About this file
This is a Sole Source Justification (SSJ) for a new contract with Fisher Scientific Company LLC to provide continued lease services for ALCOR Scientific laboratory analyzers.
The Albuquerque Area Indian Health Service requires a one-year lease contract for iSED Elite and miniiSED analyzers, including testing equipment, consumables/supplies, and preventative maintenance services. The contract performance period runs from May 1, 2026 through April 30, 2027, with a firm fixed price of $57,875.00. The acquisition is justified under 41 U.S.C. 3304(a)(2) citing "Unusual and Compelling Urgency" per RFO-FAR 6.103-2, as a delay in award would risk discontinuation of in-house laboratory testing for Erythrocyte Sedimentation Rate (ESR) and adversely impact clinical operations and patient care delivery. The Government determined that full and open competition would result in unacceptable delays and that ALCOR is the only responsible source capable of providing the required services within the necessary timeframe. ALCOR equipment is already installed and validated in all IHS federal laboratories in the Albuquerque Area. The previous contract (75H70725P00124) ran from May 1, 2025 through April 30, 2026 with a value of $57,455.36 and was awarded under FAR 8.405-6(a)(1)(i)(A) without competition. Price reasonableness was determined through comparison of the proposed price with prices found reasonable on previous purchases and comparison to an independent Government estimate.

3. Description of Supplies and/or Services:
Albuquerque Area Indian Health Service laboratory programs need a contract with ALCOR Scientific to continue support services with consumables and preventative maintenance (PM) services. This contract request is for all Albuquerque Area Indian Health Service laboratories.
4. Statutory Authority Cited and Rationale:
Authority This justification for other than full and open competition is conducted pursuant to 41 U.S.C.
3304(a)(2), as implemented by RFO – FAR 6.103-2, “Unusual and Compelling Urgency.” This acquisition is conducted in accordance with RFO – FAR Part 12 procedures applicable to acquisitions below $9 million.
Rationale for Use of Other Than Full and Open Competition The Government requires the immediate issuance of an emergency contract to ensure continuity of patient care and the uninterrupted delivery of essential laboratory services while a long-term contract, consisting of a base period and four option years, is being developed and awarded.
A delay in contract award would pose a substantial and unacceptable risk to all federal laboratory facilities within the Albuquerque Area, potentially resulting in the discontinuation of in-house laboratory testing for Erythrocyte Sedimentation Rate (ESR). Such disruption would adversely impact clinical operations and compromise the Government’s ability to meet its mission requirements for patient care.
Demonstration of Unique Qualifications / Nature of the Acquisition Due to the urgent and compelling nature of the requirement, and the need to avoid any lapse in critical laboratory services, the Government must proceed with a sole source acquisition. The selected contractor is the only responsible source capable of providing the required services within the necessary timeframe to prevent disruption.
Full and open competition would result in unacceptable delays and is therefore not in the best interest of the Government.
Conclusion Based on the foregoing, the use of other than full and open competition is justified to ensure continuity of critical healthcare services and to prevent adverse impacts to patient care and laboratory operations.
