2 SOW We have a Mentor Protégé agreement where our Mentor has a TS SCI facility clearance.

We do not currently have one.

Would we be considered eligible to bid and have our Mentor hold the facility clearance while we get ours sponsored?

If the offeror holds a TS SCI facility clearance, the offeror, mentor or protégé, may respond to the solicitation. The Government will not interfere with or forbid teaming arrangements. However, the

Government cannot sponsor interested parties for a facility security clearance to perform under the potential resulting contract.

3 N/A Is this a new requirement or a contract re-compete?

No, this is not a new requirement, it is a re-compete of an existing contract.

4 SOW Our company does not have a

Facility Security Clearance.

Will/Can the Government sponsor us for a Facility

Clearance.

No, the Government cannot sponsor interested parties for a facility security clearance to perform under the potential resulting contract.

Offerors must provide their own facility security clearance.

5 N/A The current document is not readable and appears to be a scanned document.

Our systems do not permit digital transference of documents, so we have no choice but to physically scan the solicitation documents.

6 RFP 4.2,

Technical/Management

Capability Subfactor 3:

Recruiting, Training and Retention: #5;

page 94 or 115

For the Key Personnel listed

(Senior Instructor), instructions are for Offeror to “provide a resume and a cover letter outlining the technical expertise of the key personnel.” For

“cover letter,” does the government mean a signed

Letter of Commitment by the proposed key personnel which is to be submitted as part of the proposal?

While a Letter of Commitment would be nice to include with the proposal, it is not required. A standard resume cover letter will suffice.

7 RFP 4.3, para 2, pg 94 Paragraph states, “…attached

Past Performance

Questionnaire (PPQ)…”.

However, the cited form was omitted from the RFP’s posting in SAM.gov.

Please provide the cited PPQ form.

PPQ form is now attached to the solicitation in SAM.gov.

(NDAA) that prohibits the U.S.

Department of Defense (DOD) from requiring a joint venture to hold a "facility access clearance" if the parties to the joint venture hold the requisite clearance.

Reinforcing the above statutory provision, the SBA revised its regulations governing joint ventures to address Section 644 of the Small

Business Act legislative provision to include the following provision with 13

CFR § 121.103(h)(S)c:

''Facility Security Clearances: A joint venture may be awarded a contract requiring Facility security clearance where either the joint venture itself or the individual partner(s) to the joint venture that will perform the necessary security work has

(have) a facility security clearance. "

Additionally, The GAO also has multiple rulings on this matter

(lnfoPoint, LLC. B-419856

(Aug 27, 2021).

2020 NOAA, SBA, GAO

rulings, and ISOO Joint Notice

2024-01 (Oct 5, 2023) Para 7 relating to a joint venture's facilities clearance.

Specifically, please revise the

RFP language in both sections to read:

“The offeror shall provide their

CAGE code identifying that the prime offeror has a current/active TOP SECRET

Facility Clearance.

If the prime offeror is an SBA-approved 8(a) Joint Venture, offeror shall provide the JV

CAGE code identifying that the
