JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
1. Identification of Agency and Contract Activity
The Department of Defense (DoD), Washington Headquarters Services, Acquisition Directorate
(WHS/AD) is the contracting activity. The requirement is for the Office of the Under Secretary of
Defense for (OUSD(P)).
2. Description of the Action
WHS/AD proposes to issue a follow-on bridge sole source contract, utilizing a Time-and-
Materials (T&M) contract type, to Analytic Services Inc. (ANSER) without using full and open competition in an effort entitled “Program Review and Quadrennial Defense Review (QDR)
Analysis Support Services - Bridge.” The anticipated period of performance will be a one month base period plus five-one month option periods, which would account for March 1, 2016 to
September 30, 2016. The current contract award was issued by WHS/AD and is call order no.
HQ0034-09-A-3017-0014, which expires on February 29, 2016.
3. Background
The current contract provides analytic support for a number of DoD-wide analytic processes, including Program Review and Quadrennial Defense Review (QDR). The tasks include data analytics and modeling and simulation in response to tasks supporting senior DoD leadership, including the Secretary and Deputy Secretary of Defense. The current contract expires February
29, 2016, and a new contract will not be in place before then. A gap in coverage will have a direct, deleterious effect on the ability of senior decision-makers to evaluate national defense and security strategic issues.
4. Description of the supplies/services required
The mission of OUSD(P) is to consistently provide responsive, forward-thinking and insightful policy advice and support to the Secretary of Defense (SECDEF) and the Department of Defense
(DoD). OUSD(P) provides strategic direction and guidance for developing the future Joint Force to meet requirements of the future security environment. The Office of the Assistant Secretary of
Defense for Strategy, Plans, and Capabilities supports the Secretary of Defense, the Deputy
Secretary of Defense, and the Under Secretary of Defense for Policy in developing and ensuring implementation of near-to-mid and mid-to-long term policy planning guidance to DoD on national security and defense strategy and capabilities, forces, and contingency plans necessary to implement defense strategy.
OUSD(P) requires analytic support for DoD-wide strategic security processes including Support for Strategic Analysis (SSA), Program Budget Review (PBR), and the Quadrennial Defense
Review (QDR), in the following areas:
• Data analytics and custom tool development;
• Detailed modeling and simulation; and
• Integration of the whole of Government considerations into DoD analyses.
The Contractor shall provide all labor, supervision, and quality control necessary to provide data analytics and modeling and simulation expertise and capability. The Contractor shall be directly responsible for ensuring the accuracy, timeliness, and completion of all tasks under this effort.
This requirement does not perform inherently governmental functions with all work supervised by government personnel. In accordance with FAR 37.104, personal services are prohibited and will not be performed under this contract. This requirement will be utilizing a T&M contract type, which is the same contract type for the current call order no. HQ0034-09-A-3017-0014. The requirements of this acquisition preclude the use of another contract type, specifically a fixed-price type order for a commercial acquisition, based on the iterative need for tasking and non-constant dispersion of labor hours to conduct the needed assessments and to provide the needed deliverables (i.e. reports, database and model change records, etc.). Actions to convert this requirement to a fixed-price type of order in the future is fully contingent upon whether the tasking for assessment analysis will be needed on a more consistent basis than the ad hoc nature it is now. As long as the requirement is in an ad hoc state, a T&M contract type will be the most appropriate.
Moreover, the services performed shall conform to the requirements and the resulting work products shall conform to all applicable Federal, DoD, WHS, state, and local regulations and policies including, but not limited to, the Federal Acquisition Regulation (FAR), the Defense
Federal Acquisition Regulation Supplement (DFARS), and other DoD policy and supplemental regulations as appropriate.
The total estimated dollar value for this bridge effort is
, which accounts for a six (6) month period of performance starting March 1 st , 2016 to
August 31 st , 2016.
5. Statutory Authority
The statutory authority for this non-competitive action is the Simplified Procedures for Certain
Commercial Items (41 U.S.C. 1901) as implemented in FAR 13.501, “Special Documentation
Requirements.”
6. Applicability of Authority
Failure to issue a follow-on bridge sole source contract award would create an unacceptable lapse in service in providing data analytics and modeling and simulation expertise and capability to senior DoD officials. To compete this requirement at this time will take at least six (6) months.
The period of performance under the current contract ends February 29, 2016. A solicitation is currently being drafted for the re-competed action, but is not projected to be posted or completed until late February 2016. This schedule does not give enough time to properly evaluate quotations and to award a best value acquisition prior to expiration of the current contract, which would cause an unacceptable delay and interruption in services.
The Contractor shall be directly responsible for ensuring the accuracy, timeliness, and completion of all tasks under this effort. Without this service, multiple programs and initiatives will be left without support. The need for uninterrupted services is vital for continuing quick-turn around and strategic analysis for senior DoD officials.
7. Effort to Solicit Potential Sources
The current call order was established through competition and, after this follow-on bridge effort, another competitively established call order will be in place. A “Notice of Intent to Sole Source” was posted to the Government-Wide Point of Entry (GPE) website, Federal Business
Opportunities (FBO), on 22 January 2016 and closed on 06 February 2016 in accordance with
FAR 5.203(a). On 05 February 2016, a vendor responded to the Notice indicating that it could perform the needed services. On the same date, 05 February 2016, the Government responded by email informing the vendor that it is the Government’s intent to still sole source this follow-on bridge action to ANSER, but that a competitive procurement will be forthcoming for vendors to participate. The vendor did not provide any further comment after the Government response.
In addition, allowing for a one month base period plus five-one month option periods follow-on bridge contract action affords the Government flexibility to: 1) create a best value, competitive procurement for the continuing requirement; and 2) to only be obligated for one month at a time with the current incumbent ANSER.
8. Market Research
Due to the urgency of this proposed Contract, market research has been limited to the pre-solicitation notice described above. Additionally, there is not enough time to conduct a thorough competitive procurement, source selection and contract award prior to the 29 February 2016 end date of the current call order; as such, a follow-on bridge sole source award to ANSER is necessary. A gap in coverage will have a direct, deleterious effect on the ability of senior decision-makers to evaluate national defense and security strategic issues. Therefore, a bridge contract will be issued to allow time for a competitive procurement to be conducted for the continuing requirement. As aforementioned, a “Notice of Intent to Sole Source” has been issued for the follow-on bridge contract effort, as well.
9. Other Facts
This contract directly supports OUSD(P)’s Deputy Assistant Secretary for Defense for Strategy &
Force Development (DASD (SFD)). The importance of continuing services is paramount as the nature of the requirement currently is driven solely on short suspense taskers from OUSD(P) leadership and external/Congressional inquiries on a case-by-case need; tasking and labor hours are derived from impromptu mission need for scenario based simulations and analysis.
10. Price Reasonableness
The cost to the Government will be determined to be fair and reasonable in accordance with FAR
13.106-3(a)(2)(ii) and FAR 13.106-3(a)(2)(vi). In making a fair and reasonable determination, the Government will utilize pricing from recent requirements for the similar effort. Further, the
Government will conduct a full price analysis by comparing the received cost to its independent
Government cost estimate (IGCE), which was developed through sound market research and historical data, prior to award.
