PERFORMANCE WORK STATEMENT

American Sign Language (ASL) Interpreter and Teacher of the Deaf (ToD)/ Hearing Impaired (HI) Services, Quantico Schools

1. General Information and Scope of Work

0. Agency

0. For school year (SY) 2021-22, the Department of Defense Education Activity (DoDEA) will provide PK-12 instruction to over 69,000 dependents of military and civilian employees. Student enrollment is based primarily on deployment of military troops worldwide. In the Americas, DoDEA operates 50 schools located in seven states, Puerto Rico, and Cuba. In Europe and the Middle East, DoDEA operates 64 schools located in Germany, England, Netherlands, Belgium, Spain, Turkey, Bahrain and Italy. In the Pacific, DoDEA operates 45 schools located in Korea, Japan (mainland and Okinawa), and Guam. DoDEA's curriculum, resources and student achievement scores on standardized assessments compare favorably to those of high-performing US public school systems. DoDEA also operates a full time K-12 virtual school option with teaching hubs in each DoDEA region: Americas, Europe, and Pacific. Within that context, the virtual high school is fully accredited.

0. The following Quantico schools are part of DoDEA’s Mid-Atlantic District: Crossroads Elementary School (ES) which serves approximately 50 students and Quantico Middle School/High School (M/HS) which serves approximately 300 students.

1.2 Background: DoDEA is required to provide a free and appropriate public education to all students enrolled in its schools, including ones with disabilities. Per DoD Instruction1342.12, “Provision of Early Intervention and Special Education Services to Eligible DoD Dependents” (June 2015), DoDEA is required to provide American Sign Language (ASL) interpreting and Teacher of the Deaf (ToD) / Hearing-Impaired (HI) services.

0. Scope of Work—The Contractor shall:

1. Provide the necessary tools, supervision, expertise and resources to provide ASL interpreting and ToD/ HI services for qualifying students (currently three students have been identified), enrolled in the Quantico schools in the base year in accordance with the CSC’s approved individual education programs (IEPs). Depending on the IEP, services may continue in the extended school year (summer). Note: DoDEA cannot determine how many students will require services until (1) the families or commands of students currently being served inform the school that the family is transferring or (2) until a family of a student needing ASL and ToD / HI services enrolls.

1. Conduct sessions with qualified students in accordance with DoD Instruction 1342.12 and participate in CSC-guided IEP meetings, assessments, screenings, and other meetings as directed by the COR. Per federal regulations, students as young as three years old may be screened.

1. Direct services consist of the teacher of the (HI providing IEP-mandated services to a hearing-impaired student. Indirect services consist of screenings and meetings.

1. Requirement (Objectives)

2.1 (Objective 1) ASL Interpreter Services, Quantico Schools: The objective of the ASL is to provide ASL interpreting services to meet students’ IEP requirements. However, the Quantico Case Study Committee (CSC) is responsible for determining if a student requires ASL interpreting services. Prior to the receipt of ASL services, the CSC designs and approves a qualifying student’s individual education program (IEP.

The tasks listed below are provided to help the Contractor in gaining a better understanding of the requirements in order to successfully meet the objective. The tasks are not all inclusive as the Contractor is expected to develop the total solution for meeting all the requirements of the objective in accordance with a performance-based approach.

0. Supporting Tasks (Objective 1):

The Contractor shall perform services in accordance with the IEP-mandated goals for student(s) and shall ensure that the quality and accuracy of its services are maintained. The required services include the following:

Task 1: Provide approximately 6.5 hours of daily face-to-face sign language service—simultaneous translation from English — during school hours throughout the school year.

Task 2: Provide indirect services as directed by the COR such as IEP meetings, and parent meetings.

Task 3: Ensure that there is a backup ASL interpreter in case the primary ASL interpreter is absent or otherwise unable to provide the services.

2.1.2 Performance Standards and Acceptable Quality Levels (Objective 1)

The following applies to Objective 1:

2.1.2.1 Performance Standard: Tasks shall be completed by the required completion date.

2.1.2.2 Acceptable Quality Level (AQL 1): Ninety-five percent of tasks shall be completed by the required completion date. The remaining five percent shall be completed no later than ten days after their due date.

2.2 (Objective 2) ToD / HI Services, Quantico Schools: The objective of the ToD)/HI is to provide hearing-impaired services to meet students’ IEP requirements. However, the CSC is responsible for determining if a student requires hearing impaired services in accordance with required assessment components. Prior to the receipt of ToD/HI services, the Quantico CSC designs and approves a qualifying student’s individual education program (IEP). Currently, DoDEA estimates three students requires these services but could increased during the school year.

The tasks listed below are provided to help the Contractor in gaining a better understanding of the requirements in order to successfully meet the objective. The tasks are not all inclusive as the Contractor is expected to develop the total solution for meeting all the requirements of the objective in accordance with a performance-based approach.

2.2.1 Supporting Tasks (Objective 2): The Contractor shall perform services in accordance with the IEP-mandated goals for student(s). Services are required to be delivered face-to-face on school site or virtually as determined by the COR in writing.

(Task 1): Provide approximately 15 minute sessions of ToD / HI direct service to address the IEP-mandated needs of each student and provide a progress note quarterly. All direct services with the student shall be provided at the school site during the dates and times scheduled provided by the COR during the post-award meeting. Below is a breakout of services:

1. QMHS Student (Profoundly Deaf) #1: Approximately 60 hours of services of ToD services that address the student’s IEP performed each year, preferably at the school site but virtual sessions are an option. Approximately six hours per year for IEP meetings, parent meetings, etc.

1. QMHS Student (Mild Hearing Impairment) #2: Fifteen minutes of IEP services per quarter and one annual meeting.

1. CES Student (Mild Hearing Impairment): Fifteen minutes per month of IEP services and one annual meeting.

(Task 2): Provide approximately one hour screening sessions indirect services for eligible children aged 3-21 Provide all direct screening services at the school site or virtually, as required by the contracting officer’s representative (COR).

(Task 3): Provide consultation to DoDEA school personnel with preparation for IEPs.

(Task 4): Provide draft IEP goals and accommodations to the COR and school personnel within three school days of the meeting.

(Task 5): Conduct Functional Hearing Assessments (FHA) / Functional Listening Evaluations (FLE), per CSC recommendation and provide corresponding written report to the COR within three days prior to meeting.

2.2.2 Performance Standards and Acceptable Quality Levels (Objective 2) The following applies to Objective 2:

2.2.2.1 Performance Standard: Tasks shall be completed by the required completion date.

2.2.2.2 Acceptable Quality Level (AQL 2): Ninety-five percent of tasks shall be completed by the required completion date. The remaining five percent shall be completed no later than ten days after their due date.

2.3 (Objective 3) General:

The tasks listed under this Objective applies to the entire contract during the Period of Performance.

Task 1: The contractor must follow DoDEA’s local guidance and policies when providing services.

Task 2: Key Personnel—The Contractor shall provide the following qualified personnel: ASL Interpreter, and ToD / HI.

Teacher of the Deaf (ToD) / Hearing Impaired (HI): shall meet the following preferred six qualifications that has been verified before award by the COR:

1)Possesses a current ToD/HI certificate from the Commonwealth of Virginia or a state with reciprocity with the Commonwealth.
2)Has a minimum of three years of experience, preferrably, (scope of range) – across grade levelsof providing IEP services to students with deafness and/or hearing impairments in a school setting, preferably in an elementary school and secondary school.
3)Has at least three years of experience administering Functional Hearing Assessments (FHA)/ Functional Listening Evaluations (FLE).
4)Has experience developing and implementing IEP services in school settings.
5)Is proficient in English and possesses basic computer skills.
6)Possesses a clean criminal background check less than one year old and provide a copy five (5) days after contract award.

Task 3: Changes: Personnel provided as replacements to key functions after contract award shall meet or exceed the qualifications and experience of those provided upon award. Notify the COR in writing regarding all personnel changes ten business days in advance of the change.

Task 4: Attend all required (virtual and in person meetings) meetings.

1. Constraints

0. Place of Performance: Services shall be provided at the school site during the regular school year and extended school year. All services that require in-person attendance or instruction will be scheduled in the morning hours between 9AM and noon. Some indirect services may, at the COR’s discretion, be performed virtually.

0. Holidays and Hours of Operation: Contractor personnel shall be available during the hours of 9AM to noon Eastern Standard Time (EST), except for Federal holidays and Federal government closures/ shutdowns. The following list shows recognized Federal holidays: New Year’s Day, Martin Luther King Jr.’s Birthday, Presidents Day, Memorial Day, Juneteenth, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day, and Christmas Day.

0. Installation Security Requirements: Contractor personnel performing work under this contract shall follow the installation’s rules and regulations for contracted services.

0. Privacy—The Contractor shall:

0. Contractor Personnel: Monitor that personnel assigned to this contract take proper precautions to protect information from disclosure. Collect and/or store all agency-owned or agency-controlled PII IAW the relevant requirements of the Privacy Act, 5 U.S.C, which may be found at http://www.archives.gov/about/laws/privacy-act-1974.html.

Privacy Training: Monitor that Contractor staff who have access to DoDEA’s student, teacher and/or staff personally identifiable information take the DoD Privacy Act/ Personally Identifiable Information (PA/PII) training before gaining access to the data and yearly thereafter. Provide copies of the certificates of completion to the COR which can be audited at any time by the Chief Information Security Officer (CISO) or his/her designee.

0. Section 508 Compliance—Contractor resources, wherever applicable, meet the following requirements:

1. IT Requirement: The Contractor shall monitor that all electronic hardware and software that is procured under this contract/purchase order comply with Section 508 of the Rehabilitation Act of 1973, as amended, (29 U.S.C. 794d) and the Architectural & Transportation Barriers Compliance Board Electronic Information Technology (EIT) Accessibility Standards (36 CFR part 1194). More information may be found at http://www.section508.gov.

1. Deliverable Requirement: The Contractor shall provide (one) outputs/deliverables that do not adversely affect accessibility features of existing EIT technologies and (two) EIT related to the requirements of the contract that are accessible to people with disabilities, per 29 U.S.C 794(d). Regarding outputs/deliverables including functional performance, information, documentation, and support requirements, the Contractor shall follow the applicable standards from 36 CFR Part 1194 Subpart B, C and D.

0. Optical Character Resolution (OCR): The Contractor shall provide, upon request, two digital OCR copies of print materials in one or more of the following formats:

Organizational Conflict of Interest (OCI): The Contractor (including any subcontractor) personnel performing work under this contract may receive, have access to, or participate in the development of, proprietary or Privacy Act information (e.g., personal information, education, etc.) may create a current or subsequent OCI as defined under FAR Subpart 9.5. Whenever the Contractor becomes aware that such access or participation may result in actual or potential OCI, the Contractor shall (one) immediately notify the Contracting Officer (KO) in writing and (two) promptly submit a plan to the KO to avoid or mitigate any such OCI. Note: The KO will unilaterally determine if the Contractor’s plan is acceptable. If the KO determines the plan cannot satisfactorily avoid or mitigate an OCI, s/he may implement other remedies to include prohibiting the Contractor’s further participation in contracted requirements.

0. Security Requirements—The Contractor shall follow the guidance if the professional learning occurs on a military base/installation:

3.9.1 Installation/Base Passes & Access: The local supporting military installation will issue all required installation/base passes to Contractor employees at no cost to the Contractor. To be eligible to perform work under this contract, the Contractor shall meet all applicable installation/base access requirements. Passes shall always be in each Contractor employee’s possession while on a military installation. The Contractor shall return base passes to the appropriate office within one business day upon termination of employment or completion of this contract. The Contractor shall coordinate Installation/Base Passes Access well in advance of the projected start dates for their employees.

3.9.2 Visitor Policies: The Contractor shall monitor all Contractor employees strictly comply with established DoDEA visitor policies pursuant to DoDEA Regulation 4700.2, Internal Physical Security, March 2001 and DoDEA Regulation 4700.1, DoDEA Antiterrorism Program and Standards Para 4.7.11, which can be provided by the COR upon request. This shall include the mandatory use of visitor badges necessitating the positive identification of all visitors and Contractors. Visitor or Contractor non-compliance with the visitor policy will be documented within 24 hours of occurrence for follow-up with the Contracting Officer or Installation Commander, as appropriate.

0. Identification Badges: All Contractor and subcontractor personnel who require physical access to a Federally-controlled facility and/or access to a Federally-controlled information system shall follow the Federal Information Processing Standards Publication (FIPS PUB) Number 201 "Personal Identity Verification of Federal Employees and Contractors" and the associated Office of Management and Budget (OMB) implementation guidance for personal identity verification OMB Guidance M-05-24, dated August 5, 2005, "Implementation of Homeland Security Presidential Directive (HSPD) 12-Policy for a Common Identification Standard for Federal Employees and Contractors" as required under FAR 4.13. The Contractor shall provide picture identification badges to all Contractor personnel. Identification badges shall always be worn and visible while Contractor personnel are on Government premises. Badges shall display a recent picture of the Contractor employee, Contractor employee’s name, company name, and the badge expiration date.

3.9.4 Access to and Disclosure of Information: The Contractor may require access to data and information proprietary to a Government agency, another Government contractor, or of such nature that its dissemination or use, other than as specified in this contract, shall be adverse to the interests of the Government or others. Neither the Contractor, nor Contractor employees shall divulge or release data or information developed or obtained under performance of this contract, except to authorized Government personnel or upon written approval of the COR or designated representative. Disclosure of information regarding operations and services of the activity to persons not entitled to receive it, or failure to safeguard any classified, proprietary or other similar items or information that may come to the Contractor (or any persons under the Contractor’s control) in connection with work under this contract, may subject the contractor, contractor’s agent, or employees to criminal liability under Title 18, Sections 793 and 798 and/or other sections of the US Code. Neither the Contractor nor Contractor employees shall disclose or cause to be disseminated, any information concerning the operations of the activity that could result in, or increase the likelihood of, a breach of the activities’ security or interrupt the continuity of operations.

0. The Contractor shall direct to the COR, all inquiries, comments, or complaints arising from matters observed, experienced, or learned as a result of, or in connection with the performance of this contract, the resolution of which may require the dissemination of official information.

Inquiries received by the Contractor for work performed under this contract shall be referred to the Contracting Officer for evaluation under the Freedom of Information Act (FOIA) of 1975, Public Law 93-502, 5 U.S.C., Section 552. The Contractor shall not release any information concerning the project to the public without written authorization from the Contracting Officer.

The Contractor shall not release any information (including photographs, files, public announcements, statements, denials, or confirmations) on any part of the subject matter of this contract, or any phase of any program hereunder, without the prior written approval of the Project Officer/COR. Any documentation showing individuals’ names or other personal information will be controlled and protected. The provisions of the Privacy Act of 1974, Public Law 93-579, 5 U.S.C., Section 552a shall apply.

Consultation Services – Preparation for the development of IEPs as required by the COR.

Contract Line Item Number (CLIN) – Basic structural element in a procurement instrument describing and organizing the required product or service for pricing, delivery, inspection, acceptance, invoicing, and payment. The use of the term “line item” includes “subcontract line number”, (SLIN), as applicable.

Contracting Officer (KO) – The only individual with expressed authority to obligate (bind) the Government by means of entering, administering, and terminating contracts within the limits of the authority delegated via a Contracting Officer’s warrant.

Contracting Officer’s Representative (COR) – Qualified and trained Government employee, nominated by the requiring activity (RA) and appointed in writing by a KO primarily to perform specific technical or administrative functions on a specific contract(s); serves as the ‘eyes and ears’ of a KO to assure the Government’s best interests are protected via the terms and conditions of the contract(s) appointed. COR’s do not have authority to obligate (i.e., bind) the Government.

Contractor - Supplier or vendor having a contract to provide specific supplies or service to the Government. The term used in this contract refers to the prime.

Deliverable – Usually physically delivered items but may include such items as digital documents/reports.

Direct Services – The IEP-mandated specially designed hearing-impaired services provided by the teacher of the hearing impaired (THI) to hearing-impaired students at the school site.

Indirect Services - Indirect services consist primarily of screenings of students recommended by the case study committee, participation in IEP meetings as required by the COR, and meetings with the parents of the hearing-impaired student(s) the THI services. Screenings include the administration of the functional hearing assessment (FHA) / Functional Listening Evaluations (FLE). and are always performed at the school site. The other indirect services – including checking the functioning levels of augmentative communication devices such as hearing aids - are performed at the school site or virtually as determined by the COR.

Performance Requirements Summary (PRS) – Tabular listing of performance objectives and standards that provides the basis for a meaningful QASP.

7.2 Quality Assurance Surveillance Plan (QASP): The Government will utilize a QASP to monitor the contractor’s performance on the contract. The QASP is a living document and can change at any time during the life of the contract. As such, the Government reserves the right to unilaterally edit the QASP at the Government’s discretion.

52.212-1 ADDENDUM – INSTRUCTIONS TO OFFERORS - - COMMERCIAL ITEMS (JUN 2020)

TECHNICAL QUOTE REQUIREMENTS.

(A) The Offeror’s quote should include all data and information requested by these Instructions to Offerors (ITO) and be submitted in accordance with these instructions. Non-conformance with the instructions provided in this ITO may result in an unfavorable quote evaluation.

(B) The Contracting Officer and Contract Specialist are the sole points of contact for this acquisition. Communications with other officials may compromise the integrity of this acquisition and result in cancellation of the requirement.

Intent to Submit Offer.

For planning purposes only, please send an e-mail to Ms. Laura Holder at Laura.Holder@dodea.edu and Mr. Noah Mitchell at Noah.Mitchell@dodea.edu to give notification if your company intends to submit a quote in response to this solicitation. The subject of the e-mail shall be “Intent to Submit a Quote for HE1254-21-Q-4021.” Please provide the company’s name and point of contact to include name, title, address, e-mail, phone number, company’s DUNS, and NATO Cage Code. Failure to submit a notice of intent does not prohibit an Offeror from submitting a quote.

This solicitation covers two (2) objectives. Offerors can submit a quote for Objective 1 or Objective 2 or both of these objectives. Objective 3 applies to the entire contract regardless if submitting a quote to Objective 1 or Objectove 2 or both. Offerors will not be penalized for not providing a quote for fewer than both Objectives 1 and 2. The Government will evaluate Objectives 1 and 2 separately and award to the Offeror(s) making the best value offer to the Government.

Period of Performance.

This requirement will have one base year and four option years.

Submission of Questions.

This is a DRAFT SOLICITATION to allow vendors to submit any questions and to prepare a response. The final solicitation will be released no late than August 30, 2021. Interested vendors should email their intent to provide a response to the solicitation and all questions in writing via email no later than September 3, 2021 to the Contract Specialist, Ms. Laura Holder at laura.holder@dodea.edu and the Contracting Officer, Dr. Noah Mitchell at noah.mitchell@dodea.edu. Once the final solicitation is posted vendors will have two (2) weeks to provide a response. Any questions received after this date, may or may not receive a response. Offerors shall submit one (1) electronic technical and price quote, and past performance information in .pdf, or Microsoft Office (e.g. Word, Excel, etc.) format by e-mail on or before the closing date and time stated in Block 8 of the solicitation to Ms. Laura Holder, Contract Specialist, email at laura.holder@dodea.edu, and Mr. Noah Mitchell, Contacting Officer, e-mail at noah.mitchell@dodea.edu. To be considered timely, offerors must ensure that the signed and dated attached quote and all attachments are virus free, legible, and arrives in Ms. Holder’s and Mr. Mitchell’ e-mail inboxes by the solicitation closing time. E-mails over 10 MB will be rejected by DoDEA’s network. If the electronic copy cannot be opened, the Contract Specialist or Contracting Officer will notify the Offeror and a replacement electronic copy shall be provided by the Offeror within one (1) working day after notification.

According to FAR 4.1102(a), Offerors and quoters are required to be registered in SAM at the time an offer or quotation is submitted in order to comply with the annual representations and certifications requirements. Offerors not registered in SAM at the time of quote submission will not be evaluated for award.

Volume 1 – Factor 1: Technical Approach

Performance Work Statement (PWS) The offeror shall clearly describe their technical approach in providing services as outlined in PWS.

Additionally, the offeror shall submit an actual copy of a written Functional Hearing Assessments (FHA)/ /Functional Listening Evaluations (FLE) report with PII information redacted for evaluation, and provide a copy of the ToD / HI Certification

The quote should not simply rephrase or restate the Government’s requirements but rather, shall provide convincing rationale to address how Offerors intend to meet these requirements. Offerors shall assume that the Government has no prior knowledge or experience and will base its evaluation on the information presented in the Offer’s quote.

Volume II – Factor 2: PAST PERFORMANCE.

The past performance evaluation is a comparative assessment of the Offeror’s ability to successfully perform the contract based on the Offeror’s demonstrated recent and relevant record of how well the Offeror performed on previous contracts.

Offeror shall submit past performance information on at least two (2), but not more than five (5), recent contracts for the prime and subcontractors (performing as the Prime on that effort) to determine the recency and relevancy of the Offeror’s performance. To be recent, the effort must be on-going or must have been completed within the last three (3) years by the closing date/time of this solicitation. To be relevant, the Offeror must demonstrate that performance involved similar scope and magnitude of effort and complexities this solicitation requires. The relevancy analysis will focus on if the Offeror has provided hearing-impaired services similar in scope, magnitude of effort, and complexities.

Past Performance information submitted that is not recent (more than 3 years) and/or not relevant will not be evaluated.

i. The Government reserves the right to obtain information relative to present and past performance on its own, in addition to information provided by the Offeror and from contract and subcontract POCs. If you are aware that one or more of your contracts in the Contractor Performance Assessment Reporting System (CPARS) specifically relates to the requirements in this acquisition, please provide this contract/work effort as one of the past performance submissions with your quote.

Volume III – Factor 3: PRICE.

(A) This factor will not be assigned a rating. However, the Offeror’s price quote will be evaluated for reasonableness, and balancing of prices based upon the Offeror’s priced quote using the Pricing Sheet (Attachment 1) as follows:

1. Reasonableness. Attachment 1 must be complete for each Contract Line Item Number (CLIN) the Offeror proposes. Offerors should only fill-in (complete) the shaded cells in column(s) ‘F’ of the Pricing Sheet and be sure to complete all shaded cells for each CLIN being proposed.

The Government intends to award a contract without discussions with Offerors after quotations are received, however, the Government reserves the right to communicate with Offerors, if needed. It should be noted that there is no obligation on the part of the government to make an award to any Offeror in response to this RFQ.

Contractor Responsibility – To be eligible for award, the offeror must be determined responsible as defined in Federal Acquisition Regulation (FAR) 9.104-1.

52.212-2 ADDENDUM – EVALUATION – COMMERCIAL ITEMS (OCT 2014)

BASIS FOR CONTRACT AWARD This acquisition will be conducted using Federal Acquisition Regulation (FAR) Parts 12 and 13 (to include 13.5). FAR Part 15 source selection procedures will NOT be used for this acquisition. The Government will award a Firm Fixed-Price, Single Award Indefinite Delivery Indefinite Quantity (IDIQ) contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will offer the best value to the Government, price and other factors considered. The resulting IDIQ contract may be awarded to an Offeror with a higher priced quotation if the perceived benefits of the higher priced quotation merit the additional cost. The evaluation process shall proceed as follows:
