JUSTIFICATION AND APPROVAL (J&A) FOR OTHER THAN FULL AND OPEN
COMPETITION
Justification for Selection of ENSCO Inc. to Provide Pentagon Shield Detection & Protection Systems Installation, Integration and Sustainment Services to the Pentagon Force Protection Agency (PFPA) Science and Technology Office (STO)
1. Identification of Agency and Contracting Activity
a. Requiring Agency:
Pentagon Force Protection Agency, Science and Technology Office CBRN Directorate
9000 Defense Pentagon
FB2 3317
Washington, DC 20301-9000
b. Contracting Activity:
Washington Headquarters Services Acquisition Directorate 1155 Defense Pentagon Washington DC 20301-1155
2. Nature and Description of Action: The Washington Headquarters Services (WHS), Acquisition Directorate (AD), intends to award a sole source contract to ENSCO, Inc. for the installation, integration, refinement and sustainment of Pentagon Shield command and control systems. This action is for operational support, maintenance, training, system enhancement, and documentation for the PFPA STO SENTRY system.
The system integration infrastructure and related software currently existing within the Pentagon Shield program is known as the SENTRY system. This system was supplied to PFPA in FY 2002 by ENSCO, Inc. and is considered to be intellectual property of the company.
SENTRY is a 24x7 mission critical system and is used primarily by PFPA’s Integrated Emergency Operations Center (IEOC) Directorate. It operates through a proprietary protocol and is highly specialized and unique.
3. Description of Supplies/Services: The Contractor shall provide application development support to PFPA that enables integration of new technologies and work products developed in support of the PFPA programs and response capabilities (e.g., HVAC systems and physical security systems) into the SENTRY System. The Contractor shall also refine the current SENTRY capabilities to enhance the human-machine interface, improve system performance and communication protocols, and expand current systems to address additional areas of interest on the Pentagon Reservation and throughout the NCR.
The Contractor shall also provide PFPA with equipment procurement resources & services to support sustainment of Pentagon Shield and physical security programs. This support shall include but is not limited to life cycle replacement of Tier 1-3 Chemical and Biological sensors, information technology integration and updates to documentation supporting system security. Furthermore, the Contractor shall provide support to ensure compatibility between SENTRY and associated systems as well as characterization and performance assessment for new or replaced systems.
The Contractor shall provide updated training for PFPA staff to ensure SENTRY system competency and effective use of other work products produced and updated as part of this effort. Training materials should be provided 30 days in advance for Government approval.
The Contractor shall participate in efforts to assess system performance and conduct special studies as directed by PFPA in support of Pentagon Shield and other Security programs on the Pentagon Reservation and throughout the NCR.
The Contractor shall provide documentation to facilitate the submission of security accreditation documentation and Command, Control, Communication, Computers, and Intelligence Support Plan (C4ISP) documentation for Pentagon Shield sensors (new and lifecycle replacements) and Pentagon Physical Security programs and/or work products derived from the efforts.
4. Identification of Statutory Authority: The statutory authority permitting other than full and open competition is Title 10 U.S.C. 2304 (c) (1) as implemented by Federal Acquisition Regulation (FAR) 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirement.
5. Demonstration of Contractor’s Unique Qualifications: The existing SENTRY system is an integral part of the Pentagon Shield system and is considered to be essential for the security and safety of the inhabitants of the Pentagon. Another contractor could develop a similar system, however it is estimated that it would take a minimum of two to three years to meet all user requirements that it took ENSCO over ten years to develop in the SENTRY system. This would involve substantial duplication of cost—to maintain SENTRY while developing a new system— that is not expected to be recovered through competition.
During the process of developing and customizing the SENTRY system, the incumbent has included intellectual property in the currently installed SENTRY system. Hence, legally, no other contractor can work on the system without the express permission of the incumbent.
Since intellectual property is involved, no other contractor can work on the system without the express permission of the incumbent.
6. Description of Effect to Ensure Other Potential Sources: On 15 April 2012 a notice was posted on Federal Business Opportunities (FedBizOpps) website announcing the Government’s intent to award a sole source contract to ENSCO, Inc for training, installation, integration, and support system to SENTRY System. The Statement of Objective was attached for offerors to view and patent list for offer to determine if they could perform the work required. The response period closed on 25 April 2012, and only response was received from the incumbent.
7. Determination of Fair and Reasonable Costs: The Contracting Officer will utilize price analysis techniques, leveraging ENSCO pricing history, ENSCO GSA labor rates, current market trends, and the Government’s independent estimate as a basis to negotiate a fair and reasonable contract price. The Government’s technical expertise and knowledge will validate and ensure favorable comparison to industry standards.
8. Description of Market Survey: The Government convened a market survey through the use of FedBizOpps. The result of the market survey showed that there are no contractors capable of providing the services required. SENTRY works on highly specialized and technical software that is patented by ENSCO.
9. Any Other Supporting Facts: None
10. Listing of Interested Sources: No other sources are known at this time. ENSCO was identified as the only source due to the restrictive and propriety licenses that ENSCO has on the SENTRY system intellectual property (Patent Number 6,525,658).
11. Actions Taken to Remove Barriers to Competition: The possibility to increase competition is driven by the availability of a system that could fully replace the SENTRY system in all aspects. Currently, ENSCO is the only potential provider for these services based on intellectual property rights that ENSCO holds. In addition, it would not be cost effective for the Government to replace the SENTRY System.
12. Statement of Delivery Requirement: See the attached Government’s estimated deliverable schedule. The Government issued this as a Statement of Objective (SOO) and the contractor will propose a deliverable schedule/ phased approached to complete the Statement of Objective. The Government will approve the final schedule.
13. Total Estimated Dollar Value of the Acquisition Covered by this J&A: The five-year total for one 12-month base and four12~month option years is $5,018,477.80.
14. Reference to the Approved Acquisition Plan: This requirement does not meet the threshold for written acquisition plan.
