DEPARTMENT OF DEFENSE
WASHINGTON HEADQUARTERS SERVICES
1155 DEFENSE PENTAGON
WASHINGTON, DC 20301-1155
Control No. 2018-WHS-000X
SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES
FOR CERTAIN COMMERCIAL ITEMS
UNDER FEDERAL ACQUISITION REGULATION (FAR) 13.5
1. AGENCY AND CONTRACTING ACTIVITY:
Agency:
The United States of America Vietnam War Commemoration
Contracting Activity:
Department of Defense Washington Headquarters Services (WHS), Acquisition Directorate (AD)
2. DESCRIPTION OF ACTION:
WHS/AD proposes to issue a follow-on bridge contract to Analytic Services Inc. without using full and open competition to continue providing Administrative and Operational Support Services.
WHS/AD will execute a firm fixed price contract type. The proposed contract is a follow-on to Analytic Services Inc., task order, HQ0034-09-A-3004-0004 that was issued by WHS/AD. The current contract expires on 29 March 2018, and a new competitive acquisition will include the current services under the bridge contract to the new competitive award. The anticipated award date of the competitive award is scheduled for April 2018. Therefore, to prevent a lapse in Administrative and Operational support, a follow-on bridge is required while WHS/AD is working the competitive acquisition. The total estimated dollar value for this proposed bridge contract is approximately $293,154.00 (with a potential variance of +/-5%). The anticipated period of performance is for a one month base period with a one month option period in accordance with FAR 52.217-9, “Option to Extend the Term of the Contract. Therefore, the total period of performance is from 30 March 2018 to 29 May 2018.
3. DESCRIPTION OF SUPPLIES/SERVICES:
The overall objective of the required bridge contract is to continue to provide professional administrative and operational support services to accommodate and meet the goals of The United States of America Vietnam War Commemoration (VWC) mission. The contractor shall provide administrative and operational support services to include the following:
• Administrative Level I Support Services
WASHINGTON HEADQUARTERS SERVICES
• Administrative Level II Support Services
• Administrative Level III Support Services
• Administrative Level IV Support Service
• Audio Visual Support Services
This Justification and Approval seeks to award a follow-on bridge contract to Analytic Services Inc. to continue the same services under the current contract until a new competitive acquisition is awarded.
Performance Periods
Performance Period Dates Amount
Base Period March 30, 2018 – April 29, 2018 $ 149,642.00 Option Period I April 30, 2018 – May 29, 2018 $ 143,512.00 Base + All Options $ 293,154.00
4. AUTHORITY CITED: This action is authorized under the provisions of the Test
Program for Commercial Items (4202 of the Clinger-Cohen Act of 1996), as implemented in the procedures of Federal Acquisition Regulation (FAR) 13.501, for a logical follow-on contract.
5. REASON FOR AUTHORITY CITED:
a. Background information about the requirement; Congress under the provisions of the National Defense Authorization Act for Fiscal Year 2008, section 598, Public Law 110-181, authorized the Secretary of Defense to conduct a program, The United States of America Vietnam War Commemoration (hereafter referred to as “the Commemoration”). The Commemoration will plan and promote activities and ceremonies to achieve the following objectives: (1) To thank and honor Vietnam veterans, POW/MIA’s, and families of these veterans, for their service and sacrifice on behalf of the United States; (2) To highlight the service of the Armed Forces during the Vietnam War and the contributions of Federal agencies and governmental and non-governmental organizations that served with, or in support of, the Armed Forces; (3) To pay tribute to the contributions made on the home front by the people of the United States during the Vietnam War; (4) To recognize the contributions and sacrifices made by the allies of the United States during the Vietnam War; (5) To highlight the advances in technology, science, and medicine related to military research conducted during the Vietnam War. The incumbent contract was awarded to Analytic Services Inc.
to provide Administrative and Operational Support Services for The United States of America Vietnam War Commemoration (VWC).
WASHINGTON HEADQUARTERS SERVICES
b. Details covering what events lead to the situation requiring use of other than full and open competition procedures; The period of performance under the current contract ends on March 28, 2018. The solicitation for the recompeted contract ended on March 15, 2018. The resulting lapse in service would be unacceptable, as it would cause delays in the VWC mission. The Contractor shall be directly responsible for ensuring the accuracy, timeliness and completion of all tasks under this effort. Without this service, multiple programs and initiatives will be left without support. The need for uninterrupted service is vital for continuing day-to-day operations.
c. Why considered alternatives will not work; Any alternative other than awarding a follow on bridge contract to Analytic Services Inc. would create a gap in service. The incumbent is the only source able to perform the services immediately without interruption. The current contractor has the experience and personnel available to perform without requiring a phase-in period to learn the specific processes and procedures unique to the VWC. Any delay will hinder mission performance.
d. Which authority applies and why; FAR Part 13.501, Special Documentation
Requirements applies to this acquisition because the anticipated award amount exceeds the simplified acquisition threshold, but does not exceed $7 million, and the contracting officer expects, based on the nature of the services sought and the market research that the proposal provided by Analytic Services Inc. will only include commercial items.
e. Explain the impact to the mission that would result if the Justification and
Approval is not approved and, consequently, the product or service not provided; If the Justification and Approval is not approved the current services being provided by the current vendor will be in jeopardy of ending after 29 March 2018 resulting in a gap in service until a new contract is awarded which will then lead to a new vendor having to get up to speed on the VWC without any kind of transition and provide support during one of the busiest seasons leading up to National Veterans Day.
6. EFFORTS TO OBTAIN COMPETITION:
On 1 March, 2018, Washington Headquarters Services issued a “Notice of Intent to Sole Source” on Federal Business Opportunities (FBO). The Notice of Intent was posted for ten days and closed on 11 March 2018. Based on the Notice of Intent, no vendors challenged the bridge contract to Analytic Services Inc. As previously mentioned, the
WASHINGTON HEADQUARTERS SERVICES
Government will be competing a competitive acquisition that is scheduled for award in April 2018.
7. FAIR AND REASONABLE COST DETERMINATION:
The Contracting Officer determines that the anticipated prices will be fair and reasonable by using the techniques identified at FAR 15.404-1-“Proposal Analysis Techniques.” to ensure award will be at fair and reasonable prices. Certified Cost and Pricing Data will not be obtained.
8. MARKET RESEARCH:
Market research has been limited to the pre-solicitation notice described above as this is an extension of the requirement. for ten days seeking potential sources. No vendors challenged this bridge effort.
WHS/AD will solicit this effort as a follow-on bridge contract in order to maintain continuity of support for all of the VWC’s administrative and operational support services. The bridge contract will be issued as the most logical and cost effective strategy and solution to the Government which will avoid unacceptable delays in fulfilling the agency’s requirement and a potential gap in performance of critical services while a competitive acquisition is taken place.
9. ANY OTHER FACTS SUPPORTING THE USE OF SOLE SOURCE: None
10. INTERESTED SOURCES:
No other sources have challenged the Notice of Intent to issue the sole source contract.
11. ACTIONS TO INCREASE COMPETITION:
A competitive acquisition is currently being conducted by the Government, and the anticipated award date for the new contract is anticipated to be executed in April 2018.
12. Is this acquisition for a non-competitive follow-on acquisition previously awarded on a non-competitive basis?
