Control No. HNC-20-0008

FOR OFFICIAL USE ONLY - IAW FAR 3.104

Reviews: I have reviewed this justification and find it adequate to support other than full and open competition.

Program Manager:

Legal Counsel:

is a modification to a task order which was exempt from synopsis in accordance with FAR 5.202(a)(6); The proposed contract action is an order placed under subpart 16.5.

7. ACTIONS TO INCREASE COMPETITION: Although competition is not currently the best option for this contract action, this task order was awarded under the ESS V Restricted MATOC and fair opportunity was provided to all six small businesses. HNC now competes all new task order requirements of this nature under the UMCS IV MATOC which consists of five small businesses and eight large businesses. Any new meter installation or maintenance efforts for this location will be competed on the MATOC.

8. MARKET RESEARCH: Market research was conducted prior to task order award and all mandatory and preferred sources were reviewed again for the purpose of this modification. The required services for this task order are not available from AbilityOne, GSA, or CHESS. There was a preferred source that was found (Building Maintenance and Operations (BMO), a Federally Strategic Sourcing Initiative (FSSI) offered by GSA), but was determined not to be suitable for mission requirements. This source’s scope is not as expansive as that provided under multiple USACE MATOCS. While it can provide basic meter installation effort, it does not provide for services on computers or IT equipment. The ESS and UMCS MATOCs, in contrast, provides for the installation, maintenance, and testing of IT equipment relating to the overall system being serviced. Additionally, all USACE IDIQ contract vehicles were reviewed to determine if there is an existing contract vehicle capable of fulfilling this requirement. While this task order was originally solicited on the ESS V MATOC, there is a different MATOC that has been awarded since this task order was awarded (UMCS IV) that better meets the scope of this requirement. The current contractor, Evergreen Fire Alarms, is on both of these contract vehicles. Despite the findings of the market research, it was determined modification to the existing task order is in the best interest of the Government as described in section 5 above. Any future requirements similar to this task order will be completed on the UMCS MATOC.

A cost analysis was conducted and the proposal is determined fair and reasonable based on historic pricing in accordance with FAR 15.404-1(b(2).”

Signature:

12. Contracting Officer Certification: “I certify that this justification is accurate and complete to the best of my knowledge and belief.”
