WASHINGTON, DC 20301-1155

ACQUISITION DIRECTORATE

September 21st, 2016

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION:

BRAND NAME AND SDVOSB SOLE SOURCE JUSTIFICATION

1. AGENCY AND CONTRACTING ACTIVITY:

Requiring Agency:

Department of Defense (DoD)

Rock Raven Mountain Complex (RRMC)

114th Signal (Sg) Battalion (Bn), 21st Sig Bde

Fort Detrick, MD 21702

Contracting Activity:

Department of Defense (DoD)

Washington Headquarters Services (WHS) / Acquisition Directorate (AD)

1225 South Clark Street, Suite 1202

Arlington, VA 22202

2. NATURE/DESCRIPTION OF ACTION(S):

This action requests the approval of a Brand Name Justification (BNJ) for the procurement of additional Cisco UC Telepresence Non-Classified Internet Protocol Router Network (NIPR) and Secret Internet Protocol Router Network (SIPR) core network appliances to be added to the primary Raven Rock Mountain Complex (RRMC) Video-Teleconference (VTC) systems configuration.

WHS/AD proposes to issue a competitive purchase order, utilizing a firm-fixed price (FFP) contract type, for Cisco UC Telepresence devices and software, and associated installation.

Delivery of the needed supplies will be within sixty (60) days of contract award and installation will begin once all necessary supplies are available and should take up to ninety (90) days to begin installation.

3. DESCRIPTION OF SUPPLIES/SERVICES:

The RRMC, 114th Signal Battalion (114th) is looking to provide resiliency and redundancy to its existing Cisco UC Telepresence NIPR and SIPR core network systems providing continuity of operations (COOP) mission service support to multiple mission partner agencies within RRMC.

This effort will require additional VCS-Controllers, VCS-Expressways, MCU’s and Supervisor cards to be incorporated into its existing systems in a clustered fashion. Cisco is the only brand that can meet the Government’s needs and be compatible with the current configuration.

Introducing a different brand of system would render the current configuration inoperable and would cause risks to mission and communication capabilities.

Additionally, the procurement of CISCO UC Telepresence systems will incorporate the installation of SIPR Dial Isolators supporting ISDN requirements. These additions will ensure signaling during periods of one device failure, thus providing a reasonable Break-Fix response time while working with CISCO to restore service back to the original state. Installation will be routine Blade or Chassis connection with minimal wire configuration, but CISCO products must be installed. Each component will need to be configured to mirror existing architecture in a clustered fashion. This equipment must be identically compatible in CISCO “Brand Name” and

“Make and Model” to execute its functions correctly. The needed CISCO products have

NETCOM Certificate Of Net-worthiness and are on the DISA APL (Approved Products List), which is essential in order to maintain the RRMC-IT Accreditation for the NIPR and SIPR VTC

VLANs. The Existing NIPR and SIPR VTC Enclaves technology is currently under the RRMC

114th Signal Battalion Army SMART-Net Program account for Service Support of Hardware and

Software until End-Of-Life and End-Of-Service. We are requesting this like technology to be integrated into our existing Service Support Management Program to maximize efficiencies of effort in service and maintenance support. This is an Army wide service support program is at no cost to the RRMC 114th Signal Battalion.

This CISCO requirement will be a firm-fixed price (FFP) effort with a total estimated value estimated at $XXXX (with a potential variance of +/- 5%).

4. IDENTIFICATION OF STATUTORY AUTHORITY:

The statutory authority for this brand name action is the Simplified Procedures for Certain

Commercial Items (41 U.S.C. 1901) as implemented in FAR 13.501, “Special Documentation

Requirements.” The statutory authority permitting a sole source award to a Service-Disabled

Veteran-Owned Small Business (SDVOSB) is in accordance with FAR 6.302-5(b)(6): Sole source awards under the Veteran Benefits Act of 2003 (15 U.S.C. 657f); and FAR 19.1406: Sole source awards to SDVOSB Concerns. A sole source award will be made to MarLand

Technologies, LLC, a SDVOSB concern.

5. DETERMINATION OF BEST VALUE:

In accordance with FAR 13.106-3(a)(2)(ii) and FAR 13.106-3(a)(2)(vi), price will be determined to be fair and reasonable based on comparison of historical prices paid and a comparison with the

Independent Government Cost Estimate (IGCE). This will be a sole source, SDVOSB award to

MarLand Technologies, LLC, which has provided similar services to RRMC in the past as a subcontractor, so historical pricing can be compared. Further, the Government will conduct a full price analysis by comparing the received price quote to its independent Government cost estimate

(IGCE), which was developed through sound market research, prior to award.

6. DESCRIPTION OF MARKET RESEARCH:

There has been no market research conducted regarding non-name brand solutions deviating from

CISCO, due to the incompatible nature of the existing environment with any other sources and the severity of the importance of the service support to the RRMC mission partners COOP mission. The potential of voiding the warranty on currently used CISCO equipment, coupled with the incompatibility of the current configuration with any other equipment and software source, justifies using the CISCO solution.

In terms of conducting market research for this particular requirement, it was determined that, in accordance with FAR 19.1406, a contract award to a SDVOSB concern on a sole source basis was in the best interest of the Government as all of the conditions in FAR 19.1406(a) were met. A

“Notice of Intent to Sole Source” was posted to the Governmentwide Point of Entry (GPE), FBO.gov, on 20 September 2016, to describe the Government’s intent to make a SDVOSB sole source award to MarLand Technologies, LLC for the requirement. The “Notice of Intent to Sole

Source” closed on 21 September 2016 with no challenges or receipt of capabilities from industry, specifically other SDVOSB concerns. MarLand Technologies, LLC has worked with RRMC in the past for similar services as a subcontractor and can meet all of the requirements of the acquisition without using a partner company or large prime contractor, thus passing cost savings to the Government.

7. ANY OTHER SUPPORTING FACTS:

Not applicable at this time.

8. ACTIONS TAKEN TO REMOVE BARRIERS TO COMPETITION:

Technical personnel within RRMC will continue to evaluate the market for supplies and installation commercially available that will fulfill the Government’s unique need to provide VTC functionality on NIPR and SIPR core network systems.
