ATTACHMENT 1

PERFORMANCE WORK STATEMENT (PWS)

Termite Inspection, Treatment and Annual Inspection

1. General: This is a non-personnel services contract to provide Termite Inspection, Treatment and Annual Inspection services for Ramey, Puerto Rico. The Government will not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the contractor who, in turn is responsible to the Government.

1.1 Description of Services/Introduction: The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform Termite Inspection, Treatment and Annual Inspection services for the Ramey schools as defined in this Performance Work Statement (PWS) except for those items specified as government furnished property and services. The contractor shall perform to the standards in this contract.

1.2 Background: DDESS Puerto Rico Ramey School personnel performed a visual inspection of certain buildings and detected subterranean termite infected areas (approximately 6,000 linear feet).

1.3 Objectives: The purpose of this contract is to provide subterranean treatment inspection, treatment and annual inspection services to detect and remove the termites.

1.4 Scope: The contractor shall perform Termite Inspection, Treatment and Annual Inspection services for the Ramey schools listed in Technical Exhibit 1.

1.5 Specific Tasks Performed:

1.5.1 The contractor shall provide Termite Inspection, Treatment and Annual Inspection services required for treatment and control of subterranean termites for the Ramey school buildings listed on Technical Exhibit 1.

1.5.2 The contractor shall provide at least one (1) initial inspection and complete treatment of eradication of termites to be completed within thirty (30) calendar days of award of contract.

1.5.3 The contractor shall perform annual inspection and any additional re-treatments if termites are discovered during the warranty period.

1.5.4 The contractor shall perform soil treatment by use of a termiticide that is effective for not less than five (5) years against infestation of subterranean termites. The termiticide shall be in a soluble or emulsible, concentrated formulation that dilutes with water or foaming agent, and formulated to prevent termite infestation. Use only soil treatment solutions that are not harmful to plants. Contractor shall provide quantity required for application at the label volume and rate for the maximum termiticide concentration allowed for each specific use, according to the product's EPA-Registered Label.

1.5.5 The contractor shall be licensed according to regulations of authorities having jurisdiction to apply termite control treatment for site location.

1.5.6 The contractor shall formulate and apply termiticides, which are labeled with a Federal registration number, to comply with EPA regulations, State and local laws, regulations, and ordinances.

1.5.7 The contractor shall NOT treat soil that is water saturated or frozen. The contractor shall NOT treat soil while precipitation is occurring. Contractor shall be responsible for ensuring that no termiticide gets into storm drains or other areas where water can be contaminated and in air ducts underneath buildings.

1.5.8 Contractor shall comply with the most stringent requirements of authorities having jurisdiction and with manufacturer's written instructions for preparing substrate.

1.5.9 The contractor shall be responsible for removal of all extraneous sources of wood cellulose and other edible materials such as wood debris, tree stumps and roots, stakes, formwork, and construction waste wood from soil and around foundations.

1.5.10 Fit filling hose connected to water source at the site with a backflow preventer, complying with requirements of Federal, State, and local regulations.

1.5.11 Consistent with commercial industry standards, the contractor shall, along the perimeter of each building, drill ½ “diameter holes in the concrete areas at every 12” horizontal distance extending to the dirt surface. In the dirt areas, cut a 3” wide X 3” deep continuous ditch along the perimeter of each building. Inject or pour the product Termidor to the holes or ditches in accordance to the manufacturer recommendations for volume consistent with a five (5) year warranty period.

1.6.1 APPLYING SOIL TREATMENT

1.6.1.1 Contractor shall mix soil treatment termiticide solution to a uniform consistency. Provide quantity required for application at the label volume and rate for the maximum specified concentration of termiticide, according to manufacturer's EPA-Registered Label, to the following so that a continuous horizontal and vertical termiticidal barrier or treated zone. Distribute the treatment evenly.

1.6.1.2 Foundations: Adjacent soil including soil along entire inside perimeter of foundation walls, along both sides of interior partition walls, around plumbing pipes and electric conduit penetrating slab, and around interior column footers, piers, and chimney bases; and along entire outside perimeter, from grade to bottom of footing. Avoid soil washout around footings.

1.6.1.3 Penetrations: At expansion joints, control joints, and areas where slabs will be penetrated.

1.6.1.4 Avoid disturbance of treated soil after application. Keep off treated areas until completely dry.

1.6.1.5 Protect termiticide solution, dispersed in treated soils and fills Use waterproof barrier according to EPA Registered Label instructions.

1.6.1.6 Post warning signs in areas of application.

1.7 PESTICIDE MIXING. The contractor shall not mix pesticides on Government property. All pesticides must be mixed prior to arrival at the installation.

1.8 PESTICIDE STORAGE. The contractor shall not store pesticides on Government property. All pesticides shall be stored off Government property, or inside of the secured contractor vehicle.

1.9 PESTICIDE DISPOSAL

1.9.1 All pesticides, rinse water, and containers shall be disposed of in accordance with label directions. The contractor shall dispose of any pesticides, pesticide containers, pesticide residue, Pesticide rinse water, or any pesticide contaminated article at an authorized disposal area off of Government property.

1.9.2 Contractor employees must provide proper identification to enter the Ramey school facility, may be subject to search and shall be restricted to work area site. Contractor employees must wear proper ID at all times. Contractor vehicle(s) must be properly marked and must have current and valid license tags and insurance. All vehicles and personnel are subject to search. All government facilities are non-smoking. No weapons will be allowed on the school premises.

1.9.3 The contractor shall conform to all fire prevention regulations and shall exercise every precaution in the storage of flammable material. Materials used in performance of work are to be carried in and out and never left on site where individuals might come in contact with portions of it.

1.9.4 The contractor shall ensure that all materials used in the performance of this contract shall comply with the current Armed Forces Pest Management Board standard pesticides list available to DOD Components and Agencies as approved for the Air Force (see attached Feb 11, 2015 DOD Pesticides List). Materials used by the Contractor shall conform to state and local laws and ordinances and shall be acceptable to the Facility Manager and approved by on site State environmental representative before application.

1.9.5 The contractor shall be exercise special care in the use of liquid insecticides in areas having asphaltic, mastic or linoleum floor surfaces to prevent damage.

1.9.6 Any buildings damage or otherwise affected by the operations of the Contractor shall be restored to a condition as good as existed before work commenced, without cost to the Government.

1.10 The contractor shall provide a labor and material warranty for a period of 5 years from acceptance by the Government of the initial treatment plan.

1.10.1 The contractor shall provide the Government with a written warranty signed by applicator and contractor certifying that termite control work, consisting of applied soil termiticide treatment, will prevent infestation of subterranean termites. If subterranean termite activity or damage is discovered during warranty period, contractor shall re-treat soil and repair or replace structural damage caused by termite infestation at no additional cost to the Government.

1.11 The contractor shall provide an annual inspection during the warranty periodt for the buildings listed in this contract. The annual inspections shall include but not limited to inspection and retreatment for occurrences of termite activity at no additional cost to the Government. Contractor shall provide the Government with a written inspection report following each annual inspection.

1.12 General Information

1.12.1 Quality Control: The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality control program is the means by which he assures himself that his work complies with the requirement of the contract. The QCP is to be delivered to the COR and CO within 15 days after contract award.

1.12.2 Quality Assurance: The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This QASP is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).

1.13 Recognized Holidays: The contractor is not required to perform services under this contract on the following observed Federal Holidays:

Thanksgiving Day

Independence Day

Christmas Day

1.14 Hours of Operation: The contractor is responsible for conducting business, between the hours of 7:00 AM and 4:00 PM (CST) Monday thru Friday except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. All inspections and treatment times shall be pre-arranged with the COR and shall be on a non-interference basis.

1.15 Special Qualifications/Certifications: Services to be rendered under this contract shall be provided by a qualified termite Extermination Company and applicator licensed to do business in the Commonwealth of Puerto Rico. Contractor shall hold a current and active charter and pesticide license issued the Commonwealth of Puerto Rico. Contractor shall furnish proof of charter and license when submitting their bid.

1.16 Contracting Officer Representative (COR): The (COR) will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration. The COR is authorized to perform the following functions: assure that the contractor performs the technical requirements of the contract: perform inspections necessary in connection with contract performance: maintain written and oral communications with the contractor concerning technical aspects of the contract: issue written interpretations of technical requirements, including Government drawings, designs, specifications: monitor contractor's performance and notifies both the Contracting Officer and contractor of any deficiencies; coordinate availability of government furnished property, and provide site entry of contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.
