JUSTIFICATION FOR LIMITED SOURCE JUSTIFICATION (LSJ)
UNDER FEDERAL ACQUISITION REGULATION SUBPART 8.4
1. AGENCY AND CONTRACTING ACTIVITY: The Department of Defense (DoD), Washington Headquarters Services (WHS), Acquisition Directorate (AD), Enterprise Research and Engineering Division (ERED), Technology Analysis and Services Branch
(TASB).
2. DESCRIPTION OF ACTION: Extension of services for contract HQ003419F0342 to the incumbent vendor, Jmark Services, to allow time for a competitive follow-on contract. The current contract is a Firm-Fixed Price (FFP) 8(a) contract, awarded under a General Services Administration (GSA) Federal Supply Schedule (FSS), with a base year and four option years, and including a six-month extension of services under Federal Acquisition Regulation (FAR) clause 52.217-8. The contract is currently in the six-month FAR 52.217-8 extension of services and the Period of Performance (PoP) ends December 31, 2024. The approval request is for a FFP four-month extension to April 30, 2025 plus a FFP two-month option taking the total PoP to June 30, 2025. The funding type will be FY2024 and FY2025 RDT&E.
3. DESCRIPTION OF SUPPLIES/SERVICES: This is a non-personal services contract to provide analytical, administrative, programmatic, and management support to the Office of the Assistant Secretary of Defense for Science and Technology (OASD(S&T)).
The OASD(S&T) are tasked with providing oversight and program management of science and technology (S&T) to solve current and future challenges for the Department of Defense (DoD). The OASD(S&T) requires management, program, and administrative support services to support its mission. Services provided are business and operations management, including security management support and administrative support. The support enables multiple significant and critical programs to include the S&T Security program and the Science, Mathematics, and Research for Transformation (SMART) Defense Education Program. The SMART Program is essential to determining the DoD’s efforts to formulate/define objectives based on future needs and a good understanding of applicable business systems and Defense requirements with regards to Science, Mathematics, and Research for Transformation. Support is also essential to strategic planning for the DoD Federally Funded Research and Development Centers
(FFRDC) and University Affiliated Research Centers (UARC) program, to include providing advice on ways to strengthen the department’s governance procedures for these important assets and the strategic relationship that the department has with its FFRDCs and UARCs.

4. CIRCUMSTANCES JUSTIFYING LIMITED SOURCES:
FAR 8.405-6(a)(1)(i)(C), In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed under the Federal Supply Schedule ordering procedures.
A follow-on six-month extension to contract HQ003419F0342, which was not issued under sole-source or limited-sources procedures, is the most economical and efficient way to receive these essential services.
5. BEST VALUE DETERMINATION: The Contracting Officer hereby determines this action represents the best value to the Government in that the services currently being performed by Jmark Services (Jmark) will be continued over with no changes to the current work scope or effort. Jmark’s pricing for the extension will be reviewed and analyzed for fairness and reasonableness, with comparison to the current pricing.
Jmark’s past performance has been rated Satisfactory or higher across all Contractor Performance Assessment Reporting System (CPARS) ratings going back to 2017, with many ratings of Exceptional. Jmark is qualified to perform the services given their experience, personnel, and past performance on this requirement. Until this requirement is competitively recompeted, an extension to Jmark is the most advantageous for this requirement for price and technical performance.
6. MARKET RESEARCH: Market research for the competitive 8(a) recompete shows a large pool of vendors who can potentially perform this work. The current contract was awarded competitively on GSA and the current market research shows on GSA Advantage there are over 500 8(a) vendors in NAICS code 541611 and GSA Oasis also offers a pool of 95 8(a) vendors in Pool 1, which includes NAICS code 541611. Market research also discovered opportunities to direct award to a tribal 8(a), however the recompete is planned to be competitive 8(a) using GSA.
7. OTHER SUPPORTING FACTS: WHS AD awarded contract HQ003419F0342 for this requirement in 2019, which was a recompete contract for work already in the 8(a) program. This requirement has a long history of being in the 8(a) program. Prior to the extension modification being issued, a Bridge Action Authorization and Approval was approved by the WHS AD Head of Contracting (HCA).
8. ACTIONS TO REMOVE OR OVERCOME ANY BARRIERS THAT LEAD TO
THE RESTRICTED CONSIDERATION BEFORE ANY SUBSEQUENT
ACQUISITION FOR THE SUPPLIES OR SERVICES IS MADE: The recompete action will remain in the 8(a) program and as such is planned to be a competitive 8(a) set-aside using a GSA FSS. Market research indicates multiple sources for the recompete are found under GSA multiple award schedules.
(a) Efforts to obtain competition: The Government is conducting market research to determine a competitive acquisition strategy. Multiple vendors were identified through market research that can provide the services, ensuring adequate competition, while staying in the 8(a) program.
(b) Actions to increase competition: The solicitation for the recompete will be posted on GSA E-Buy with opportunity for any 8(a) 541611 schedule holder to submit a proposal.
9. If this acquisition is for new work as a logical follow-on to on original FSS, was the original order was placed under the FSS ordering procedures?
