WASHINGTON, DC 20301-1155
ACQUISITION
DIRECTORATE
LIMITED SOURCES JUSTIFICATION
HQ0034-15-R-0119
Upon the basis of the following justification, I, the contracting officer, hereby approve the use of restricting consideration of the proposed contractual action pursuant to the authority of FAR 8.405-6.
1. REQUIRING ACTIVITY / CONTRACTING ACTIVITY [FAR 8.405-6(c)(2)(i)]
Requiring Activity:
Department of Defense (DoD) Office of the Under Secretary of Defense (OUSD) for Acquisition, Technology, and Logistics (AT&L) Assistant Secretary of Defense for Acquisition (ASD(A)) 1155 Defense Pentagon Washington, DC 20301-1155
Contracting Activity:
DoD Washington Headquarters Services (WHS) Acquisition Directorate (AD) 1225 S. Clark Street Arlington, VA 22202
2. NATURE / DESCRIPTION OF ACTION(S) [FAR 8.405-6(c)(2)(ii)]
This justification approves the use of a three-month bridge task order to SRA International using SRA’s GSA Mission Oriented Business Integrated Services (MOBIS) schedule GS- 23F-9806H. The current call order was awarded under SRA’s WHS Blanket Purchase Agreement, HQ0034-08-A-1012 call 0001, which was competitively awarded to SRA International, Inc. on 05 Jan 2010. The current period of performance expires on 11 July 2015. The follow-on contract was strategically planned to be one of the first task orders to be competitively awarded under the newly awarded Analytical Technical Support Services (ATSS), Indefinite Delivery / Indefinite Quantity (IDIQ) contracts competed under solicitation HQ0034-14-R-0074. Prior to the awards being made a stayed was ordered due to a series of protest at the Government Accountability Office (GAO). The protests in question were denied or dismissed on 22 June 2015. However, the basic IDIQ awards have not yet been completed. This three-month bridge contract is necessary to provide sufficient time for the Contracting Activity to compete this requirement award among IDIQ contract holders after protest resolution.
3. DESCRIPTION OF SUPPLIES / SERVICES [FAR 8.405-6(c)(2)(iii)]
The Deputy Assistant Secretary of Defense for Command, Control, and Communications, Cyber, and Business Systems (DASD C3CB) under ASD(A) has the lead functional acquisition oversight of all critical warfighting C3 & Cyberspace capabilities in DoD and performs the responsibilities of the Principal Staff Assistant (PSA) for non-Intelligence Space supporting the Secretary of Defense, Chairman of the Joint Chiefs of Staff, Combatant Commands, Services and Defense Agencies. The PSA role is responsible for acquisition and management oversight of major defense acquisition programs.
The DASD C3CB works to achieve interoperability and net-centric operations by establishing critical capabilities via program oversight, guidance and directives, portfolio management, enterprise wide systems engineering to enable critical information access, sharing and collaboration across the defense information enterprise architecture. This position provides highly technical expertise and management oversight of command and control, communications, non-intelligence space and cyber activities to include net-centric and command and control capabilities portfolio operations and governance decision implementation. It serves as the civilian capability manager for the command and control and the net-centric joint capability areas and advises the Deputy Secretary of Defense and DoD Components on how to optimize capability investments across the defense enterprise for minimizing risk and maximizing return on investment. In these capacities, the DASD C3CB is a chief architect of master plans, roadmaps, guidance and directives, program acquisitions, strategic investments and architectures for ensuring information on demand from its source to the tactical edge. The position provides guidance and direction of these activities throughout the Department’s requirements, acquisition and planning, programming, budgeting and execution (PPBE) system processes. The estimated dollar value for this three-month bridge contract is $211,500. This estimate is based on historical data for the provided services under the current call order.
SRA currently supports a wide range of technical, scientific, engineering, acquisition and programmatic expertise to support management oversight of the DASD’s portfolio of cyber & space and space-related programs, projects and activities to support the Director in providing effective guidance and direction for non-intelligence space programs and ensuring interoperability of systems to benefit the warfighter. First, SRA supports AT&L chartered Integrated Product Teams (IPTs) and Defense Acquisition Boards (DABs) technical and documentation requirements and delivers plans and studies in response to all requisite C3, cyber, and space architectural initiative activities. Second, SRA provides evaluations of architectural studies, results of Analysis of Alternatives, resource inputs, improvements to strategies and plans for acquisition planning processes throughout the review cycle of decision-making authorities, including developing, communicating, and ensuring net-centric Key Performance Parameters are met. Finally, SRA supports for assessment, analysis and, evaluation and implementation of the Persistent Test and Training Environment (PTTE) within the Cyber Range effort.
A break in the service will result in a significant procurement delay to the $5.3B Global Position System and Global Positioning System Next Generation Operational Control System. SRA will provide technical and acquisition support for two pre-milestone decision meetings with Undersecretary of Defense for Acquisition, Logistics and Technology (OUSD/AT&L) in first quarter of CY15. The department anticipates spending $1B in development and procurement in FY15 and any delays will significantly impact a needed warfighter capability.
DASD C3CB is also responsible for effectively and efficiently manage cyberspace infrastructure investments in support of evolving cyber mission force (CMF) capability, team development and emerging T&E cybersecurity requirements. SRA support is required to integrate cyberspace infrastructure investments and assist DASD C3CB with acquisition and procurement oversight of cyberspace infrastructure in support of testing, evaluation (T&E), training, exercising, experimentation, mission rehearsals, science & technology, and research and development (collectively referred to as ‘cyber ranges’). A break in contract will result in a significant delay in training the CMF and delay cybersecurity resiliency testing.
4. AUTHORITY AND SUPPORTING RATIONALE AND A DEMONSTRATION OF THE PROPOSED
CONTRACTOR’S UNIQUE QUALIFICATIONS TO PROVIDE THE REQUIRED SERVICE [FAR
8.405-6(a)(1)(i)(C)]
In accordance with FAR 8.405-6(a)(1)(i)(B), Only one source is capable of providing the services required at the level of quality required because the services are unique or highly specialized and following the standard competition procedures would result in unacceptable delays.
In the case of follow-on contracts for the continued provision of highly specialized services, as these services are, it is likely that award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition.
SRA was awarded this call order competitively under a WHS/AD BPA with their MOBIS schedule GS-23F-9806H.
The three month bridge is necessary to avoid an unacceptable lapse in service. The three-month duration provides sufficient time to award the referenced ATSS IDIQ contracts, and then compete the requirement among all the IDIQ holders. If a further protest is filed with the United States Court of Federal Claims, the three-month bridge contract should also be sufficient to run a new full follow-on competition using another contract vehicle option.
Stability and continuity of services are required until the competition of the new ATSS IDIQs provides a new suitable awardee. A break in support services will result in significant procurement delay $5.3B Global Position System and Global Positioning System Next Generation Operational Control System. SRA will provide technical and acquisition support for two pre-milestone decision meetings with Undersecretary of Defense for Acquisition, Logistics and Technology (OUSD(AT&L)) in first quarter of CY15.
SRA is familiar with the AT&L and DASD C3CB operations that are conducted on a daily basis, has the required staff and has the proper security clearances to perform the work. To competitively award a new contract would result in unacceptable delays and mission risk due to issues in finding personnel with the specific technical expertise and TS/SCI eligible clearances.
Allowing a lapse in services would negatively affect the support services being providing in Section III (Tasks) of the PWS and any delays will significantly impact a needed warfighter capability.
To competitively award a bridge contract to a new contractor would result in unacceptable delays and mission risk due to issues in finding personnel with the specific technical expertise and eligible clearances. Given the short duration of the option, this is the most reasonable approach to prevent a disruption in service and ensure program continuity.
5. REPRESENTATION OF THE BEST VALUE [FAR 8.405-6(c)(2)(v)]
The Contracting Officer will evaluate SRA’s proposed prices in accordance with Class Deviation 2014-O0011. CD 2014-O0011 requires DoD contracting officers to evaluate Federal Supply Schedule (FSS) prices using the price analysis techniques at FAR 15.404-1, even if the FSS contracting officer has determined the prices to be fair and reasonable. The Contracting Officer will also seek discounts due to the current fiscal environment and efficiencies gained through learning during the five-year Period of Performance. This will ensure that the final negotiated price for this three-month bridge contract is fair and reasonable. Part of making a fair and reasonable determination, the Government will utilize pricing from previous awards such as call orders HQ0034-08-A-1012-0002 or -0003. These awards were previously deemed fair and reasonable.
6. DESCRIPTION OF MARKET RESEARCH [FAR 8.405-6(c)(2)(vi)]
In accordance to FAR 8.405-6(c)(2)(vi), this requirement is a follow-on contract and due to substantial duplication of cost to the Government that is not expected to be recovered through competition and unacceptable delays in fulfilling the agency’s requirements, it is in the best interest of the Government to award this contract on a sole source basis.
7. ANY OTHER SUPPORTING FACTS [FAR 8.405-6)(c)(2)(vii)]
There is a high risk that other potential contractors will not quote for work inclusive of a limited period of performance. It would be difficult to find qualified personnel willing to work for such a short period of time. This risk is too high considering the need for the support services and the amount of time it would take to try to find potential contractors with little chance any would be interested.
If a contractor was willing and technically suitable to quote on the short period of performance, the risk to the Government in terms of disruption of support in both the short-and long-terms, would be too high to transition support to another contractor for such a limited time. The Government would incur substantial delays to performance during multiple transitions from one contractor to the next. The new contractor would potentially only be on board for one month. As such, there would be a transition from the incumbent, SRA, to the new contractor, and a transition from the new contractor to the successful contractor of the follow-on acquisition (i.e. the ATSS IDIQ task order). Assuming personnel hired by each contractor required no learning curve, the administrative challenges alone involving hiring, building passes and required TS/SCI security clearances would cause significant disruption in critical services. This duplication of effort and resultant delays in performance is mitigated by extending the current SRA call order by one month as there would only be one transition period from SRA to the successful offeror for the ATSS IDIQ task order for this work.
8. ACTIONS TAKEN TO REMOVE BARRIERS TO COMPETITION [FAR 8.405-6(c)(2)(viii)]
The contracting activity is in the process of awarding the ATSS IDIQs that were previously subject to a GAO protest action. The full follow-on task order solicitation is anticipated to be competed among the IDIQ contract holders, or among contract holders on other contract vehicles available for use by the contracting activity. If the IDIQ is subject to further protest actions at the U.S. Court of Federal Claims, this bridge contract also contains enough time to run a new full follow-on competition using another contract vehicle option.
9. TECHNICAL / REQUIREMENTS CERTIFICATION [FAR 8.405-6(c)(2)(x)]
I certify that the facts and representations under my cognizance which are included in this justification and which form the basis for this justification are complete and accurate.
