JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Office – Defense Commissary Agency, Store Services Support Division (CCQT); 1300 E Avenue / Fort Lee, Virginia 23801.
2. Type of Contract Action – Six Month J&A; MOD to contract HDEC08-14-C-0030 will be done for 4 months (additional 2 months will be used if necessary); Firm Fixed Price (FFP) Contract; Defense Working Capital Funds (DWCF).
3. Description of Supplies/Services – Acquisition is for Shelf Stocking, RSHA, RG, and Custodial Services at the Fort Hood II Commissary, located in Fort Hood II, Texas; Six Month J&A Estimated Amount is approximately $485K ($323K for 4 months; $162K for 2 months).
4. Authority Cited - The statutory authority permitting other than full and open competition that is applicable to this Justification and Approval (J&A) is FAR 6.302-2, Unusual and Compelling Urgency.
5. Reason for Authority Cited – An award to any other source at this time would result in unacceptable delays in fulfilling the requirement and an interruption of services. In the absence of these services, the commissary could be shut down and the military members and their families will be denied their full commissary benefit provided to them by statue under 10 USC §2481 and 10 USC §2484.
The six month J&A is necessary due to delays throughout the procurement process. The delays are primarily due to other urgent actions. The Technical Evaluation Board is scheduled to occur January 13, 2020 through January 22, 2020. It is anticipated an Award can be made to the apparent successful offeror within four months. A MOD will be executed for the full four months. If an Award cannot be made within the four months, an additional MOD will be completed for two additional months. The total bridge action is an estimated $485K ($323K for 4 months; $162K for 2 months).
6. Efforts to Obtain Competition – The justification in support of the agency’s request not to issue a sources sought notice is predicated upon the fact that the required services are deemed to be available only from the incumbent contractor. Centennial Management Services Inc., has been performing the services as a satisfactory level for the past year.
7. Fair and Reasonable Cost Determination – A MOD will be done for four months. A proposal was requested from the contractor on December 20, 2019 for the four month J&A period of performance. In accordance with FAR Part 15, the following techniques will be used to determine fair and reasonableness: FAR 15.404-1 (b) (2) (v) Comparison of proposed prices with independent Government cost estimates and FAR 15.404-1(b) (2) (vii) Analysis of data other than certified cost or pricing data provided by the offeror.
8. Market Research and Interested Sources – As indicated above, an award to any other source at this time would result in unacceptable delays in fulfilling the requirement and an interruption of services.
9. Actions to Increase/Foster Competition - This is currently a Small Business Requirement and the replacement acquisition solicitation was posted on FedBizOps on August 8, 2019.
10. Other Factors – N/A
