PERFORMANCE WORK STATEMENT

1.0

PURPOSE.

The Department of Defense Education Activity (DoDEA), Domestic Dependent Elementary and Secondary Schools (DDESS), requires comprehensive elementary and middle school level special education program services for eligible dependent children of Department of Defense personnel residing on the U.S. Military Academy installation at West Point, New York. These services shall be provided in a highly structured educational setting and include specially designed instruction and related services to implement the student’s Individualized Education Program (IEP) goals. Historically, the requirement for these services has ranged between one and four children in a given school year.

2.0 BACKGROUND.

2.1 Specially designed instruction and related services in a highly structured educational setting is mandated for provision of special education services to DoDEA students with disabilities under the 32 CFR Part 80 entitled, "Provision of Early Intervention Services to Eligible Infants and Toddlers with Disabilities and Their Families, and Special Education and Related Services to Children with Disabilities within the Section 6 School Arrangement."

2.2 The DDESS Case Study Committee (CSC) is responsible for determining if a student requires an out-of-district specialized educational setting in accordance with a student’s IEP goals. An IEP is the document written by the CSC that establishes the goals and services that must be provided to a student with a disability in order to provide a Free Appropriate Public Education (FAPE). The required services shall be provided with linkage to the educational needs of the student rather than to the medical needs of the student.

3.0

SCOPE OF WORK.

The contractor shall provide all necessary labor, services, administration, supplies, and equipment to provide comprehensive elementary and middle school level special education program services and successfully implement each student’s IEP. The contractor shall provide the required educational program in accordance with the laws of New York State as well as applicable United States laws and regulations. The contractor shall be approved by the New York State Secretary of Education to operate schools, grades PreKindergarten (PK)-8 in the state. The contractor shall ensure that safety and security policies and practices are in place and comply with all federal and state policies and practices.

4.0

PERIOD OF PERFORMANCE.

August 1, 2008, or date of award, whichever is later, for School Year (SY) 08-09 with the option to extend services for up to 4 one-year periods.

4.1. School Year Calendar. The regular school year calendar shall include a minimum of 180 days of instruction. The Extended School Year (ESY) term shall include 30 days of instruction. The calendar shall be consistent for all students served in this educational setting.

4.2 Place of Performance. The contractor shall provide the educational program at a facility that can be reached in one hour or less from the West Point Academy.

5.0

TECHNICAL REQUIREMENT:

The contractor shall:

5.1 Be approved by the New York State Department of Education to operate schools and education services for grades PK-8.

5.2 Be experienced in IEP development and linkage of goal development and services to educational needs rather than medical needs.

5.3 Be capable of providing a full day school program with complete implementation of the student’s IEP goals.

5.4. Provide a safe and secure environment for the students and staff that complies with all federal, state, DoD, and local laws and regulations.

6.0 TASKS TO BE PERFORMED:

The Contractor shall:

6.1.

Participate in a post-award conference after contract award, as coordinated by the Contracting Officer's Representative (COR).

6.2 Provide direct specially designed instruction and related services in accordance with each student’s IEP goals.

6.3 Provide consultative services to staff at West Point schools, parents, and students in accordance with IEP goals

6.4 Develop revised IEPs for students found eligible for services. The Pupil Personnel Services Coordinator or a designee from the West Point Schools shall participate in the Case Study Committee (CSC) meetings to revise IEPs for modification and annual review purposes.

6.5 Complete educational assessment reports per the request of the Case Study Committee (CSC). Reports shall be submitted to the COR within 30 school days of request date.

6.5. Provide for Safety and Security of Students, Personnel, and Facilities. The Contractor shall be responsible for technology and security requirements and shall be in compliance with DoD Directive 2000.12, "DoD Antiterrorism/Force Protection Program," April 13, 1999, DoD Instruction 2000.16, "DoD Antiterrorism Standards," June 14, 2001 and DoDEA Regulation 4700.1, "Department of Defense Education Activity Antiterrorism (AT) Program,” September 6, 2002.

7.0 PERSONNEL REQUIREMENTS.

7.1. Manager(s). The Contractor shall appoint a Primary and Alternate Manager who shall be responsible for all services performed under this PWS. The COR and the School Officials must be able to contact either the Primary or Alternate Manager at any time, regarding emergencies, severe weather notification, or other similar urgent non‑routine matters. The Primary or Alternate Manager shall be immediately available to go to the scene of an accident or other emergency.

7.2. Criminal History Background Check. The Contractor shall complete a Criminal History Background check for each applicable proposed employee working under this contract in accordance with New York state law and school district procedures.

8.0. QUALITY CONTROL AND ASSURANCE.

Contractor shall develop and maintain a quality program to ensure educational services provided to West Point students are performed in accordance with commonly accepted state and federal standards. The contractor shall develop and implement procedures to identify and prevent defective services from recurring. At a minimum, the contractor shall develop quality control procedures that address the areas identified in Table 1 below. The contractor must provide a specific quality control point of contact in case of customer complaints. The government will periodically evaluate the contractor’s performance in these same areas.

This includes failure to provide service sessions (such as physical and occupational therapy (PT and OT)) that are included/provided under the basic tuition cost as well failure to provide any required separately priced service session that is in addition to the basic tuition.
6.2
For each service session missed, the cost of the service session will be deducted based upon total service divided by the number of sessions included in that cost.*

* For example: If the student’s IEP requires remedial reading sessions at one session per week, and the total service cost represents a total of 40 sessions, then a deduction = to 1/40th of the total service cost be deducted for each missed session.
