PROPOSAL INSTRUCTIONS

I. INTRODUCTION

The Defense Threat Reduction Agency (DTRA) intends to award a firm-fixed priced contract resulting from this solicitation to the Lowest Priced, Technically Acceptable (LPTA) offeror. The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)).

This solicitation is being issued as a Small Business set-aside. The NAICS code for this procurement is 713990 and the size standard is $7.5 Million.

This solicitation is formatted as a Request for Proposal (RFP) in accordance with the requirements designated by Part 15 of the Federal Acquisition Regulation (FAR). This method permits evaluation of proposals based on price competition, technical acceptability, and other factors; permits impartial and comprehensive evaluation of the offeror’s proposals; permits discussions if necessary; and ensures selection of the source whose performance provides the best value to the Government. This acquisition will be solicited as a competitively negotiated procurement as a total small business set-aside.

The Government reserves the right to reject any or all proposals at any time prior to award; to negotiate with any or all offerors; to award the contracts to other than the offeror submitting the lowest total price; or to award to other than the offeror submitting the highest technically rated proposal.

OFFERORS ARE ADVISED THAT AWARD MAY BE MADE WITHOUT

DISCUSSIONS OR ANY CONTACT CONCERNING THE PROPOSALS

RECEIVED. Therefore, proposals should be submitted initially on the most favorable price and technical terms. Offerors should not assume that they will be contacted or afforded an opportunity to qualify, discuss, or revise their proposals. However, the Government reserves the right to clarify certain aspects of proposals or conduct discussions providing an opportunity for offerors to revise their proposals.

The LPTA process is selected as appropriate for this acquisition because the best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price.

An overall non-price factors rating must be evaluated at least “ACCEPTABLE” in order to be eligible for award. An “UNACCEPTABLE” evaluation rating for any of the technical factor elements #1-#16 shall result in the overall non-price technical factors proposal being rated “UNACCEPTABLE” unless corrected through discussions. An overall non-price technical factors rating of “UNACCEPTABLE” makes a proposal ineligible for award.

II. EVALUATION FACTORS

The solicitation requires the evaluation of price and the following non-cost/price factors: Factor 1 - Technical Requirements

Technical acceptability of Offerors will be based on the Statement of Objectives (SOO) dated 12 February 2024 and course credentials. The following elements will be assessed for technical acceptability:

The Government intends to award a contract resulting from this solicitation to the Lowest Priced, Technically Acceptable (LPTA) offeror. Please note: the Government reserves the right to reject proposals that are unreasonably low or high in price as determined through historical costs paid for the same or similar services and comparison with market pricing.

Technical acceptability of Offerors will be based on the Statement of Work (SOW) dated 15 February 2024.

Within the SOW the following tasks will be assessed for technical acceptability

Offerors must receive an “Acceptable” rating in all requirements listed in the above table to be considered award.

PRICE

Offerors shall propose pricing for CLINs 0001, 1001, 2001, 3001, and 4001 Pricing for each individual CLIN (including Optional CLINs) and an overall cost/price total for the requirement shall be provided via a separate/attached quote on company letterhead. In addition to the quote, the Offeror must fill in all information required in block 17a of the solicitation (including Offeror’s Cage Code) and the SF1449 shall be signed and dated (Blocks 30a‐c) by an official having the authority to contractually bind the firm. A "complete offer" must include both attachments: the quote as well as the signed solicitation.

Price will be evaluated and considered but will not be scored or combined with other aspects of the proposal evaluation. CLIN level pricing for each separately priced CLIN shall identify the number of labor hours by labor category and employing organization that serve as the primary basis of estimate for proposed CLIN level pricing. Total labor hours by CLIN and for the proposed total price shall be clearly identified in the price proposal. They will also be analyzed to determine whether they are realistic for the work to be performed, reflect a clear understanding of the requirements, and are consistent with the information provided by the Offeror.

The otherwise technically acceptable lowest-priced Offeror may be required to confirm/validate its price on an elemental basis, and/or provide additional information in support of their price, prior to contract award at the Government’s request and discretion. In exceptional cases, when the determination of fair and reasonable price requires additional information, the Contracting Officer may conduct a cost analysis to support the determination of whether the proposed price is fair and reasonable.

Please be advised that if priced options are reflected in this requirement that they will be evaluated and considered in making the award determination to include establishing the basis of pricing any future exercise of the option described in FAR 52.217-8.

This award is also subject to acceptance of all terms and conditions of the contract and a determination of a fair and reasonable price. The Federal Acquisition Regulation (FAR), as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), will be used to evaluate the offer and award this requirement.

III. SOLICITATION SUBMITTAL REQUIREMENTS

A. In response to this solicitation, the Offeror shall submit an electronic copy of the proposal in accordance with the following instructions by the proposal due date:

1. Electronic Copies: Offerors shall submit electronic proposals (.pdf format/ Microsoft Excel) in response to this solicitation to terrie.l.overstreet.civ@mail.mil and russell.v.kelley.civ@mail.mil by 1500 on July 19, 2024. Offerors shall allow adequate time to upload files which may be slower for non-DoD users and to avoid other technical difficulties that may be encountered. Offerors are also responsible for submitting files in the format specified and consistent with requirements stated elsewhere in this solicitation.

Files that cannot be opened or are otherwise missing the required content are the responsibility of the Offeror.

2. The Offerors shall provide a cover page with the solicitation number, solicitation title, Offeror name, address, phone number, Unique Entity Identifier (UEI), CAGE code, Federal Tax ID number, identification of authorized company representative to enter into a binding contract with the Government, proposal Point of Contact (POC), POC phone numbers, and POC email addresses with its proposal.

3. SAM registration. Offerors shall ensure current registration on the SAM Website, www.sam.gov, including Annual Representations and Certifications are complete and updated for this procurement.

4. FAPIIS Certification. Offerors shall ensure Federal Awardee Performance and Integrity Information System (FAPIIS) Certification as required by FAR 52.209-7, Information Regarding Responsibility Matters.

5. VETS-4212 registration. Offerors shall ensure a current VETS-

4212 report has been submitted to the Department of Labor (DOL) website, http://www.dol.gov/vets/vets4212.htm, if the Offeror is required to submit. An email confirmation of submission can be requested and received by the Offeror from the DOL website and submitted in the price proposal. If the Offeror is not required to submit a report to VETS-4212, include a brief statement and justification explaining why the Offeror is not required to submit a report.

IV. PRE-PROPOSAL QUESTIONS (PPQs)

All PPQs must be submitted in writing and received by the Contract Specialist all questions shall be submitted to the specialist not later than 1500 EDT, 10 July 2024 in order to permit adequate time to reply to the PPQ. There is no guarantee that PPQs submitted after the cut-off date will be answered before the solicitation closes. STATEMENT OF WORK

DTRA RANGE SERVICES

1. Introduction / Background / Scope The Defense Threat Reduction Agency (DTRA) requires selected deployable individuals to maintain weapons proficiency. In support of this requirement, DTRA maintains a cadre of qualified instructors able to provide weapon qualification training.

This effort is to provide a safe area for DTRA-designated weapons instructors to conduct weapons training and qualification for DTRA personnel. It includes all required materials, to include access to weapons cleaning facility, necessary to conduct safe range operations.

The range must be within 60 miles of Fort Belvoir, Virginia. In addition, based on the fluid nature of the DTRA's Weapons Training Program, the logistical coordination involved to support this program requires a Range with the ability to reserve range times up to one (1) year in advance, year-round accessibility, and the ability to accommodate various type of firearms, range positions and distances.

2. Tasks / Requirements:

Allow access to stored range supplies by appointed DTRA authorized personnel only. Authorization for the use of DTRA qualified instructors and Range Safety Officers (RSO’s) conducting training of agency personnel.

DTRA instructors/RSO’s will use a ratio of six (6) students to one (1) instructor for static flat range training utilizing a 25m-300m flat range with 10-12 firing positions adjacent to one another.

Accommodate DTRA training which often requires the coordination/scheduling of quarterly range dates up to one (1) year in advance as well as accommodate range scheduling changes within 24 hours’ notice. Provide for the performance of twenty-five (25) weapons range training days annually.

Range Support Services:

During the period of performance, the contractor shall provide facilities and equipment in support of the DTRA Weapons Qualification and Sustainment Program. The Contractor shall provide facilities with the following capabilities or accommodations for the performance of twenty-five (25) training days:

Facilities Requirements:

a. Facilities capable of handling and accommodating the use of the following weapons:

M4A1 carbines, in semi-automatic, burst, and automatic configurations

M-17 MHS pistol

b. Facilities to accommodate both prone and standing shooting positions for M-17 pistols and M-4 rifles from 25 to 300 meters.

c. Facilities to accommodate practice firing and maneuver exercises performed during the day and night. This includes facilities which enable shooters to perform night firing out to 300 meters for zeroing and training with night optics.

d. Facilities to allow movement in depth and laterally on flat ranges with a four (4) student to one (1) instructor ratio.

e. Authorization for the use of DTRA qualified instructors and Range Safety Officers (RSO’s) conducting training of agency personnel. DTRA instructors/RSO’s will use a ratio of six (6) students to one (1) instructor for static flat range training utilizing a 25m-300m flat range with 10-12 firing positions adjacent to one another.

f. Facilities which enable the use of steel reactive targets on 25m flat range.

g. Facilities with a range out to 300 meters for rifle firing and flat stationary ranges for weapons qualification out to 25 meters.

h. Scheduled access to ranges during normal working/training hours to the facility for authorized DTRA Contracting Officers Representative (COR) personnel.

i. Facilities to accommodate training of up to twenty-four (24) students per day.

j. Facilities to accommodate parking, bathroom, and a break area for approximately twenty-four (24) personnel per day.

k. No restrictions on the number of personnel (instructors) required to be on site for operation of the range in accordance with applicable Occupational Safety and Health Administration (OSHA), Fire Department, and all other State and Federal regulatory restrictions.

Period of Performance: 12-month base year with four (4) 12-month options.

1. Purpose of Contract: The Defense Threat Reduction Agency (DTRA) requires selected individuals to maintain weapons proficiency. In support of this requirement, DTRA maintains a cadre of qualified instructors able to provide weapon qualification training.

This effort is to provide a safe area for DTRA designated weapons instructors to conduct weapons training and a qualification range for DTRA personnel. It includes all required materials, to include access to weapons cleaning facility, necessary to conduct safe range operations.

2. Review Responsibilities: DTRA OI-CO will be designated as the Contracting Officer's Representative (COR) and Project Officer (PO) for this contract. As PO/COR, OI-CO is responsible for interfacing with the contractor in the performance of duties such as those set forth below.

3. Methods and Frequency:

3.1 Surveillance will be accomplished in several methods: monthly, quarterly, and annual reviews. The method used for evaluation will be based upon reviews, observation, and received customer feedback.

3.2 Timely feedback to the contractor on unacceptable performance will be provided, in writing, by the COR, or other designated OI-CO government representative.

3.3 A summary of any performances that did not meet the terms and conditions of the contract shall be prepared by the COR, or other designated OI-CO government representative, and forwarded to the Contracting Officer (KO).

3.4 The surveillance report and a summary of the surveillance logs will be prepared by the COR and submitted to the KO annually. The COR may submit out-of-cycle reports to the KO to support claims of uniquely superior performance, unacceptable performance, or when there is a significant change in performance that alters the assessment in one or more evaluation areas.

3.5 The Summary Performance Surveillance Checklist, provided as Part III, will be used by the COR in monitoring this contract.

4. Performance Areas:

The following performance areas will be evaluated as described. However, they are not all- inclusive, and any service on this contract may be evaluated at any time; all services provided on this contract are subject to inspection and evaluation at any time.

4.1 The contractor will be evaluated on:

4.1.1 PRS Reference # 1, Training Support / Scheduling; Contractor’s effectiveness will be rated on the effectiveness in providing training support scheduling (i.e. available range times to support DTRA’s frequent changes). This performance area will be reviewed quarterly by the

COR.

4.1.2 PRS Reference # 2, General Facility Conditions; Contractor’s effectiveness will be rated on cleanliness, function, and availability of ancillary facilities, including restrooms / rest areas, classrooms, and parking areas. This performance area will be reviewed quarterly by the COR.

5. Evaluation Criteria:

Exceptional: Indicates performance clearly exceeds contractual requirements. The area of evaluation contains minor problems for which corrective actions appear to be highly effective.

Satisfactory: Indicates performance clearly meets the contractual requirements. The area of evaluation contains some minor problems for which the corrective actions appear satisfactory.

Marginal: Indicates performance meets contractual requirements. The area of evaluation contains a serious problem for which corrective actions have not yet been identified, appear only marginally effective, or have not been fully implemented.

Unsatisfactory: Indicates the contractor is in danger of not being able to satisfy contractual requirements, and recovery is not likely in a timely manner. The area of evaluation contains serious problems for which the corrective actions appear ineffective.

6. Surveillance Documents: Documentation used and referenced to perform surveillances will consist of reports, the statement of work, or Customer Feedback. Documentation shall include the date, time, and location of the surveillance; applicable remarks of the surveillance; and signature of the COR, or designated government representative. Unsatisfactory ratings must be signed by the contractor.

7. Rating: All contractor tasks will be rated as Exceptional, Satisfactory, Marginal, or Unsatisfactory. At the end of the contract or contract order, the KO, or designated representative, will collect the supporting documentation and provide an overall rating for each of the performance areas using the evaluation criteria in Paragraph 5 of this plan.

8. Recording Observations: A Performance Assessment Report (PAR) Form will be used to record each observed performance issue noted, for performance areas identified in Paragraph 4 or any other tasks identified in the SOW. The PAR becomes the formal record for reference.

The contractor is notified each time a performance issue is found during the observations.

9. Potential Unacceptable Performance: The COR, or representative, must identify the specific service that is unacceptable and the possible causes and ask questions in order to identify the source of the problem. The COR shall attempt to resolve the problem with the contractor.

9.1 The COR shall forward the original documents and the PAR documenting the observation and attempted solution (along with an evaluation of the results) to the KO, when a specific service becomes Unsatisfactory during a surveillance period. The surveillance reports will be used to provide an overall rating for the performance areas identified in Paragraph 4 of this plan.

9.2 The contractor shall complete a response to the unacceptable evaluation, if requested by the KO or by its own choice.

10. Taking Action:

10.1 The COR shall evaluate the contractor's performance and document any non-compliance, but only the KO may take action against the contractor for an unacceptable rating.

10.2 When the contractor's performance is unacceptable and a formal action is indicated, the COR and KO will determine what action is appropriate for the specific circumstances. The KO will determine the final action.

(a)(1) The North American Industry Classification System (NAICS) code for this acquisition is 713990.

(2) The small business size standard is $9,000,000.

(3) The small business size standard for a concern that submits an offer, other than on a construction or service acquisition, but proposes to furnish an end item that it did not itself manufacture, process, or produce is 500 employees, or 150 employees for information technology value-added resellers under NAICS code 541519, if the acquisition--

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL PRODUCTS AND

COMMERCIAL SERVICES (FEB 2024)

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.

(a) Definitions. As used in this provision --

"Covered telecommunications equipment or services" has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

"Economically disadvantaged women-owned small business (EDWOSB) concern" means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127, and the concern is certified by SBA or an approved third-party certifier in accordance with 13 CFR 127.300. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

"Forced or indentured child labor" means all work or service-

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

"Highest-level owner" means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

"Immediate owner" means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

"Inverted domestic corporation" means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).

"Manufactured end product" means any end product in product and service codes (PSCs) 1000-9999, except--

(1) PSC 5510, Lumber and Related Basic Wood Materials;

(2) Product or Service Group (PSG) 87, Agricultural Supplies;

(3) PSG 88, Live Animals;

(4) PSG 89, Subsistence;

"Place of manufacture" means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

"Predecessor" means an entity that is replaced by a successor and includes any predecessors of the predecessor.

"Reasonable inquiry" has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

"Restricted business operations" means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate--

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(3) Consist of providing goods or services to marginalized populations of Sudan;

(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

(5) Consist of providing goods or services that are used only to promote health or education; or

(6) Have been voluntarily suspended.

"Sensitive technology"--

(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically--

(i) To restrict the free flow of unbiased information in Iran; or

(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).

"Service-disabled veteran-owned small business (SDVOSB) concern" means a small business concern—

(1)(i) Not less than 51 percent of which is owned and controlled by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran; or

(2) A small business concern eligible under the SDVOSB Program in accordance with 13 CFR part 128 (see subpart 19.14).

(3) Service-disabled veteran, as used in this definition, means a veteran as defined in 38 U.S.C.
