DEPARTMENT OF DEFENSE

WASHINGTON HEADQUARTERS SERVICES

ACQUISITION DIRECTORATE

1155 DEFENSE PENTAGON

WASHINGTON, DC 20301-1155

LIMITED SOURCES JUSTIFICATION

Upon the basis of the following justification, I, hereby approve the use of restricting consideration of the proposed contractual action pursuant to the authority of FAR 8.405-6.

JUSTIFICATION

1. AGENCY AND CONTRACTING ACTIVITY: [FAR 8.405-6 (c) (2) (i)]

Agency:

Department of Defense Office of the Under Secretary of Defense, Acquisition, Technology, and Logistics Assistant Secretary of Defense for Acquisition 1155 Defense Pentagon Washington, DC 20301-1155

Contracting Activity:

Department of Defense Washington Headquarters Services Acquisition Directorate (WHS/AD) 1225 S. Clark Street Arlington, VA 22202

2. NATURE/DESCRIPTION OF ACTION(S): [FAR 8.405-6 (c) (2) (ii)]

This justification approves a bridge sole source award to Camber Corporation for a three-month period of performance with a three-month option period. This is necessary to provide sufficient time for the Contracting Activity to take corrective action on a protest to new Indefinite Delivery / Indefinite Quantity (IDIQ) contracts, under which this requirement was supposed to be awarded as a Task Order. WHS/AD awarded the current task order, HQ0034-14-F-0271, against GSA Schedule GS-10F-0050N. This order expires on 19 February 2015 without any further possibility for an extension. A three-month bridge sole source contract action is the minimum time needed to support mission critical tasks while corrective action is taken and a competitive procurement is completed. The additional three-month option will only be exercised if there are any further delays in proceeding with the aforementioned IDIQ contracts.

3. DESCRIPTION OF SUPPLIES/SERVICES: [FAR 8.405-6 (c) (2) (iii)]

The Office of the Under Secretary of Defense for Acquisition, Technology & Logistics (OUSD(AT&L)) develops and leads key initiatives that provide recommendations to senior OUSD(AT&L) leadership to inform the Department’s strategic investment decisions and to ensure joint, integrated, interoperable, system-of-system combat capability is delivered to the warfighter. The estimated dollar value of the three-month period of performance for this bridge is . The estimated dollar value of the three-month option period is also

Camber provides support services to assist with ODUSD(AT&L)’s mission to develop and lead key initiatives to support early strategic investment decisions that ensure joint, integrated, interoperable, system-of-system combat capability to the warfighter. Camber also provides strategic planning, capability-based road mapping, project coordination support, report and briefing preparation, and other program activities leading to the institutionalizing of a capabilities-based approach to the acquisition of warfighting capability within the Department of Defense (DoD). In performance of these tasks, Camber has a thorough understanding of the Department of Defense (DoD), the Joint Capabilities Integration and Development System (JCIDS), the Defense Acquisition System, and has a working knowledge of OUSD(AT&L) organization and processes.

4. AUTHORITY AND SUPPORTING RATIONALE AND A DEMONSTRATION OF

THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS TO PROVIDE THE

REQUIRED SERVICE: [FAR 8.405-6 (c) (2) (iv)]

In accordance with FAR 8.405-6(a)(1)(i)(A), an urgent and compelling need exists for Camber to continue providing these services to support the operations of the Office of the Secretary of Defense for Acquisition.

The Government intended to compete this requirement among Analytic & Technical Support Services (ATSS) Indefinite Delivery / Indefinite Quantity (IDIQ) contract holders recently awarded under Solicitation HQ0034-14-R-0074. However, a GAO protest to these awards was filed, and the contracts are currently stayed. By the time this delay arose, the Government determined there was not enough time to compete the requirement on an alternate contract vehicle without causing a lapse in service.

A break in service would cause serious injury to the Office of the Assistant Secretary of Defense for Acquisition with significant negative impact to matters of national security for the Department of Defense.

Camber provides unique expertise in electronic warfare and missile defense technology and systems. Their expertise is critical in the analysis of electronic warfare technology to support the acquisition and fielding of Department of Defense electronic warfare capabilities to meet the rapidly evolving operational threat. In addition, Camber provides critical expertise in missile defense systems, including the understanding of the complicated system of systems relationships and interdependencies of Department of Defense missile defense systems. This understanding is necessary for the Department to develop and field a missile defense capability to meet the urgent operational needs of Combatant Commanders and our Allies. A loss of or a break in this critical expertise in missile defense and electronic warfare will be especially detrimental at this time since the Department is starting the Capability Gap Assessment process, identifying and examining urgent and critical needs of the Combatant Commanders.

Due to the urgent and compelling need that came about as a result of the ATSS IDIQ protest delay, Camber should continue to provide these services because it is familiar with the Office of the Assistant Secretary of Defense for Acquisition operations that are conducted on a daily basis, has the required staff, and has the proper security clearances to perform the work. To competitively award the bridge to a new contractor would result in unacceptable delays and mission risk due to issues in finding personnel with the specific technical expertise and TS/SCI eligible clearances. Given the short duration of the bridge, a sole source award to the incumbent Camber is the most reasonable approach to prevent a disruption in service and ensure program continuity.

5. REPRESENTATION OF THE BEST VALUE: [FAR 8.405-6 (c) (2) (v)]

The Contracting Officer will ensure that the final negotiated price for this bridge order is fair and reasonable in accordance with the techniques listed under FAR 15.404-1 and the DPAP Deviation 214-O0011 dated March 13, 2014.

6. DESCRIPTION OF MARKET RESEARCH: [FAR 8.405-6 (c) (2) (vi)]

Market research was not conducted for this limited acquisition due to the urgent and compelling nature of the requirement.

7. ANY OTHER SUPPORTING FACTS: [FAR 8.405-6 (c) (2) (vii)]

There is a high risk that other potential contractors will not quote for work inclusive of a limited period of performance. It would be difficult to find qualified personnel willing to work for such a short period of time. This risk is too high considering the urgent need for the support and the amount of time it would take to try to find potential contractors with little chance any would be interested.

If a contractor was willing and technically suitable to quote on the short period of performance, the risk to the Government in terms of disruption of support in both the short- and long-terms, would be too high to transition support to another contractor for such a limited time. The Government would incur substantial delays to performance during multiple transitions from one contractor to the next. The new contractor would potentially only be on board for three months.

As such, there would be a transition from the incumbent, Camber, to the new contractor, and a transition from the new contractor to the successful contractor of the follow-on acquisition (i.e. a Task Order RFP requirement of the IDIQ). Assuming personnel hired by each contractor required no learning curve, the administrative challenges alone involving hiring, building passes and security clearances (up to TS/SCI) would cause significant disruption in critical services.

This duplication of effort and resultant delays in performance is mitigated by awarding a three-month base with three-month option bridge to Camber as there would only be one transition period from Camber to the successful offeror for the Task Order RFP requirement under the IDIQs for the Office of the Assistant Secretary of Defense for Acquisition.

8. ACTIONS TAKEN TO REMOVE BARRIERS TO COMPETITION: [FAR 8.405-6 (c)

(2) (viii)]

The contracting activity is in the process of resolving a protest to the ATSS IDIQ awards under which this requirement will be competed as a Task Order.

9. TECHNICAL/REQUIREMENTS CERTIFICATION: [FAR 8.405-6 (c) (2) (x)]

I certify that the facts and representations under my cognizance which are included in this justification and which form the basis for this justification are complete and accurate.
