JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN
COMPETITION
1. Description of action The Defense Threat Reduction Agency contracting activity proposes to procure without using full and open competition an effort entitled “Gas Chromatograph Toroidal Mass Spectrometer Specific (GC-TMS) upgrade” to make improvements to the seven Guardion-7 (G-7) GC-TMS instruments delivered to DTRA in Aug 2009 under HDTRA1-08-C-0069. This action would upgrade the government’s seven G-7 units to Torion’s current model Tridion-9 GC-TMS. The upgrade will take advantage of developments made to the GC-TMS technology through private investment by Torion Technology and Smiths Detection. Torion and Smiths have continued to develop, improve, and market the G-7 GC-TMS instrument since completion of the DTRA contract in 2009. The GC-TMS units will be upgraded from a G-7 EP2 to H Series TRIDION 9, improving mass resolution long term stability, mass calibration stability, altitude pressure stability, signal improvement, and the tuning, testing, and evaluation of the TMS module. The instruments will be evaluated during a DTRA/SOCOM operational validation after the upgrades are completed.
2. Description of the supplies/services required The DTRA Combating Terrorism Division (J9/CXC) supports research and development of counter WMD technology to combat threats facing the DOD Geographical Combatant Commanders. J9/CXC endeavors to enhance the Combatant Commander's capability to respond to conventional and Chemical, Biological, Radiological, Nuclear Improvised and Conventional Explosive Devices. The Torion G-7 GC-TMS Chemical Agent detector was developed by Torion in response to DTRA requirements in 2009 to bring laboratory gold standard chemical detection and identification of CWA and hazardous toxic industrial chemicals and materials (TIC/TIM) diagnostics to the field to be applicable in any environment.
The G-7 instruments were designed and built with modular components to allow for quick access and to facilitate upgrades and repairs. This effort will focus on purchasing specific TRIDION-9 hardware and software improvements that have been developed by private industry to be incorporated into the older G-7 GC-TMS models that DTRA possess. The purchase also includes a one year warranty, replacement of consumables used since original delivery, and a 2 day basic operator training course for 5 personnel.
Upgrade of the seven units is projected to take approximately 8 weeks. .
The TRIDION-9 instruments represent the only man portable field GC-TMS instruments available today that are battery operated, weigh less than 30 lbs, and have a resolution of one atomic mass unit (AMU). The Miniature Toroidal Ion Traps developed for this GC-MS are a unique design developed by DTRA, Brigham Young University and Torion Technologies. The Miniature Toroidal Ion Traps allow for a significant reduction in power requirements as well as a significant reduction in the physical size of the ion traps and the GC-MS overall. This has been accomplished without compromising laboratory standards for resolution and selectivity. There is
Defense Threat Reduction Agency 8725 John J. Kingman Drive, MS 6201
Ft. Belvoir, VA 22060-6201 not another instrument available today on the commercial market with these specifications that is man portable and can be used in the field in austere and rugged environments.
3. Statutory Authority The statutory authority for this non-competitive action is 10 U.S.C. 2304(c)(1), as implemented by Federal Acquisition Regulation 6.302-1, Only One Responsible Source, and Section 4202 of the Clinger-Cohen Act of 1996 (for commercial supplies and/or services)
4. Applicability of Authority This procurement meets the Simplified acquisition threshold” exception (2.101) for acquisitions of supplies or services that, as determined by the head of the agency, are to be used to support a contingency operation or to facilitate defense against or recovery from nuclear, biological, chemical, or radiological attack (41 U.S.C. 428a), the term means:
250,000 for any contract to be awarded and performed, or purchase to be made, inside the United States.
The acquisition will be used to fulfill a standing requirement supporting J9/CXC tasks in combating and defending against CBRN WMD.
DTRA has significant dollars invested in the development of the G-7 GC-TMS. The purchase of seven new TRIDION-9 instruments The upgrade of seven instruments and one year warranties on each unit The upgrades represent a significant savings, to the government and allows for an increase in capability to be realized in the shortest amount of time possible.
Based on the aforementioned facts and data, Torion Technology is the only source capable of meeting the Governments’ requirements for the upgrade of these devices.
5. Effort to Solicit Potential Sources Torion Technology is a small privately owned business that is the only source that produces the TRIDION-9 GC-TMS. Smith Detection has a non-exclusive agreement with Torion to market and sale their product to other Department of Defense agencies.
6. Fair and Reasonable Costs The anticipated cost/price of this contract action to the Government will be determined to be fair and reasonable based on published price lists, government estimates, and historical data.
7. Market Research Considerable research has been completed recently and over the past several years looking for commercial off the shelf, miniature (under 30lbs) one man portable, battery operated, Gas Chromatograph Mass Spectrometers that can be used to identify liquids, gases, and solids in austere and extreme environments that can provide analysis in under 5 minutes.
The only other system that comes close to TRIDION 9 is the HAPSITE from Inficom. The system takes twice as long to analyze sample and weighs almost 100 lbs to be able to do analysis on liquids, gases and solids. Cost of the HAPSITE is comparable to new cost of TRIDION-9.

8. Other Facts Seven Gas Chromatograph Toroidal Mass Spectrometers (GC-TMS) were developed by DTRA CSC with Brigham Young University in June of 2007 and Torion Technologies in Aug 2009.
Torion Technologies is a small business that has a commercial product available on the open market. The system is unique as no other GC-MS instruments exists on the market today that meets the specifications as outlined below for the TRIDION-9 GC-TMS.
a. The TORION-9 GC-TMS system is a hand portable, capillary gas chromatograph–toroidal ion trap mass spectrometer. The instrument is capable powering up from cold start to analysis in < 5 minutes with typical analysis run time of approximately 3 min/analysis.
Dimensions: 15.5” x 15” x 9”.
Weight: 32 lbs (fully self-contained including batteries, mechanical pumping system, and helium cartridge) Peak Power: ~120 w, Average Power: ~60w Sample Introduction: Solid Phase Micro-Extraction (SPME) Fiber GC: Low thermal mass capillary gas chromatograph o MTX-5, 5 m x 0.1 mm i.d. 5% phenylmethylpolysiloxane Mass Range: 45 – >500 Daltons Resolution: < Unit Mass Ion Trap: Miniature Toroidal
b. GC-TMS technology is the only technology capable of providing a multi-dimensional approach to analyzing complex compounds to separate and identify CWA’s, TIC’s and TIM’s to a laboratory standard that is field portable for use in austere environments. There is not another technology that can provide an equivalent laboratory analysis capability that is equal to GC-MS technology. The original G-7 GC-TMS instruments in particular were designed specifically for DTRA and SOF use to detect and identify Chemical Warfare Agents and Toxic Industrial Chemicals and Materials in the field with a greater than 95% accuracy without problems with interferents and mistaken identification.
To positively distinguish and identify all of the known CWA’s, any instrument used must have the ability to resolve atomic mass units smaller than 2 AMU. There are no other instruments currently available that are portable field instruments that can provide the same capabilities as the Torion Tridion-9. The Tridion-9 GC-TMS will provide DTRA and SOF forces with a positive CWA, TIC’s, TIM’s detection and identification capability of greater than 95% accuracy.
c. The improvements identified pertain directly to this instrument. They cannot be accomplished by any other vendor without the vendor purchasing the instruments and backward engineering the design. The uncertainty of a redesign and modifications provided by an alternate vender on an unfamiliar product that is under evaluation would be very costly and constitute a high risk venture.
9. Interested Sources None. Torion is the only authorized vendor to perform maintenance or upgrades without voiding warranties on the GFE.
10. Subsequent actions After the Torion Tridion-9 GC-TMS instruments have been upgraded and evaluated the instruments will be operationally evaluated by SOCOM for utility and subsequent additional purchases.
