access to the installation access control. All planned visits shall be scheduled at least three (3) business days in advance. Once on-site, the representative shall obtain a visitor security badge from the Security Directorate and an appropriate escort will be provided to destination.

12.4.5 Temporary Removal of Personnel Posing an Imminent Threat. The DMA-HQ Chief, Security or designated representative, in consultation with the program manager, may remove any individual from duty who poses an imminent threat to himself or herself, safety of personnel, or Government resources. The Contractor will be notified as soon as possible of the action taken.

The temporary removal will last until the incident prompting removal has been resolved to the satisfaction of the Government. Once the incident has been resolved, the individual will either be allowed to return to work on the contract or prohibited from performance on the contract, as the

Government deems appropriate. Temporary removal of personnel does not relieve the contractor of any performance requirements.

1. All offerors shall submit via email, separate documents for the cost proposal, and the technical proposal and past performance (to satisfy Part III mentioned below). 2. Offerors shall confine their submissions to providing information in sufficient detail to define their proposal and to provide an adequate basis for evaluation. All written material in the proposals shall not exceed 50 pages. Part I documents do not impact the page limitation. Partial submissions will result in an unacceptable determination, disqualifying the proposal for an award. In evaluating an offeror’s submissions, the Government will consider how well the offeror complied with these instructions and will view any variance adversely. The Government evaluation team will not assume any information not provided. Material submitted by the offerors will not be returned.

3. Proposals shall be in three (3) separate parts and consist of the following items:

(a) Part I – Price Proposal – Solicitation, Offer and Award Document, SF 1449, and any amendments shall be completed by the Contractor. Part I shall also contain the completed FAR and DFARS clauses 52.212-3, “Offeror Representations and Certifications – Commercial Items” and 252.212-7000 “Offeror Representations and Certifications – Commercial Items”.

(b) Part II – Technical Proposal – Comprehension of the Performance Work Statement (PWS).

The technical portion of the proposal shall consist of narrative and supporting data that address

ALL requirements contained in the PWS. The proposal shall provide evidence that the offeror recognizes the scope of services that will be required under the proposed contract and the offeror’s method of performing these services. Technical responses should provide clear and detailed answers, and/or viable alternative solutions, to each requirement outlined in the

PWS. Merely stating comply to a requirement may result in an unfavorable rating.

(c) Part III - Past Performance Information: Offerors must provide recent (last 5 years) and relevant information on three (3) customers concerning contracts and subcontracts (including

Federal, State, and local government; and private) that demonstrate their ability to perform the proposed effort. Source selection teams may want to limit the information requested to a summary of the offeror’s performance for each contract or subcontract. The summary should include contract numbers, contract type, description and relevancy of the work, dollar value, and contract award and completion dates; and names, phone numbers, and e-mail addresses for references in contracting and technical areas.

4. EVALUATION (GO/NO GO): Proposals will initially be reviewed and evaluated to determine that they meet the government's minimum requirements (GO/NO GO factors). Offers that do not meet the minimum requirements will be excluded from further participation in the acquisition. The minimum requirements (GO/NO GO factors) are as follows:

A. The proposed solution provides a multiplatform AoIP app complete with all features, as detailed in the PWS.

B. The proposed solution meets the DISA and DOD Cyber Security requirements for download and use on government devices as described in the PWS.

C. The proposed solution seamlessly integrates with Triton Digital products and services.

D. The proposal provides for design reviews, commissioning, integration, acceptance testing, training, and support services that satisfy the requirements of the PWS. The vendors past performance response provides clear evidence of recent app development of similar size and scope to that of the American Forces Network where integrated streaming audio content comparable to what is detailed in the PWS have been successfully deployed and are currently in use.

52.212-2 Evaluation-Commercial Items. (Oct 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers and are listed in descending order of importance as follows:

Technical (System Functionality and Design), Past Performance, and

Cost/Price.

Technical (System Functionality and Design) and Past Performance, when combined, are significantly more important than Cost/Price.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the

Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

5. EVALUATION (FACTORS): Award will be made to the offeror who is deemed responsible in accordance with the Federal Acquisition Regulation (FAR), and whose proposal conforms to solicitation requirements and is judged, by an integrated assessment of the non-price evaluation factors and price listed below, to provide the “Best Value” to the Government, based on a Best

Value – Tradeoff Source Selection Process. In determining the "Best Value", offerors will be evaluated using the following three factors:

A. System Functionality and Design

The Government will do an analysis of the proposed system to ensure that at a minimum it meets or exceeds the PWS requirements for the design, functionality, testing, training, hosting, and support services for a modern multiplatform AoIP app. In rating this factor evaluators will consider the following elements:

1. Extent to which the proposed solution provides a multiplatform AoIP app, and meets the operational and design requirements as described in the PWS.

2. Extent to which the proposed solution provides capability to comply with DOD

Cybersecurity and DISA requirements for use on government devices and networks as described in the PWS.

3. Extent to which the proposed solution provides app hosting per the requirements detailed in the PWS.

4. Extent to which the proposed solution provides service and support per the requirements detailed in the PWS.

5. Extent to which the proposed solution provides an acceptable usage gathering and reporting system per the requirements detailed in the PWS.

6. Extent to which the proposed solution provides an acceptable mechanism for AFN admins to edit display and layout.

7. Extent to which the proposal demonstrates a proven ability to utilize emerging technologies.

8. Extent to which the proposal offers an online knowledge base.

B. Past Performance

1. The Government will review the Offeror’s three Past Performance submittals and score recent and relevant experiences as they relate to the Offeror successfully completing projects similar in nature to the system detailed in the PWS. Past performance experiences that are not within the past five years and relevant to this project will not receive consideration.

2. The Government will contact three of the offeror’s customers to ask them whether or not they believe

(a) that the offeror is capable, efficient, and effective;

(b) the offeror’s performance conformed to the terms and conditions of the contract;

(c) that the offeror was reasonable and cooperative and committed to customer service.

(d) the offeror has effectively supported emergency off-air conditions.

3. Past performance is one indicator of an offeror’s ability to successfully perform the contract. Past and current contract experience should be as closely related, or highly similar, to the current project as possible in size, complexity, and scope. The evaluation will include any relevant past performance to fulfill the requirements of the PWS. An offeror without a record of past performance or for whom information on past performance is not available will receive a neutral rating

4. In evaluating this factor, the Government will consider the following four elements:

a) Currency of the Information: Whether the Offeror’s examples occurred within in the past five years.

b) Relevance of the Information: Whether the Offeror’s examples provided evidence of successfully developing multiplatform AoIP applications as described in the PWS. and whether the Offerors examples were in use in a 24x7x365 Broadcast Radio environment like that of the AFN mission.

c) Source of the Information, to include the context of the data and

d) Trends in contractor’s performance.

C. Cost/Price

All prices will be evaluated for reasonableness and realism in meeting the requirements of the

PWS. In selecting the best overall proposal, the government will consider the value of each proposal in relationship to the proposed price. The importance of price as a factor in the selection will increase as the merit differences between proposals decrease.

The aggregate of the non-price factors are significantly more important than cost/price in this solicitation.

Offerers must be prepared to show a fair and reasonable price charged to government by comparing proposed price with price charged commercially for similar product/ service of a similar size, scope and complexity.

CONTRACT CLOSEOUT

CONTRACT/ORDER CLOSEOUT—FIXED-PRICE, TIME-AND-MATERIALS, OR

LABOR-HOURS

Timely contract closeout is a priority under this contract/order. The Contractor shall submit a final invoice within ninety (90) calendar days after the expiration of this contract/order, unless the Contractor requests and is granted an extension by the Contracting Officer, in writing. In addition, and concurrent with the submission of the final invoice, the Contractor shall notify the

Contracting Officer of the amount of excess funds that can be de-obligated from this contract/order so the closeout process can begin as soon as possible upon expiration of this contract/order. A bilateral contract/order closeout modification will be forwarded to the

Contractor by the Contracting Officer and must be signed by the Contractor and returned to the

Contracting Officer within thirty (30) calendar days of issuance of the modification. A

Contractor’s failure to respond and/or sign the bilateral closeout modification within thirty (30) calendar days of receipt will constitute approval of the terms of the modification and the modification will subsequently be processed unilaterally by the Contracting Officer to de-obligate excess funds and close this contract/order.

If this contract/order contains option periods, the Contractor is required to submit an invoice within ninety (90) calendar days after expiration of the base period of performance and the expiration of each exercised option period of performance to allow for deobligation of excess funds that were obligated in those respective periods of performance.

METHOD OF PAYMENT: Invoices for materials shall be submitted electronically through Wide Area Work

Flow (WAWF). The Government anticipates paying fully certified invoices on a Net 30 day basis. Payment of fully certified invoices for partial delivers of material is hereby authorized. Distribution of payment will be made by

Electronic Funds Transfer (EFT) to the contractors account. It is the responsibility of the contractor to review such accounts to ensure that payment has been reviewed.

SALES TAX EXEMPTION: The Contractor is hereby advised that the United States Government and Agencies are exempt from State and Local Government Tax by virtue of Article 6 of the United States Constitution. No exemption certificate is required.

The Contractor shall attach two (2) copies of a detailed packing list with each box or container with unlike items where the full description of the contents is not authorized or cannot be shown.

Include one (1) copy of the packing list inside the box or container and attach one (1) copy of the packing list on the outside of the box or container. The outside of the box or container must also include the complete shipping address as provided in the schedule and the

Contract/Purchase/Delivery Order number located on Page 1 of this document.

The packing list shall contain the following information:

(a) Contract number

(b) Package number and set number (if any) of the container.

(c) A list of the contents which shows the quantity by item, item description, part number, type and size, unit of issue if other than each.

(d) Each item including all components that makes up a KIT will be packaged AS A KIT and delivered complete.

(e) Containers must be arranged and identified for easy cross reference with contract line item numbers (CLIN) and durable for further reshipment

52.203-18 PROHIBITION ON CONTRACTING WITH ENTITIES THAT REQUIRE CERTAIN INTERNAL

CONFIDENTIALITY AGREEMENTS OR STATEMENTS--REPRESENTATION (JAN 2017)

(a) Definition. As used in this provision--

Internal confidentiality agreement or statement, subcontract, and subcontractor, are defined in the clause at 52.203-

19, Prohibition on Requiring Certain Internal Confidentiality Agreements or Statements.

(b) In accordance with section 743 of Division E, Title VII, of the Consolidated and Further Continuing

Appropriations Act, 2015 (Pub. L. 113-235) and its successor provisions in subsequent appropriations acts (and as extended in continuing resolutions), Government agencies are not permitted to use funds appropriated (or otherwise made available) for contracts with an entity that requires employees or subcontractors of such entity seeking to report waste, fraud, or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information.

(c) The prohibition in paragraph (b) of this provision does not contravene requirements applicable to Standard Form

312, (Classified Information Nondisclosure Agreement), Form 4414 (Sensitive Compartmented Information

Nondisclosure Agreement), or any other form issued by a Federal department or agency governing the nondisclosure of classified information.

(d) Representation. By submission of its offer, the Offeror represents that it will not require its employees or subcontractors to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting waste, fraud, or abuse related to the performance of a Government contract to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information (e.g., agency Office of the Inspector General).

52.203-19 PROHIBITION ON REQUIRING CERTAIN INTERNAL CONFIDENTIALITY AGREEMENTS OR

STATEMENTS (JAN 2017)

(a) Definitions. As used in this clause--

Internal confidentiality agreement or statement means a confidentiality agreement or any other written statement that the contractor requires any of its employees or subcontractors to sign regarding nondisclosure of contractor information, except that it does not include confidentiality agreements arising out of civil litigation or confidentiality agreements that contractor employees or subcontractors sign at the behest of a Federal agency.

Subcontract means any contract as defined in subpart 2.1 entered into by a subcontractor to furnish supplies or services for performance of a prime contract or a subcontract. It includes but is not limited to purchase orders, and changes and modifications to purchase orders.

Subcontractor means any supplier, distributor, vendor, or firm (including a consultant) that furnishes supplies or services to or for a prime contractor or another subcontractor.
