52.212-1 ADDENDUM – INSTRUCTIONS TO CONTRACTORS - - COMMERCIAL ITEMS (DEC 2006)
The following additions/changes are made to FAR 52.212-1(b) Submission of offers and (c) Period for acceptance of offers:
(1) This solicitation is issued as a Request for Quote. Therefore throughout this document the term “offer” will refer to “quote” and the term “offeror” will refer to “contractor”. All offers shall be received NLT Refer to SF1449 Block 8 Eastern Standard Time (EST) by the office shown below. Facsimile (fax) offers will not be accepted. Only electronic submissions of e-mailed offers or commercial/Government carrier or hand carried will be accepted. E-mailed offers will be accepted as follows:
(i) The size of e-mail offers with or without attachments cannot exceed 10mb. The Government’s server will reject any e-mail size greater than 10mb. The Government’s server will reject Personally Identified Information (PII) contained in e-mailed offers. Examples of PII include social security number, passport number, driver’s license number, or financial account or credit card number.
(ii) Due to the potential of Government server fire walls blocking submission of e-mail offers, the Government recommends contractors activate the “delivery receipt” option. The Government will not be responsible for blocked submissions of e-mail offers. Contractors should assume the e-mail offer was undeliverable if a delivery receipt is not received. Acceptable evidence to establish time of receipt for e-mail offers shall be a copy of the delivery receipt showing the date, time and correct e- mail address.
(iii) Offers shall be submitted electronically to: alicia.prince@am.dodea.edu and ensure subject line of the email is identified with the following information: "Solicitation # HEVAS6-16-T-0014 Offer".
(2) Offer Preparation Instructions: This section provides general guidance for preparing offers in regards to the format and content of the offer. Each volume shall be complete in itself. To assure timely and equitable evaluation of offers, contractors must follow the instructions contained herein. Contractors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements- in addition to those identified as evaluation factors or subfactors. Contractors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale.
(i) The offer shall include-
(A) Table of Contents;
(B) Subcontractor List: Company name, physical address, and DUNS (if applicable);
(C) Contractors Representations, Certifications and Other statements;
(D) Exceptions and/or Assumptions used in preparing the offer;
(E) Solicitation Cover Sheet (SF 1449 -- Page 1); Complete blocks 12, 17a, and 30a, b, and c.; and
(F) Three separate parts consisting of: Volume I-Technical, Volume II-Past Performance, and Volume III-Price.
(ii) Page Limitations. The following page limitations and number of copies shall be used by the contractor when preparing their offer:

(iii) Text type shall be Times New Roman or Arial, no smaller than 12 point with normal proportional spacing. Illustrations and tables shall be no smaller than Times New Roman or Arial 10 point.
Each volume of the offer will be submitted within one (1) email as a separate document/file. Each document/file will identify the Contractor’s name, Volume number (e.g., “Volume I”, “Volume II”, or “Volume III), RFQ number “HEVAS6-16-T-0014”, RFQ title “Grounds Maintenance- Ft. Jackson”.
(I ) Volume I – Technical
The contractor shall ensure that no pricing is displayed in the Technical information.
Technical will be evaluated using the following procedures:
An assessment of the contractor’s demonstrated approach to meet the Government’s requirements will be rated on an acceptable/unacceptable basis, assigning one of the ratings described in the following Technical Acceptable/Unacceptable Ratings table below:

The technical offer shall specifically address the following two (2) technical subfactors:
(i) Management Plan. To be considered technically acceptable, the management plan shall demonstrate the contractor’s technical ability to perform the requirement as stated within the PWS. The document includes a Management Plan that describes the process by which quality of service will be measured. The plan shall address the contractor’s hiring practices, employee standards/requirements, employee training, employee incentive/retention programs, and vetting processes in sufficient detail to demonstrate that contractor’s ability to successfully perform the requirements of the PWS.
The contractor’s Management Plan shall include:
a. A Contractor Organizational Chart that clearly shows the organizational structure and lines of authority;
b. Detailed information on the number of employees by type, the number of hours, schedules worked, licenses, professional certifications for each type proposed for use on this contract; and
c. A detailed plan to provide adequate manning to include a minimum of one (1) Project Manager, sufficient oversight, and an effective work schedule to ensure uninterrupted services at contract start date in accordance with the PWS, and the plan to recruit and retain and provide for substitution and replacement of personnel to ensure an adequate staff to complete all tasks through the life of the contract.
(ii) Quality Control Plan (QCP). To be considered technically acceptable, the quality control plan shall be sufficiently specific, detailed, and complete to clearly and fully demonstrate that the prospective contractor has a thorough understanding of the solicitation requirements and importance of quality control.
The QCP shall address the following:
a. How the contractor will monitor performance and prevent deficiencies to ensure compliance with the PWS;
b. How the contractor will ensure all employees meet and maintain all safety, security, and licensing/training, and professional certification requirements;
c. How the contractor will monitor and report changes in personnel safety/background records (i.e.
arrests, DUIs, etc.) to maintain compliance with the personnel requirements in the PWS throughout the performance of services; and
d. How the contractor will evaluate and resolve immediate safety related incidents and implement preventive measures for future safety related incidents.
(II) Volume II - Past Performance
Past Performance will be evaluated in accordance with FAR 13.106-2(b)(3) and DFARS 252.213-7000. Past Performance shall include:
The past performance section provides an assessment of the contractor’s probability of meeting the minimum past performance solicitation requirements. The Government will review recent and relevant performance within the past three (3) years of similar scope, magnitude, and complexity to the service required to be performed (See FAR 52.212-1(b)(10)).
The evaluation of past performance will take into account past performance information regarding predecessor companies or subcontractors that will perform major or critical aspects of the requirement.
Past performance information pertaining to a subcontractor cannot be disclosed to the prime contractor without the subcontractor’s consent.
The Government may use past performance information provided by the contractor’s references, list of contracts for last three (3) years, and Past Performance Information Retrieval System (PPIRS) to rate the contractor. Contractors with no relevant past performance information shall provide a written statement attesting to such. In the case of a contractor without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the contractor may not be evaluated favorably or unfavorably on past performance (see DFARS 213.106-2(b)(i)(C). Therefore, the contractor shall be determined to have unknown past performance. In the context of acceptability/unacceptability” unknown” shall be considered “acceptable.”
The Government requests three recent and relevant references completed by previous/existing customer(s) using the questionnaire format (See Attachment 2 of the solicitation). The questionnaire must be completed and mailed by the customer to the address at 52.212-1(2) or email directly (questionnaires only) to: alicia.prince@am.dodea.edu. These references shall be for work similar to this solicitation in terms of service/support, complexity, dollar value, contract type and within the past three
(3) years. Contractor shall identify the three references in their offer and strive to ensure the reference information is submitted to arrive no later than 20 May 2016, 2:00 PM EST.
List of contracts for last three (3) years: Contractors shall also submit with the offer a list of relevant current and completed contracts within the past three (3) years as of the release date of this solicitation.
These references shall be for work similar to this solicitation in terms of service/support, complexity, dollar value, contract type and within the past three years. The list shall contain the following information for each reference:

(III) Volume III – Price
Price will be evaluated to determine whether it is fair and reasonable in accordance with FAR 13.106-3.
Price shall include-
(i) Price Schedule. The Price Schedule located on pages 3-7 of this SF1449 shall be submitted fully completed and error free. It shall contain the contractor’s prices for the established Contract Line Items Numbers (CLINs). The contractor shall provide all data required to make assessments of fairness and reasonableness. The price shall consist of the contractor’s price to successfully complete the proposed work identified in the PWS. Contractors must agree to hold the prices in its offer firm for 90 calendar days from the date specified for receipt of offers.
(4) Solicitation Questions: Questions concerning the solicitation document shall be submitted via E-mail to the Contract Specialist indicated below. 52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)
(a) The Government will award a single, firm-fixed price purchase order from this solicitation to a responsible offeror whose offer is most advantageous to the Government, price and other factors considered using FAR Part 12 and Subpart 13.5 procedures. Award will be made to the offeror who submits the lowest priced acceptable quote with price, past performance, and technical considered. To be considered “acceptable” the offeror must receive an acceptable rating for the technical and past performance factors and subfactors. The Government will not award a contract to any vendor whose offer receives an “unacceptable” rating for any factor or subfactor. The following factors shall be used to evaluate offers:

(b) Options. The Government will evaluate price offer for award purposes by adding the total price for all options to the total price for the basic requirement. (c) A written notice of award or acceptance of offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.

The offeror shall complete only paragraphs (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site accessed through http://www.acquisition.gov . If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (q) of this provision.
(a) Definitions. As used in this provision--
“Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
“Forced or indentured child labor” means all work or service—

“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

Sensitive technology—

“Service-disabled veteran-owned small business concern”—
