(End of Addendum to FAR 52.212-1)
52.212-2 ADDENDUM – EVALUATION – COMMERCIAL ITEMS (DEC 2006)
Basis of Award
(a) The Government intends to award a single Firm-Fixed-Price (FFP) contract resulting from this solicitation under the Best Value-Trade-Off approach, to the responsible vendor whose quote is deemed most advantageous to the government in accordance with FAR Parts 12 and 13 procedures when price and other factors are considered. Most advantageous does not necessarily mean the lowest price Quote.
The Government reserves the right to not consider for award any quotation that does not adhere to the administrative requirements set out in the Instructions to Vendors found in Addendum to 52.212-1 of this solicitation.
For a quote to result in an awardable contract, it must at least be acceptable for Factor 1-Technical and Factor 2- Price must be determined Fair and Reasonable by the government.
The Government intends to award without discussions. Therefore, the vendor’s initial quote should contain the vendor’s best approach/terms for all the evaluation factors (technical and price). However, despite this intent, the Government reserves the right to conduct discussions if the Contracting Officer determines they are necessary. As noted in the Addendum to FAR 52.212-1, nonconformance with the instructors to offerors, and any administrative requirements provided in Addendum to FAR 52.212-1 proposal preparation and submission instructions may result in removal of the quote from further evaluation.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt unless a written notice of withdrawal is received before award.
(d) Section 508 Acceptance: Prior to acceptance, the government reserves the right to perform testing on required Information and Communications Technology (ICT) items to validate the Offeror’s Section 508 conformance claims. If the government determines that Section 508 conformance claims provided by the Offeror represent a higher level of conformance than what is actually provided to the agency, the government shall, at its option, require the offeror to remediate the item to align with the Offeror’s original Section 508 conformance claims prior to acceptance. Vendors may be ineligible for contract award if proposed ICT products or services are not compliance with Section 508 standards.
To make the award decision, the following factors and subfactors shall be used to evaluate offers:
Factor 1: Technical Subfactor 1: Terms of Service Agreement Subfactor 2: DoDEA Cloud Questionnaire
Factor 2: Price
Relative Order of Importance: Factor 1 – Technical Capability is significantly more important than Factor 2 – Price. A contract will not be awarded to an offeror with significant weaknesses and/or deficiencies as defined in FAR 15.001.
EVALUATION FACTORS
Factor 1 - Technical.
Technical Capability: The Government will evaluate the offeror’s approach to determine how well the offeror’s proposed approach meets or exceeds the requirements and tasks stated in Section 2.0 of the Performance Work Statement (PWS). Any unacceptable rating makes the overall proposal rating unacceptable and the offeror may not be evaluated further nor be considered for award.
The ratings for factor 1 are defined in the table below:
Rating Rating Standard
Good The vendor’s quote indicates a thorough understanding of and approach to the technical requirements, contains at least one strength, and the risk of unsuccessful performance is low.
Acceptable The vendor’s quote clearly meets the requirements, indicates an adequate understanding of and approach to the technical requirements, and the risk of unsuccessful performance is no worse than moderate.
Unacceptable The vendor’s does not clearly meet the minimum requirement of the solicitation, contains one or more deficiencies, and/or the risk of unsuccessful performance is unacceptable. Quote is unawardable.
Subfactor 1 – DoDEA Terms of Service Addendum: The Government shall review the offeror’s response to the Terms of Service Agreement.
Subfactor 2 – DoDEA Cloud Questionnaire: The government shall review the offeror’s response to the Cloud Questionnaire (Attachment 2) to ensure compatibility and acceptability to meet DoDEA’s Cloud Compliance requirements. Offeror’s may be ineligible for contract award if the government determines that the offeror’s responses represent risk of unsuccessful performance due to incompatibility with DoDEA’s Cloud requirements.
Subfactors 1 and 2 will be given a rating of Pass or Fail.
Factor 2, Price. The price quote will be evaluated but not rated. Offeror’s price quote will be evaluated to determine price fair and reasonableness in accordance with FAR 13.106-3. The Government will establish a total evaluated price based on the sum of all prices proposed within the solicitation Pricing Sheet found at Attachment 2.
In accordance with FAR 52.217-8, the option to extend services for an additional six months will be included within this solicitation. A six-month extension is within the total project scope of the solicitation. For purposes of evaluation of this extension, the Government shall use the Vendor’s pricing attachment response for the last option period. Evaluation of options shall not obligate the Government to exercise the option (s).
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The offeror shall submit pricing for the base period and all option periods. The government also intend to evaluate FAR 52.217-8, Option to Extend Services, and FAR 52.217-9, “Option to Extend the Terms of the Contract”. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c). A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt unless a written notice of withdrawal is received before award.
