B. ADMINISTRATION, ACCOUNTING, AND APPROPRIATION DATA

The Administration Office and Accounting & Appropriation Data will be specified on each individual delivery/task order issued against the contract. Payment will be made by Electronic Funds Transfer (EFT) to the account registered in the Central Contractor Registration (CCR) database.

C. INVOICE SUBMISSION

1. Payment shall be based on receipt of a proper invoice and Contractor’s signed Certificate of Conformance. The Contractor shall comply with the content of invoice requirements specified at FAR 32.905, "Payment Documentation and Process," and at FAR Clause 52.212-4, paragraph (g) "Invoices." Failure to provide a proper invoice can result in return of invoice for correction and delay of payment.

2. Shipping and handling may be issued on a separate delivery order from materials.

D. Tax Exemption Status. DoDEA is an activity of the Federal Government. As such, state agencies are precluded from taxing them by reason of the Supreme Court decision in McCullough v. Maryland, 17 US 316 (1817). In addition, the various states have codified this immunity by appropriate statues. DoDEA Federal Tax Identification Number: 26-2331642.

E. Contract Type. Contract award type shall be a Firm-Fixed Price, Requirements Contract. The period of performance shall be a 12 month base year from date of award with four 12 month options.

F. Commercial Provision - Section 508 - IT Requirement. All electronic hardware and software procured under this contract/purchase order must comply with Section 508 of the Rehabilitation Act of 1973, as amended, (29 U.S.C. 794d) and the Architectural and Transportation Barriers Compliance Board Electronic Information Technology (EIT) Accessibility Standards (36 CFR part 1194). Further information is available via the Internet at http://www.section508.gov.

G. Overseas Shipments. The Contractor shall place a sticker on the outside of each box which states:

“FOR USE BY US FORCES, EDUCATIONAL MATERIALS”

H. PROOF OF SHIPMENT

Proof of shipment shall accompany invoices to initiate the payment process. This shall be accomplished by submitting the Contractor’s signed Certificate of Conformance as shown in the clause below:

52.246-15 CERTIFICATE OF CONFORMANCE (APR 1984)

(a) When authorized in writing by the cognizant Contract Administration Office (CAO), the Contractor shall ship with a Certificate of Conformance any supplies for which the contract would otherwise require inspection at source. In no case shall the Government's right to inspect supplies under the inspection provisions of this contract be prejudiced. Shipments of such supplies will not be made under this contract until use of the Certificate of Conformance has been authorized in writing by the CAO, or inspection and acceptance have occurred.

(b) The Contractor's signed certificate shall be attached to or included on the top copy of the inspection or receiving report distributed to the payment office or attached to the CAO copy when contract administration (Block 10 of the DD Form 250) is performed by the Defense Contract Administration Services. In addition, a copy of the signed certificate shall also be attached to or entered on copies of the inspection or receiving report accompanying the shipment.

(c) The Government has the right to reject defective supplies or services within a reasonable time after delivery by written notification to the Contractor. The Contractor shall in such event promptly replace, correct, or repair the rejected supplies or services at the Contractor's expense.

(d) The certificate shall read as follows:

STATEMENT OF WORK (SOW)

DEPARTMENT OF DEFENSE EDUCATION ACTIVITY (DoDEA)

EDUCATION DIRECTORATE

GEOMETRY CURRICULUM ADOPTION

1.0 BACKGROUND

1.1 The Department of Defense Education Activity (DoDEA) serves the educational needs of the dependents of military and civilian employees by providing PK-12 instruction to approximately 80,000 students in seven states, twelve foreign countries, Guam, and Puerto Rico. The number of students varies based on the deployment of military troops worldwide. DoDEA’s curriculum, resources, and student achievement scores on standardized assessments compare favorably to high-performing US public schools. Further information may be found at http://www.dodea.edu .

1.2 DoDEA is divided into three administrative areas. DDESS (Domestic Dependent Elementary and Secondary Schools) covers seven states, Puerto Rico, and Cuba. DoDDS (Department of Defense Dependent Schools) is divided into DoDDS-Europe and DoDDS-Pacific. DoDDS-Europe consists of England, Germany, Italy, Belgium, Netherlands, Spain, Portugal, Turkey, and Bahrain. DoDDS-Pacific includes Korea, Japan, and Guam.

2.0

INTRODUCTION

2.1 DoDEA has a requirement of instructional resources that promote student acquisition of knowledge and skills in Geometry mathematics classes. Specific content is identified in the DoDEA Mathematics Standards and can be reviewed at http://www.dodea.edu/curriculum/math.cfm?cId=stn&stndId=math .

2.2 All instructional materials and related professional development shall be based on current mathematics education research and best practices.

3.0

SCOPE

3.1 DoDEA standards are written for individual courses, the Government expects to award one contract for the Geometry mathematics textbooks. The estimated quantity to be ordered for each of the four 12-month option periods is five percent of the base period’s quantity.

3.2 The requirement is based on the number of students, teachers (including teachers in other programs who require mathematics materials). The estimated number of students in the base period (SY09-10) is shown below:

4.0

REQUIREMENTS

4.1 All materials should:

4.1.1 Preferably have a copyright date of 2008 or later.

4.1.2 Provide teachers and students with developmentally appropriate lessons and formative assessments for the age and stage of learning that supports students acquiring and practicing skills needed to understand mathematical concepts and use them to solve problems in the 21st century.

4.1.3 Correlation to DoDEA and National Standards: Offeror will provide a document self-certifying that all of its instructional materials are correlated to the DoDEA mathematics standards and National Council of Teachers of Mathematics (NCTM) Principles and Standards of School Mathematics. The DoDEA course standards can be found at the following URL: (http://www.odedodea.edu/instruction/curriculum/math/stands.htm). In addition, there shall be a correlation for the course by quarter to identify where the texts address each of the standards in the DoDEA scope and sequence.

4.1.4 Be supported by informal assessment materials and/or multiple criterion-referenced assessment components to measure student progress and target student instruction based on student needs.

4.1.5 Provide materials for differentiated instruction to meet the instructional needs of all students.

4.1.6 Have technology components that facilitate conceptual understanding and program delivery, which may be in the form of audio/text CD-ROM, online, etc.

4.1.7 Be free of racial, color, national origin, age, disabling conditions, sexual, religious, and ethnic bias, and shall present a balanced coverage of multi-cultural contributions, where appropriate.

4.2 The Contractor shall provide professional development (including Online and Guides), that are based on current research and best educational practices.

4.2.1 All professional development modules for the mathematics materials shall be correlated to the DoDEA curriculum content standards. The DoDEA Mathematics Content Standards may be found at the following URL: http://www.dodea.edu/curriculum/math.cfm?cId=stn&stndId=math . In addition, there shall be a correlation for each course by quarter to identify where the texts address each of the standards in the DoDEA scope and sequence.

4.2.2 The Contractor shall make all materials available throughout the duration of the curriculum adoption period and assure their copyright dates remain unchanged for the entire contract period.

5.0

TECHNICAL REQUIREMENTS

5.1 Section 508 Compliance: All software—stand-alone, network or web-based—shall be Section 508 compliant. (www.Section508.gov).

5.2 All online resources and instructional software shall meet DoDEA information security requirements, such as not containing vulnerabilities posing risk to the network. All software and websites will undergo preliminary testing to ensure that it poses no security risk to the DoDEA Infrastructure. Any IT component of the Contractor’s proposal that fails to meet DoDEA’s information security and technology requirements will be excluded from further evaluation. All software/Plug-Ins/Add-Ons shall meet DoDEA’s requirements for the DoD Information Assurance Certification & Accreditation Process (DIACAP), Defense Information Systems Agency (DISA) Information Assurance Vulnerability Assessment (IAVA) requirements, and Security Technical Information Guidance (STIG) standards. The contractor shall provide security patches, patch updates, upgrades, and work-a-rounds for software, including 3rd party applications, in response to public released vulnerabilities associated with their software solution. Contractor software solutions shall not interfere with other installed software and shall not modify the system security configuration. The Contractor shall develop and provide software upgrades within 30 days of notification should any of the software/plug-ins be found vulnerable and non-compliant with DISA standards. Software upgrades and patches shall be included in the licensing cost and performed at the least disruptive times. Any additional software requirements may be subject to the DIACAP process prior to contract award.

5.3 DoDEA requires the use of software which may be installed and/or accessed in a stand-alone environment, a network environment or web-based environment that is compatible with standards cited herein. All software shall be completely functional on a standard DoDEA desktop without the need for user rights greater than that of a member of the standard Windows 2000/XP/Vista local Users group. 5.4 All software tools must work from the DoDEA standard student login and shall not require any special user access or user rights.

5.5 All windows, fly-out menus, etc. must work from within an environment that blocks popup windows. Additionally, all web-based software shall not require the use of streaming videos or downloads, such as Java Applets.

5.6 The Contractor shall deliver any online materials on a web-based platform and provide course or video files in QuickTime v.6.0+ and Windows Media v.9+ formats, and /or Flash 6+ format that are compatible with the hardware and operating system requirements listed in Section 5.3. The software shall run successfully in the existing DoDEA environment.

5.7 The Contractor’s solution shall be robust enough to serve the needs of a large community of learners dispersed across the world using a variety of bandwidths. Contractor’s solution shall be scalable and able to expand to meet future growth, both in terms of the volume of instruction and the size of the student body.

5.8 Maintenance and support shall be available for the duration of the contract. Maintenance is defined as automatic distribution of upgrades and revisions that can be accomplished using a combination of Internet and or email. Any upgrades to online digital materials shall include compatibility with DoDEA school-level technology and Department of Defense (DoD) information technology requirements. The Contractor shall not contact schools directly but shall coordinate the dissemination of upgrades or revisions through the COR and will provide electronic access of the update and/or revision to the COR for testing.

5.9 The Contractor shall be willing to sign Non-Disclosure Agreements (NDA). The NDA will prohibit the disclosure, publishing, divulgence, or release of any information to include, but not limited to Information Technology Assurance and Compliance information.

6.0

PROGRAM REQUIREMENTS

6.1 The contractor should provide:

6.1.1 Geometry student textbooks (hardcover and CD or online); and have teacher edition (hardcover and CD or online) for the course.

6.1.2 Student supplementary materials, including but not necessarily limited to adaptive or audio/text CDs, etc.

6.1.3 Teacher supplementary materials, including but not necessarily limited to the following: lesson preparation/ instructional strategies/graphic organizers, differentiated instruction, vocabulary development, online resources (including student textbook and teacher editions), and assessments (hardcover and/or CD/online.)

6.1.4 Standards alignment correlation with DoDEA standards for the mathematics instructional and assessment materials. (http://www.odedodea.edu/instruction/curriculum/math/stands.htm). In addition, there shall be a correlation for the course by quarter to identify where the texts address each of the standards in the DoDEA scope and sequence.

6.1.5 Initial and ongoing individually administered Mathematics assessments which identify and analyze the student’s present algebraic skill level. These assessments allow for analysis and display of small group and/or class performance.

6.2 Student materials should:

6.2.1 Be based on research-based best practices for learning mathematical concepts and skills needed for the 21st century.

6.2.2 Be developmentally appropriate for high school courses and stage of student learning.

6.2.3 Provide lessons that support students acquiring and practicing skills needed to understand mathematical concepts and solve problems in the 21st century. These items should include fiction and nonfiction selections.

6.2.4 Include sequential mathematics skills and address various mathematics abilities from below grade level, advanced beginner, at grade level, and higher level skills.

6.2.5 Be of high interest, age-appropriate for students at the secondary level, and encourage students to think about their own performance and experiences (megacognition).

6.2.6 Include lessons and activities designed around contexts that model real-life situations, allow students to apply mathematical concepts, incorporate appropriate use of technology and make connections to other content domains.

6.2.7 Provide materials in various formats to include texts, short exercises, and presented in a manner that is visually stimulating with graphs, graphic-organizers, charts, and timelines. Materials shall include current, real-life samples (e.g., restaurant menus, inventory lists, rate tables and checkbook activities).

6.2.8 Provide high interest and hands-on student activities for developing mathematics skills while reinforcing reading skills—related to mathematics—such as vocabulary development, fluency, applications, and comprehension.

6.2.9 All student materials shall be provided in an electronic Optical Character Resolution (OCR) format, or PDF format, that is compatible with common OCR devices to convert written text into audio format. If not already available, the Contractor may be required to convert student texts into this format.

6.2.10 Have technology components to support student learning.

6.3 Teacher Materials should:

6.3.1 Include teacher guides and resources for all student materials, e.g., assessments, student reading texts, student activities, utilization with software.

6.3.2 Provide teachers with a variety of instructional and assessment strategies based on best practices for teaching a rigorous high school geometry program.

6.3.3 Assist teachers in designing developmentally appropriate lessons for the age, grade, and stage of learning that support students acquiring and practicing skills (thorough understanding of geometric concepts, computational skills, problem-solving strategies) needed to understand geometric concepts and solve problems in the 21st century.

6.3.4 Include multiple criterion-referenced (formative and summative) assessment components.

6.3.5 Include lessons that integrate technology at appropriate junctures and facilitate attainment of mathematical concepts.

6.3.6 All supplemental materials shall be provided in an electronic Optical Character Resolution (OCR) format, or PDF format, that is compatible with common OCR readers to convert written text into audio format for student use at time of delivery order issuance.

6.4 Training: The face-to-face training should be designed for an audience of District Mathematics Specialists who will deliver a professional development program to classroom teachers. The online modules are required for use by District Mathematics Specialists in their delivery of professional development for classroom teachers and administrators.

6.4.1 Mathematics Specialist Training: The Contractor shall provide up to three days of training for the Mathematics Specialists (approximately 30 people). This face-to-face training shall cover the information that will be placed in the online modules that will be used to train classroom teachers and administrators. It shall occur during winter of 2010-11, at a location to be determined and provided by DoDEA.

6.4.1.1 The face-to-face training shall:

· Be provided by content experts who are also experienced facilitators.

· Include any technology training necessary to fully implement the Contractor’s program.

· Include any ancillary materials that are part of the teacher materials 6.4.2 Online Modules: Based on the feedback from the Mathematics Specialists, 2-3 hours of online training for classroom teachers and one hour of online training for administrators shall be developed for the geometry program. The online modules shall focus on the way program materials should be used by administrators and classroom teachers to help students meet the DoDEA High School Geometry standards. They shall be accompanied by facilitator notes, which shall include the outlines, agendas, transparencies, support materials, DVDs, videos, and online resources that were used in the Mathematics Specialist Training. The Government will post the modules on the DoDEA Mathematics Virtual Learning Environment (VLE) for continued reference by DoDEA educators and instructional leaders throughout the life of the contract.

6.4.2.1 The online modules willl:

· Follow a model that will be approved by DoDEA mathematics staff,

· Provide a script for audiences to follow that explain the way program that materials support standards-based mathematics instruction, using interactive modules (PowerPoint or similar format) and online resources,

· Include any technology training necessary to fully implement the Contractor’s program,

· Include any supplemental materials that are part of the contract.

6.5 Classroom Observational Guides: For the course, the Contractor shall provide a 1-page Classroom Observational Guide, listing the key components of the program materials and research-based best teaching strategies observers should see when visiting the mathematics classrooms.

7.0

DELIVERABLES

The Contractor will:

7.1 Participate in a Post-Award Conference, which will occur no later than 15 business days after contract award and consist of a one-day meeting at DoDEA Headquarters in Arlington, Virginia, or tele-conference. At that meeting, DoDEA staff and the Contractor will review the contract; coordinate details for the following deliverables, including dates: mathematics Online Professional Development and the Classroom Observational Guides. Identify the quantities ordered for each school, and plan the professional development modules - to include reviewing the format of the module to be used. Additionally, discuss/plan for the conversion of all student materials into OCR or PDF Format.

7.2 Participate in a Professional Development Meeting, which will occur no later than 30 days after the Post-Award Conference. At this one-day meeting held at DoDEA HQ in Arlington, Virginia, the following deliverables, including dates, shall be discussed: Mathematics Specialist Training; Standards Alignment Correlations (including the DoDEA scope and sequence); Classroom Observational Guides; and the On-line Professional Development.

7.3 No later than 60 days after the post-award conference, the Contractor shall participate in a meeting to deliver the following:

· Present a dry run of the Mathematics Specialist Training, modules, and review of the facilitator notes that accompany the online modules.

· Provide a standards correlations document aligning the program materials to the DoDEA Geometry Standards.

· Provide a correlation for the course by quarter to identify where the texts address each of the standards in the DoDEA scope and sequence.

· Provide a Classroom Observational Guide for the course, listing key components of the program materials and research-based best teaching strategies observers should see when visiting Mathematics classrooms.

7.4 The Contractor shall make revisions to the draft on-line modules and materials within 30 days of receiving written feedback from the Government.

CONTRACTOR TRAVEL

Contractor costs for Government authorized travel are included in this contract. All travel shall be in accordance with FAR 31.205-46 and applicable travel regulations (Joint, Federal or Standardized). Contractor payment claims shall include applicable documentation to support actual costs incurred (e.g., airfare and hotel/lodging receipts) as well as any receipts valued at or above $75.00. Failure to provide appropriate documentation may result in loss of reimbursement of travel expenses.

This is not a delinquent tax because it is not a final tax liability. (iii) The taxpayer has entered into an installment agreement pursuant to I.R.C. Sec. 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(iv) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).

(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the certification will be considered in connection with a determination of the Offeror's responsibility. Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible.

(d) Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a) of this provision. The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.

(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. DoDEA intends to award a single contract for the stated Curriculum Program, but may award multiple contracts for supplemental materials.

52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate the offers: Technical, Past Performance, and Price. The order of importance of these factors is: Technical, Past Performance and Price. When combined Technical and Past Performance are significantly more important than price. The government is using Simplified Acquisition Procedures for this procurement.

Evaluation Factors:

Factor 1: Technical Capability/Quality of Products and Services. Offerors will be evaluated on how well they demonstrate their ability to perform the requirement as set forth in the Statement of Work as well as on the general quality of the proposed products and services.

Factor 2: Past Performance: Offeror’s Past Performance will be evaluated to determine the offeror’s likelihood of success on the present requirement.

Factor 3: Price: Price to include option CLINs will be evaluated to ensure price reasonableness. Price to include all option CLINs, will be considered by the Government when determining the best value offer.

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. .

Addendum to Provision:

(c) If the subject solicitation has been issued as a Request for Quotation, all references to offer and offeror are hereby changed to quote and vendor respectively, except for in paragraph (c), which stands as written. If a quote is provided, the Government may make an offer based on all or part of a vendor’s quote, as originally presented or as subsequently modified.

(d) If any component of the contractor’s offer or quote is not acceptable to the Government, then the Government may reject the offer or quote without further evaluation.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (AUG 2009) ALTERNATE I (APR 2002)

An offeror shall complete only paragraph (b) of this provision if the offeror has completed the annual representations and certifications electronically at http://orca.bpn.gov. (a) Definitions. As used in this provision:

"Emerging small business" means a small business concern whose size is no greater than 50 percent of the numerical size standard for the NAICS code designated.

"Forced or indentured child labor" means all work or service-

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174).
