DEPARTMENT OF DEFENSE

WASHINGTON HEADQUARTERS SERVICES

1155 DEFENSE PENTAGON

WASHINGTON, DC 20301-1155

ACQUISITION

DIRECTORATE

4 October 2016

LIMITED SOURCES JUSTIFICATION FOR FSS ORDER

1. Agency and Contracting Activity:

Washington Headquarters Services – Acquisition Directorate (WHS/AD) 1225 South Clark Street Arlington, VA 22209-1901

Requiring Activity: Office of the Secretary of Defense/Cost Assessment and Program Evaluation (OSD/CAPE)

2. Description of the Action Being Approved:

WHS/AD has a requirement for continuity of services on a limited sources basis, pursuant to FAR 8.405-6(a). Current services, for OSD CAPE’s Projection Forces Division Mobility Programmers Support are being rendered under Federal Supply Schedule task order GS-35F- 0494K/ HQ0034-12-F-0142. Continuation of these services are required to maintain daily operational support activities as they relate to the OSD CAPE’s Projection Forces Division Mobility Programmers Support mission and other related functions.

The proposed contractor is:

Raytheon Company 870 Winter St.

Waltham, MA 02451-1449

3. Description of Services:

This requirement is in support of the OSD CAPE. CAPE provides the Department of Defense (DoD) with timely, insightful and unbiased analysis on resource allocation and cost estimation problems to deliver the optimum portfolio of military capabilities through efficient and effective use of resources. PFD focuses on analysis and assessment of DoD’s mobility system (primarily airlift, aerial refueling, sealift, and prepositioning) with the aid of numerous computer models;

chief among those is the Analysis of Mobility Platform (AMP) model and the Next Generation Tanker Scheduler/Employment (NGTS/E) model. CAPE has historically used this task to provide programmer support for AMP, NGTS/E, and other related models. Programmer support is necessary to maintain models and debug problems in a timely manner. This is essential to ensure the analysis being supported is not interrupted due to software glitches. Currently, these services are provided by Raytheon via GS-35F-0494K/ HQ0034-12-F-0142 which expires on 31 October 2016.

This contract action would constitute a new task order, under Federal Supply Schedule Contract #GS-35F-4097G, for a period of twelve (12) months. The proposed period of performance for this contract action is 1 November 2016 – 31 October 2017 along with two (2) option periods.

The estimated value of this action is $217,000.00 funded by FY17 Operations and Maintenance (O&M) appropriations. The Government has extended the existing contract through no cost modifications over four (4) months from 14 June 2016 to 31 October 2016 while preparing this action.

4. Statutory Authority Permitting Other Than Full and Open Competition:

This acquisition is being conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies, in accordance with FAR 8.405-6(a), Limited Sources. This task order award is being conducted on a limited sources basis, as only one source that is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized. The task order will be awarded against Federal Supply Schedule Contract/Order #GS-35F-4097G pursuant to FAR 8.405-6(a)(l)(i)(B). The previous award was competitively solicited and awarded using the ordering procedures at FAR 8.405 on 12 June 2012. This task order is necessary to provide continued support to OSD/CAPE with analysis on resource allocation and cost estimation problems to deliver the optimum portfolio of military capabilities through efficient and effective use of resources.

The statutory authority which permits restricting consideration of schedule contractors to fewer than that required in FAR 8.405-2 is 41 U.S.C. 251, as implemented by FAR 8.405-6.

Specifically, competition for this acquisition is waived based on criteria cited in FAR 8.405- 6(a)(1)(i)(B).

5. Rationale Justifying Use of Cited Statutory Authority:

The need for specialized knowledge in AMP, NGTS/E, and other related models is essential to ensure timely analytical support to the SecDef and the warfighter. These models have over 2.5 million lines of code and unfamiliarity can significantly impede efforts to update or debug the various modules. CAPE analysts depend on these models to provide the analytic support to our senior leaders. CAPE can ill afford delays waiting for patches or debugging, especially if they are in the throes of a SecDef directed, Congressionally-mandated study or providing direct support to warfighters. Raytheon is the only source that has the requisite operational ready personnel that are cleared and trained to perform the requirements and possess the specialized knowledge of sensitive case file handling needed and that can maintain the operational tempo for the period of performance contemplated. Raytheon is the developer of both the AMP and NGTS/E models and the NGTS/E is expected to be integrated into the AMP suite of models as it matures. Thorough knowledge of the AMP suite of models and the new NGTS/E is essential to this task and continued services needed for OSD/CAPE.

Recent history illustrates the need for this timely support. These models were utilized extensively to support the National Commission on the Future of the Army which submitted its final report to the President and Congress in January 2016. The support to the commission was often short notice taskings to determine the transportation feasibility of various alternatives of deploying the force. Other recent activities include the Congressionally-mandated Mobility Requirements Study which set the requirements for the $25 billion annual mobility portfolio.

These high-level research and analysis activities are critically dependent on the AMP and NGTS/E models supported by this contract. The models are modified as needed to support the specified task and require an in-depth knowledge of the 2.5 million lines of code to ensure the analytic efforts of CAPE can meet the nation’s needs in a timely manner. Raytheon is the only known firm that has extensive knowledge of these models.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Possible:

No contractors were identified that could provide the required services within the agency's time frame.

7. Determination of Fair and Reasonable Cost:

The Contracting Officer has determined that issuing the proposed task order to Raytheon to provide the AMP, NGTS/E, and other related models in support of CAPE PFD represents the best value and will result in the lowest overall cost, considering price and administrative costs, to meet the Government's needs. This task order will be awarded in accordance with FAR 8.404, "Use of Federal Supply Schedules" and the terms and conditions of the original, conformed task order. The General Services Administration (GSA) has already negotiated fair and reasonable pricing rates and the price for this extension task order will be analyzed based on those rates as negotiated in the current task order. The Contracting Officer will also consider DFARS and local guidance regarding the use of FSS pricing. Additionally, prior to issuance of the task order, the ordering activity will consider the level of effort and the mix of labor categories proposed to perform the specific task being ordered in order to determine that the total price is reasonable.

The contractor's labor mix and level of effort will also be compared to the Independent Government Cost Estimate (IGCE). The IGCE was completed and reflected a base amount of $111,450.00 and a total value, base plus two (2) option years, of $563,456.00.

8. Description of Market Research:

8.1 On April 1, 2016, WHS/AD issued a sources sought notice synopsis on the Federal Business Opportunities (FBO) website and GSA e-buy under Notice MAK040120161840 that detailed the tasks for the Programmer Support requirement. The Sources Sought and Request for Information was solely for the purpose of determining the availability and potential technical capability of small business, 8(a), veteran-owned small business, service-disabled veteran owned small business, HUBZone small business, small disadvantaged business, and/or women owned small business to provide the describes services. The sources sought notice response due date was 4/8/2016 at 5:00PM. The Government received zero responses from FBO and GSA eBuy notices.

8.2 On April 14, 2016, a Strategic Sourcing review for Mobility Analysis – Programmer Support was requested from the Enterprise Strategic Sourcing Branch (ESSB) as required by the Acquisition Directorate Acquisition Policy (ADAP) section 9.902 (S-91) Policy. It was determined that this requirement was not suitable for the existing strategic sourcing vehicles.

8.3 WHS/AD also reviewed GSA e-Library and SBA’s Dynamic Small Business Search (DSBS) to identify potential sources with the applicable NAICS code. The SBA’s DSBS search was completed on May 2, 2016 and provided zero results.

8.4 On June 16, 2016, WHS/AD issued an additional sources sought notice synopsis on the FBO website under FBO Notice HQ0034-16-R-0184 that detailed the tasks for the Programmer Support requirement. The Sources Sought and Request for Information was solely for the purpose of determining the availability and potential technical capability of all businesses in providing the requirement. The sources sought notice response due date was June 23, 2016, with one (1) response received. A capability statement was provided by Axxera Inc., a SBA- Certified HUBZone Small Business. The capability statement was forwarded to the COR for review, however, it was determined that it did not meet the requirement since it did not address any of the tasks stated on the source sought notice.

8.5 The program office, OSD/CAPE, reviewed similar procurements and also had communications with vendors that provide similar services to DoD offices such as Booz Allen Hamilton, Inc., AT&T Government Solutions, and Unisys Corporation. In addition, Booz Allen Hamilton, Inc. and AT&T Government Solutions provided capability statements in response to the RFI dated June 16, 2016. However, both capability statements were deemed unacceptable to meet the requirement due to the lack of response to tasks 3.1 and

3.1.1 which are the core components of the requirement.

8.6 The market research revealed that there were no small businesses and/or large businesses capable of fulfilling the requirement besides Raytheon. The two (2) large businesses that provided capability statements were not able to address the core tasks of 3.1 and 3.1.1 due to their lack of expertise and knowledge of the systems utilized for this requirement. Raytheon is the only known firm that has the extensive knowledge for particular models needed for the requirement such as: Analysis of Mobility Platform (AMP) suite of models and Next Generation Tanker Scheduler/Employment (NGTS/E) model.

9. Listing of Interested Sources

Other than the incumbent contractor, Raytheon, there are no interested sources for this action.

10. Statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before ally subsequent acquisition for the supplies/ services required.

Award of the new requirement is anticipated by 28 October 2016. The program office estimates the award to value at $668,307.00
