LIMITED SOURCES JUSTIFICATION (FAR 8.405-6)

Justification

The acquisition referenced herein is conducted under the authority of the Multiple Award Schedule Program.

I. Contracting Activity:

Washington Headquarters Services/Acquisition & Directorate (WHS/AD) 1155 Defense Pentagon Washington, DC 20301-1155

Requiring Activity:

Office of the Under Secretary of Defense for Policy (OUSD(P))

II. Description of Action for Approval

WHS/AD proposes to issue a follow-on bridge contract without using full and open competition on an effort entitled “2282 Assessment”. The anticipated period of performance will be a three-month base period and three one-month option periods, which will account for 29 March 2017 to 28 September 2017. The government has a need for a follow on contract to the current vendor for continued support for up to six-months without a break in services to allow enough time to re-compete the current contract which will expire under the FAR Clause 52-217-8 on 28 March 2017.

III. Description of Services

Section 2282 of Title X, United States Code (formerly Section 1206 of the FY 2006 National Defense Authorization Act (NDAA), as amended) provides the Secretary of Defense, with the concurrence of the Secretary of State, the authority to train and equip foreign military forces, foreign maritime or border security forces, and foreign security forces to improve their capacity to conduct counter-terrorism operations and allied or coalition military or stability operations that benefit the national security interests of the United States. Since the initial investment of $100 million in FY 2006, then-Section 1206 has provided over $1 billion to approximately 60 countries in a total of 100 separate programs. The current authorized ceiling for FY 2015 is $350 million plus additional proposal amounts submitted in support of the Counterterrorism Partnership Fund (CTPF). Section 2282 authority is executed in coordination with the Department of State, Combatant Commands, and Chiefs of Mission, which presents a challenge to ensure consistent and feasible programs that support both recipient nation goals and U.S.

national interests.

OSD-SOLIC&IC/SOCT, as the executive agent, provides policy oversight for Section 2282 programs. OSD-SOLIC&IC/SOCT must continue a contract to develop and implement a means to assess the effectiveness of the investments in the recipient nations’ military establishments. The process must integrate qualitative and quantitative performance-related data in order to form a basis for assessing outputs and measuring progress toward reaching the desired outcomes and end states to improve capabilities of military and maritime security forces of the recipient nations. The objective of this program is to develop and validate a Section 2282 assessment process and assess selected programs.

Estimated value for the six (6) month bridge: $685,194.60.

Period of Performance: 29 March 2017 until 28 September 2017

IV. Statutory Authority and Rationale for Authority Cited:

FAR 8.405-6(a)(1)(i)(A) An urgent and compelling need exists, and following the procedures would result in unacceptable delays.

This requirement was originally procured as an unrestricted competition on the Federal Supply Schedule. In December 2016, WHS/AD was notified that this requirement had additional assessments that required completion after the period of performance would end. Therefore, the Contracting Officer determined that the best approach to the procurement of these services would be to issue a follow on bridge contract utilizing FAR 8.405-6(a)(1)(i)(A). Due to the continuing resolution (CR), WHS/AD was unable to compete the old requirement given the magnatude of the new scope of the upcoming requirement, budget, and time constraints. Therefore, a folow on bridge is necessary while a recompete occurs to avoid a break in services.

SAIC is the only company that can fulfill the need in the timeframe required, because as the incumbent contractor for this specialized effort, they are already familiar with the nuances of the requirement. Due to the specialized nature of the program, it would not be cost or time effective to resolicit and contract with a new contractor for the specified time period.

OUSD Policy support will be severely compromised if there is a break in service, therefore continuation of this contract is necessary. A new contract is being put in place, and this would bridge the gap between this contract and the new one.

V. Best Value Determination and Price Reasonableness.

The cost to the Government will be determined to be fair and reasonable in accordance with FAR 15.404 in making a fair and reasonable determination, the Government will utilize historical pricing from recent requirements for the same effort. Further, the Government will conduct a full price analysis by comparing the received cost to its independent Government cost estimate (IGCE), which was developed through sound market research and historical data, prior to award.

VI. Market Research Due to the urgency of this proposed Contract, market research has been limited to the pre-solicitation notice described above. Additionally, there is not enough time to conduct a thorough competitive procurement, source selection and contract award prior to the 28 March 2017 end date of the current contract, as such, a follow-on bridge award to SAIC is necessary. A gap in coverage will have a direct, deleterious effect on the ability of senior decision-makers to evaluate security strategic issues. Therefore, a bridge contract will be issued to allow time for a competitive procurement to be conducted for the continuing requirement.

VII. Actions to Increase Competition This Limited Sources Justification will be posted to Federal Business Opportunities (www.fbo.gov). Upon completion of this follow-on bridge effort, competitively established procurement will be against the Washington Headquarters Services Acquistion Directorate TEAMS BPA.
