4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION:
FAR 6.302-1(c): Application for brand name descriptions.
(1) An acquisition or portion of an acquisition that uses a brand-name description or other purchase description to specify a particular brand-name, product, or feature of a product, peculiar to one manufacturer—
(i) Does not provide for full and open competition, regardless of the number of sources solicited; and
(ii) Shall be justified and approved in accordance with FAR 6.303 and 6.304.
(A) If only a portion of the acquisition is for a brand-name product or item peculiar to one manufacturer, the justification and approval is to cover only the portion of the acquisition which is brand-name or peculiar to one manufacturer. The justification should state it is covering only the portion of the acquisition which is brand-name or peculiar to one manufacturer, and the approval level requirements will then only apply to that portion;
(B) The justification should indicate that the use of such descriptions in the acquisition or portion of an acquisition is essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company; and
(C) The justification shall be posted with the solicitation (see 5.102(a)(6)).
5. DEMONSTRATION THAT THE NATURE OF THE ACQUISITION REQUIRES THE
USE OF THE AUTHORITY CITED:
For Windows Server:
This maintenance is necessary to provide OUSD(AT&L) with continued support for currently installed Microsoft Windows Server. Market research of this requirement has validated that all requirements can only be satisfied by Microsoft Windows Server. They are the only providers of the software tech support. Without the purchase of this software maintenance, OUSD(AT&L) would not be able to keep current with the latest releases of the products or obtain support in the event of technical problems. More than $152,000 has been invested in our Microsoft Solution. This investment has allowed OUSD(AT&L) to store, manage, and provide users with access to mission critical data. It is used on a daily basis to make strategic decisions within the organization at all levels. To switch to another solution would result in increased training cost, increased software configuration management, as well increase technical support, thereby not making it advantageous to the government.
For SQL Server:
AT&L has invested more than $327,000 on this solution. To switch to another solution would result in increased training cost, increased hardware and software configuration management, increase technical support, thereby not making it advantageous to the government.
6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED
FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE, INCLUDING
WHETHER A NOTICE WAS OR WILL BE PUBLICIZED AS REQUIRED BY SUBPART
5.2 AND, IF NOT, WHICH EXCEPTION UNDER 5.202 APPLIES:
This requirement will be solicited among those vendors that hold a DoD Enterprise Software Initiative (ESI) blanket purchasing agreement (BPA). DoD ESI BPAs are based on GSA Schedule contracts. Due to the dollar value and brand-name nature of this requirement, this document and the award document will be posted at the Governmentwide Point of Entry (GPE), colloquially referred to as FedBizOpps, for 15 days at the time of award. The request for quote document will serve as the combined solicitation and synopsis document.
7. CONTRACTING OFFICER’S DETERMINATION THAT THE ANTICIPATED COST
WILL BE FAIR AND REASONABLE:
DoD ESI BPAs are discounted compared to the base GSA Schedule contract. This action will be procured on a Lowest-Priced, Technically-Acceptable (LPTA) basis.
8. DESCRIPTION OF MARKET RESEARCH AND ITS RESULTS:
Market research was conducted to determine the availability of products under DoD ESI BPAs. Ten (10) vendors hold a DoD ESI BPA; two are small businesses, and eight are large businesses. Per FAR 8.405-5, small business preference programs are not required for required sources. This J&A document will be posted alongside the solicitation, per FAR 6.302-1. Posting a separate synopsis of this contract action will not be required, per FAR 5.202(a)(11).
9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN
COMPETITION:
None.
10. LIST OF INTERESTED SOURCES:
Insight Public Sector, Dell, SHI International, Softmart Government Services, En Pointe Gov, Hewlett Packard, CDW-G, GovConnection, GTSI, Softchoice Corporation
11. STATEMENT OF ACTIONS (IF ANY) THE AGENCY MAY TAKE TO REMOVE OR
OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT
ACQUISITION FOR THE SUPPLIES OR SERVICES REQUIRED
DoD ESI is a required source, per Department of Defense Federal Acquisition Regulation Supplement (DFARS) 208.74. This requirement will be competed among the DoD ESI BPA holders for Microsoft products and services.
