52.212-2 ADDENDUM
52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
ADDENDUM
AUTHORITY: This solicitation is entered into under the authority of 10 U.S.C. §4293 and the Federal Acquisition Regulation (FAR) subpart 12.1 Acquisition of Commercial Items and 13.303 Blanket Purchase Agreements – in conjunction with FAR Part 15—Contracting by Negotiation.
M1 Basis of Award
The Government intends to award a single-award, Blanket Purchase Agreement (BPA) resulting from this Request for Proposal (RFP) to the responsible Offeror whose offer, conforming to the solicitation, represents the best value determination by using the Tradeoff Process.
Pursuant to FAR 52.212-1(g), Instructions to Offerors – Commercial Items (MAR 2023), the Government may evaluate offers and award without discussions. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.
https://piee.eb.mil/
This procurement will be conducted in accordance with FAR 12, 13.3, and Section M of the solicitation. The Government will award a single BPA resulting from this solicitation, to the responsible offeror whose offer conforms to the solicitation and is the best value determination. Providing supplies, providing incidental services, accessibility of services, past performance and price considered. By submission of its offer, the offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified in the evaluation factors. Failure to meet a requirement of the solicitation may result in an offeror being determined unacceptable. The Government also reserves the right to award a contract based upon initial offers. The Government intends to award without dialog with offerors but reserves the right to open discussions with offerors if determined to be in the Government’s best interest. Offers that contain exceptions, qualifications or other conditions/deviations from the RFP’s terms shall not be considered or assessed and shall be deemed ineligible for award.
M2 Relative Importance of the Evaluation Factors
Factor 1 is the most important factor, Factor 2 is the second most important factor, and Factor 3 is the least important factor. Factor 1 Technical Plan and Factor 2 Past Performance when combined together are significantly more important than Factor 3 Price.
The Offeror will be evaluated under Factor 1 Technical Plan and provided an adjectival rating. The Offeror will receive a single rating under Factor 1 based on an integrated assessment of the Factor 1 Technical Plan. If an offeror receives an “Unacceptable” or “Marginal” rating in any sub-factor under Factor I (Technical Plan) or an overall “Unacceptable” or “Marginal” rating under Factor 1, the Offeror shall be ineligible for award and shall not be further evaluated. If an offeror receives a rating of “Acceptable,” or above, the Offeror will then be evaluated under Factor 2 Past Performance. If the Offeror receives a “No Confidence” rating under Factor 2 Past Performance, the offeror shall be ineligible for award and shall not be further considered. If the Offeror receives a rating greater than “No Confidence” under Factor 2, then the Offeror’s price shall be evaluated under Factor 3 Price.
M3 Evaluation Factors
Award Selection: Award Selection will be made in accordance with FAR Parts 12 and 13.3. In selecting the Best Value offer using the Tradeoff source selection process among Offerors deemed eligible for award, the following factors will be considered: Factor 1 Technical Plan, Factor 2 Past Performance, and Factor 3 Price.
An “Unacceptable” rating under Factor 1 or a “No Confidence” under Factor 2 Past Performance factor renders the entire proposal unacceptable and ineligible for award. The Government will cease evaluating a proposal after a single “Unacceptable” or “No Confidence” rating under any factor or sub-factor.
Technical Plan: Technical and sub-factors will be assigned a rating in accordance with the table below. A final, overall technical rating will be assigned based on the combined sub-factor ratings. All sub-factors under Factor I will be considered equally in determining the overall Factor I rating.
Adjectival Rating Description
Outstanding Quote indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.
Good Quote indicates a throrough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.
Acceptable Quote meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.
Marginal Quote has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.
Unacceptable Quote does not meet requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable.
Quote is unawardable.
Technical Plan Factor 1: Technical Plan will be evaluated as detailed below in section (a) through section (d):
a. The Offeror's method and approach for how it will deliver and perform the required technical aspects of the fitting of the Mobile Safety Shoes of this SOW at the levels expected in Parts 4 and 5.
b. Describe how your company plans to follow the measurement requirements.
c. The Offeror’s demonstration of its understanding of the fundamental standards of the supplies required and how they will adhere to this requirement. The Offeror’s understanding of the Berry Amendment as required by Title 10 United States Code [U.S.C.] §4862 and outlined in the Defense Federal Acquisition Regulation Supplement (DFARS) 225.7002 “Restrictions on food, clothing, fabrics, and hand or measuring tools” section and supplemental DFARS Procedures, Guidance, and Information (PGI) 225.7002-1 “Restrictions” along with clauses 252.225-7001 and 252.225-7012.
d. The Offeror’s proposed unique processes, resources, capabilities, skills and/or qualifications that clearly demonstrate the Offeror’s ability to meet or exceed the requirements of the SOW.
Past Performance Factor 2: Past Performance will be evaluated as detailed below in section (b) through section (f).
The Offeror’s past performance proposal must address corporate past performance in performing projects similar in size and scope to the effort required by the SOW. To be considered, all projects must be recent and relevant. To be recent, the projects referenced by the contractor must have been completed within two (2) years from the date of solicitation issuance or currently ongoing and have completed at least six
(6) months of performance by solicitation issuance. If currently ongoing, the extent of actual performance will be considered in determining the project’s relevance.
The Offeror's relevant Past Performance will be evaluated to assess the extent of its ability to perform the contract successfully (quality of product or service, accuracy and completeness, timeliness of delivery/work, business relations, customer satisfaction, key personnel and staffing, including subcontractors/partners). The evaluation may include additional information, not limited to, Government databases such as Past Performance Information Retrieval System (PPIRS).
The Offeror shall submit with its proposal completed Past Performance Data Sheet for up-to-three (3) total projects for the prime contractor and may also submit up-to-one (1) for each primary subcontractor.
The up to three total projects for the prime contractor and up to one each for each primary subcontractor can be for Government or commercial contracts for services directly related or similar to the services required in the SOW. To be considered relevant, the referenced project must, at a minimum, involve providing fitting of Safety Shoes to employees, both male and female, at a similar complexity to the solicited work (see SOW); and total contract value is a minimum of $10,000.00 for any federal or private projects. Past performance by subcontractors, predecessor companies or key personnel will be considered for the Offeror’s three total projects or each primary subcontractor project if recent and relevant provided the offeror describes how the subcontractor, predecessor company or key personnel significantly contributed to the referenced project and the subcontractor or key personnel will significantly contribute to the solicited work. A sufficient nexus between a predecessor company’s management and the offeror must also be established for a project performed by a predecessor company to be considered. The offeror shall address in Past Performance the following:
a. The nature of the effort
b. The tasks performed as they relate to Statement of Work
c. Timeliness
d. The extent of involvement (as a prime versus a subcontractor, predecessor company)
e. The period of performance
f. Point of contact, phone and email address for each contact listed
The Offeror shall complete the top portion of page 1, and send it to each of the customers. As stated in Past Performance Questionnaire (Attachment 2), the reference will complete this form and return it directly to the Government no later than the proposal due date and time. Past performance data must be received by proposal due date to be considered.
An Offeror without a record of relevant past performance or for whom information on past performance is not available will not be evaluated favorably or unfavorably on past performance (neutral evaluation).
The Government may consider past or current contracts (including Federal, State and local Government and private) for efforts similar to the Government requirement. The Government will consider information provided on problems encountered on the identified contracts and associated corrective actions. Contractors with a negative past performance rating based on received Past Performance Questionnaires will be afforded an opportunity to address alleged deficiencies. The Government may also consider information obtained from any other sources when evaluating past performance. Failure of a contractor to disclose a relevant Government contract with poor past performance may affect the contractor's past performance rating.
The Government may consider past performance information regarding subcontractors, predecessor companies with a sufficient management nexus to the offeror or key personnel as part of the Offeror’s maximum three project references if the subcontractor’s, predecessor company’s or key personnel’s performance is recent and relevant to work required under this solicitation and the subcontractor, predecessor company or key personnel made a significant contribution to the success of the referenced project and the subcontractor or key personnel will make a significant contribution to the Offeror’s performance of the solicited work.
Past Performance Evaluation: The past performance evaluation results in an assessment of the Offeror’s probability of meeting the solicitation requirements. The past performance evaluation considers each Offeror’s demonstrated recent and relevant record of performance in supplying services that meet the contract’s requirements. One performance confidence assessment rating is assigned for each offeror after evaluating the Offeror’s recent and relevant past performance, focusing on performance that is relevant to the contract requirements. Past performance information about the offeror as a prime contractor may be considered more significant and given more weight in the past performance evaluation than that of a subcontractor, predecessor company or key personnel.
There are two aspects to the past performance evaluation. The first is to evaluate the Offeror’s past performance to determine how relevant a recent effort accomplished by the offeror is to the solicited work. In establishing what is relevant for the acquisition, consideration should be given to those aspects of an Offeror’s past performance that would give the greatest ability to measure whether the offeror will satisfy the current procurement.
Past Performance Relevancy Ratings. In conducting a performance relevancy assessment, each offeror shall be assigned one of the following ratings:
Rating Description
Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.
Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
Somewhat Relevant
Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.
Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
The second aspect of the past performance evaluation is to determine how well the contractor performed on the recent/relevant contracts. The PPQs will be considered in the overall quality assessment for each referenced recent/relevant project. Other sources of information as outlined above may also be considered in the quality assessment. The combination of relevancy and quality of performance will be used to determine the overall performance confidence rating for the offeror.
Performance Confidence Assessment. In conducting a performance confidence assessment, each offeror shall be assigned one of the following ratings:
Rating Description
Substantial Confidence
Based on the Offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.
Satisfactory Confidence
Based on the Offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.
Neutral Confidence
No recent/relevant performance record is available or the Offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned. The offeror may not be evaluated favorably or unfavorably on the factor of past performance.
Limited Confidence

No Confidence Based on the Offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.
Offers that receive a ‘No Confidence’ past performance rating shall be deemed ineligible for award regardless of price or technical acceptability.
Factor 3: Price will be evaluated for reasonableness in accordance with FAR 12 and 13.3 utilizing techniques found in FAR 15.404. The reasonableness determination may be based on one or more of the price analysis techniques in FAR 15.404-1 including, but not limited to, comparison to the Independent Government Estimate (IGE), comparison to other offers, adequate price competition, or comparison to commercial/industry prices.
Pursuant to FAR 15.404-1(g), the Offeror’s price for each option or price line item shall be evaluated for unbalanced pricing. An Offeror’s proposal may be rejected or otherwise unfavorably evaluated if, despite a total price that is considered reasonable by the Government, the Offeror’s option prices or line item prices are unbalanced as defined in FAR 15.404-1(g) and pose a performance risk to the Government or a risk that result in the Government paying an unreasonably high price for all or part of the contractor’s performance.
The Offeror’s proposed approach must be consistent with the price proposal. The combined contract price will be considered the Offeror’s proposed price in response to this solicitation and will be evaluated for reasonableness.
For the purposes of price evaluation, the total evaluated price is the sum of the total prices submitted for
(a) the base period, (b) all option periods, and (c) the six-month extension authorized by FAR clause 52.217-8 for Attachment 1 Pricing Standard. For the purposes of determining the evaluated price for the six-month 52.217-8 extension, the total price is calculated as one-half of the total price of the final option year. Evaluation of options will not obligate the Government to exercise the option(s).
