ADDENDUM TO FAR 52.212-2

EVALUATION – COMMERCIAL ITEMS

A. BASIS FOR AWARD: The Government will award one (1) contract resulting from this solicitation. The source selection methodology is Best Value, Trade-off. The process permits trade-offs among cost or price and non-cost factors and allows the Government to accept other than the lowest price proposal or other than the highest technically rated proposal. Proposals will only be considered for award where all “high volume” core items are priced, minimum patron savings are provided for the base period and all option periods and other required information is submitted. Contract award will be made to the responsible offeror whose offer conforming to the solicitation will provide the best value to the Government considering the evaluation factors as stated below:

1. The following factors shall be used to evaluate offers:

Factor 1 - COMBINED TECHNICAL CAPABILITY/RISK

a. Sub-factor - Quality Program

b. Sub-factor – Resale Experience/Existing Commercial Relationships

c. Sub-factor - Force Protection

d. Sub-factor - Transportation

e. Sub-factor - Value Added Service

Factor 2 - PAST PERFORMANCE

a. Sub-factor – Quality History/Customer Satisfaction

b. Sub-factor - Product Delivery to Commercial Supermarkets/Commissaries

c. Sub-factor – Resale Business Relations with Commercial Supermarkets/Commissaries

Factor 3 – PRICE

2. Relative Importance of Evaluation Factors:

For evaluation purposes, the Combined Technical Capability/Risk evaluation factor is significantly more important than the Past Performance evaluation factor. Combined Technical Capability/Risk and Past Performance when combined are considered to be significantly more important than Price, as this provides the contracting officer with the broadest discretion in determining best value for the Government. Within the Combined Technical Capability/Risk evaluation factor, the Quality Program, Resale Experience/Existing Commercial Relationships, Force Protection, Transportation and Value added Services sub-factors are of equal importance to each other. Within the Past Performance evaluation factor, the Quality History/Customer Satisfaction, Product Delivery to Commercial Supermarkets/Commissaries and Resale Business Relations with Commercial Supermarkets/Commissaries sub-factors are all of equal importance to each other.

3. Subject to provisions contained herein, award will be made to the offeror who is deemed responsible in accordance with the Federal Acquisition Regulation (FAR), conforms to the solicitation requirements, and whose proposal, judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, represents the Best Value Trade-off procedure to the Government. It is the Government’s intent to award without discussions; however, in accordance with FAR 15.306, should discussions become necessary, the Government reserves the right to hold them. If this occurs, a competitive range may be determined and Offerors notified in accordance with FAR 15.306 (c)(2). Offerors are urged to reflect their best possible terms, to include cost related elements, since less than the best potential prices could result in exclusion of the proposal from further consideration. The Government reserves the right to award to other than the lowest proposed price.

Unrealistically high or low proposed prices may be grounds to eliminate a proposal from the competitive range based upon assessment that the offeror does not understand the requirement or the offeror has made an unrealistic proposal.

B. Evaluation Methodology and Ratings for Combined Technical Capability/Risk – Factor 1:

Combined Technical Capability/Risk: The technical proposals shall be evaluated using the evaluation sub-factor enumerated below:

At a minimum the offeror shall describe the following:

1. Quality Program: The offeror’s quality control and quality assurance system throughout the entire supply chain must be addressed. The offeror must describe, in detail, procedures in place to assure product quality, food safety and traceability.

2. Resale Experience/Existing Commercial Relationships: Describe in detail, your firm’s resale experience with work of similar nature, scope, complexity and difficulty that must be performed under the resulting contract of this solicitation.

3. Force Protection Measures: Describe what steps your firm takes to insure that products have not been tampered or contaminated throughout the manufacturing, storage and delivering process.

4. Transportation Plan: The proposal must describe the scope of current proposed transportation capacity. This solicitation requires for temperature controlled vehicles only.

5. Value Added Service: Describe your company’s plan how to support the commissaries with merchandising support, product promotion plans, Point of Sale (POS) material, store visits by vendor personnel, etc.

After the evaluation of each sub-factor of the technical proposals, each proposal shall be assessed as a whole in terms of the following:

Outstanding Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.

Good Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.

Acceptable Proposal meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.

Marginal Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.

Unacceptable Proposal does not meet requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable. Proposal is unawardable.

C. Evaluation Methodology and Ratings for Past Performance – Factor 2:

1. The information presented in the Offeror’s Past Performance documentation, together with performance information from the referenced points of contact and other sources available to the Government will be the basis of evaluation for this factor.

2. The offeror’s Past Performance in each contract will be evaluated based on the following sub-factor:

(a) Quality History/Customer Satisfaction; i.e. Compliance with contract requirements, item selection, fill rates, promotion schedule, conduct of liaison personal, non-conforming reports in comparison to delivered quantities.

(b) Product Delivery to Commercial Supermarkets/Commissaries; Reliability, Meets contract delivery schedule.

(c) Resale Business Relations with Commercial Supermarkets/Commissaries; Effective management, including subcontracts, reasonable/cooperative behavior, Responsive to contract requirements, Notification of problems, Flexibility, Pro-active vs. reactive.

3. The contractor’s Past Performance information will be used to determine how relevant a recent effort accomplished by the offeror is to the effort to be acquired as outlined in the statement of requirement. A Past Performance relevancy assessment rating of very relevant, relevant, somewhat relevant and not relevant as defined below:

4. The contactor’s Past Performance will be used to assess the Offeror’s expected performance as outlined in the statement of requirement in terms of performance confidence assessments. A performance confidence assessment rating of substantial, satisfactory, limited, no or unknown (Neutral) as defined below:

PERFORMANCE CONFIDENCE ASSESSMENTS RATING METHOD

Adjectival Rating Description Substantial Confidence Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.

Satisfactory Confidence Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.

Neutral Confidence No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned. The offeror may not be evaluated favorably or unfavorably on the factor of past performance.

Limited Confidence Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.

No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.

5. The Government may reject a proposal if it is found that any information that has a negative impact on the offeror’s Past Performance record has been deleted, misrepresented, or withheld.

D. Price: There is not a rating for the Price Evaluation Factor. Price will be evaluated by price analysis to determine price reasonableness. The Government may also conduct a price realism evaluation for Price (Minimum Percentage of Patron Savings). The Government will evaluate each offeror's proposed minimum guaranteed percentage of patron savings for the HVCI and the proposed prices for price reasonableness in relation to the total requirements of the solicitation. The proposed unit/case prices should reflect the application of the minimum percentage of 25% or more of patron savings for the HVCI. The proposed unit prices should reflect an accurate application of the proposed minimum percentage of patron savings during week of 13 – 18 Aug 2018 (CW 33) as stated in the solicitation and will indicate an understanding of the percentage of patron savings application, in addition to providing the government with the opportunity to perform a price realism assessment. Each offeror must submit a case and unit price for each designated high volume core item (HVCI). If an offeror does not submit a guaranteed percentage of patron savings for each group with its initial offer or price a HVCI, the proposal may not receive further consideration for award.

In determining price reasonableness for this requirement, the Government will use independent government market basket survey equivalents and direct competition between offers. The independent government market basket equivalent will be derived from the results of the market basket surveys conducted by the commissary store locations’ personnel assigned to the United Kingdom. The independent government market basket survey equivalents will provide the retail selling prices of comparable commercial supermarket chains within a 50 km radius for each commissary location for the same HVCI stated in the solicitation during a specified period of time. Potential offerors are permitted to obtain their own market basket survey equivalents using the same criterion at their own expense if desired.

The sum of the retail unit prices for all HVCI represents the overall average retail price of all HVCI for the United Kingdom. The total estimated evaluated price will serve as a “snapshot in time” for price reasonableness. The total estimated evaluated price is not the total estimated contract amount.

To evaluate an offeror’s understanding of the patron savings application, the offeror’s overall adjusted price (DeCA’s selling price) of the HVCI will be compared to the overall retail price (Independent Market Basket Equivalents) of the HVCI. The percentage difference resulting from this comparison will be compared to the Minimum Percentage of Patron Savings offered in the proposal. If the Minimum Percentage of Patron Savings offered in the offeror’s proposal is not within 10% of the comparison results, the offeror’s proposal may not receive further consideration for contract award.

The HVCI are identified by item in the solicitation and may only be changed by the Contracting Officer. All HVCI are required to be priced. Offerors may identify to the Contracting Officer any HVCI that is not available globally within the specification required by the solicitation. The Contracting Officer will provide final disposition on those HVCI identified. Proposed alternate HVCI submissions in lieu of the HVCI stated in the solicitation will be disregarded without the Contracting Officer’s consent. Failure to provide the HVCI required by the solicitation may result in removal from further consideration for contract award.

E. Evaluation of Options: The Government will calculate and evaluate as basis of contract award the total evaluated price for all HVCI and the respective patron savings percentage offered for the base period and all option periods. Evaluation of options shall not obligate the Government to exercise the options.

F. Notification: A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the proposal, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
